While the business and church communities stood tall during the recent Kingsland flood catastrophe, there was one glaring exception.  On 10-17-18, the Antlers Coffee Shop closed due to storm-related failure of the Kingsland water system. Patrons, however, are routinely allowed to get online outside even when the shop is closed.

A long-term coffee shop customer entered the hotel lobby to ask the desk clerk whether wifi was still up and running after the catastrophe.  She said it was and told the patron he could get online inside the closed shop.  She then asked him to have another regular customer who had just arrived outside to come in and get out of the cold as well.

Antlers co-proprietor Rick apparently quickly got wind of both customers, made quite a jackass of himself emulating the petulant narcissist currently occupying the Oval Office.  Aggressive stupidity at a time the Kingsland business community is indeed suffering, can least afford it.  Further proof positive of the old adage 'can fix ignorant, can't fix stupid.'

Why would, why should both customers put up with this?  Think this hasn't happened to others?M

Hey, Sheriff?  Is it true Llano County Attorney Becky Lange has advised you to stay out of the "Berardi Property Rights Denial-Damage To Pace Arrow-Deputy Leroy Rodriguez, Badge #764" fiasco?  That right, Bill?  Isn't that obstruction of justice?  Also true your deputies have advised the Bolens to accept the status quo and not force the no-trespassing issue with Greene?  If so, isn't that also obstruction and official oppression?  When will you do your job, Bill?  As an elected official, you answer to the public, forget?  -- No honor?  ... No honor at all? If the foregoing allegations are indeed true, didn't you swear an oath to uphold the law and Constitution?  Why aren't you doing so?  No guts?

Your deputy has been accused of abusing authority.  What action have you taken other than ignore the complaint?  Why aren't both Rodriguez and the County Attorney under criminal investigation?  The County Attorney appears to be obstructing justice, accepting the word of Greene in lieu of two surveyor companies who strongly assert otherwise.  Both the County Attorney and District Attorney have ignored complaints.  Par for the course in Llano County, isn't it?  Failed to do their jobs.  No surprise there, right, Bill?  Both receiving 'special consideration' up to and/or including a bribe from Greene?  Regardless, clearly, no justice in Nazi Llano County.  Bottom line?  Desperate need for an outside criminal investigation.  Conveniently, forget?  This County is ruled by men, certainly not rule of law and the United States Constitution.

Precisely, why there is desperate need for a new federal agency whose sole function would be to investigate, arrest, charge, and prosecute criminal law enforcement, prosecutors, and judges in a special court whose only mandate would be to adjudicate such cases.  Total independence.  Until that happens, the criminal bastards who falsely believe they run and own this hell hole County will continue to do as they please.

Ahrens frequently drives all the way through Berardi's property.  Coup de grace?  When Berardi complained to Llano County Deputy Idle about the trespassing, the officer's response was insane.  Said the Sheriff told him to tell Berardi since Ahrens believes she owns his property she can't be charged with trespassing.  Perfect Catch-22, right, Sheriff?  You're not fit for office, Bill.  Bribed by Johnny Greene?

Why is Theresa Ahrens allowed by your goons to dictate what vehicles can and cannot be parked on Berardi's property?  Ahrens claims she has proof the property belongs to her where the vehicle was parked.  Has failed to produce it.  Surveyors say otherwise.  Back up Berardi.  Yet, your jackbooted bastards refuse to enforce Berardi's property rights.  Why?  Somebody lining somebody's pockets, Sheriff?

Ms. Ahrens micro-mini portable 'house' is parked on an unused unmarked Llano County road.  Imagine that.  Madam County Attorney well-aware.  Has done nothing.  Shit squat.  Egregiously ignored her oath of office.  Someone bribing you, Becky?  Lining your pockets, Counselor?  Paying you not to sell the unused unmarked County road to Berardi?  Doesn't the County want and need the sale money, to say nothing of the resultant tax income?

Yet, you ludicrously assert that's not the County's legal position.  It's not?  Why not?  You claim you're not a real estate expert.  Rather than accept the advice of two surveyor companies, the Precinct 3 Commissioner, the Appraisal District, the Tax Office, and even the Sheriff himself, you've inexplicably chosen to follow the advice of property owner Johnny Greene, -- who conveniently happens to be reportedly in the oil industry.

Question to be asked.  Could you have received any 'consideration' in return, -- up to and including a bribe?  Only way to know for sure is for the District Attorney to conduct a criminal investigation.  Apparently, there has been none.  If not, why not?

Equally pointedly, why hasn't Llano County Deputy Leroy Rodriguez, Badge #764 been held criminally accountable for egregious abuse of power involving denial of property rights to this Kingsland property owner?  To say nothing of consequent resultant physical damage done to a motor home on that property.

Our achingly useless, worthless, gutless Sheriff has ignored an email vis a vis the damage this jackbooted thug is responsible for.  Interestingly, his fellow officers believe him to be an idiot.  Yet, the Sheriff continued to defend this piece of human excrement until he realized  this entire fiasco would not be swept under the carpet.

Rodriguez is indeed an idiot.  Would you believe this piece of crap ordered the motor home to be moved on to an unmarked unused Llano County road? That motor home has indeed been moved back to where it was parked before Rodriguez forced it to be moved.  Why hasn't the County paid for the cost of moving it back?  To say nothing of the damage.

Equally pointedly, why is it the County has allowed Theresa Ahrens to park and live in her tiny cottage on that very same road?  Why hasn't she been evicted by the County?  Why was she assessed taxes on an adjacent improvement she doesn't own?

Why is it, Counselor, Johnny Greene is paying for the attorney retained by Ms. Ahrens?  Is Greene attempting to make this all go away by bribery?  Greene has also informed Berardi he is going to sue.  For what?  Has Greene lost his mind?

What about Wells who installed a $4500 septic system on a lot turns out he does not own as a result of Greene, an outrageously inept County, to say nothing of the Llano County Attorney who remains equally determinedly clueless?

How about Bolen who hasn't a pot to piss in, but was nonetheless f--ked over by Greene to say nothing of an egregiously inept County, to say nothing of you and your goddamned equally incompetent office?

Llano County DA "Sonny Boy" is in the news.  Received an award.  The DailyTrib reports:

"The Texas Parks and Wildlife Commission recognized District Attorney Wiley “Sonny” McAfee on August 22 for his efforts in prosecuting natural and cultural resource violations as well as environmental crimes. The commission named the 33rd and 424th district attorney the 2019 Texas Parks and Wildlife Department Prosecutor of the Year. McAfee serves Burnet, Llano, Blanco, and San Saba counties. Elected in November 2012 and taking office on January 1, 2013, he has been instrumental in a number of high-profile cases involving Texas game wardens and Texas State Park police officers."

The District Attorney has ignored a complaint filed earlier by this publication regarding special treatment accorded Texas oil man Johnny Greene by the Llano County Attorney and Sheriff vis a vis a property dispute involving a local banker, three other local property owners with homes encroaching on land they don't own, one of which is on an unused Llano County road.  To say nothing of damage to a Pace Arrow motorhome on that property.  All a result of egregious abuse of authority by Llano County Deputy Leroy Rodriguez, Badge #764.  The circumstances of this fiasco can be found above in each and every edition of this publication since this happened two years ago.  The Sheriff, the County Attorney, and the District Attorney have all determinedly, concertedly ignored this ongoing, unresolved fiasco raising one ferociously pointed question.  How much were they bribed?

Cowardly fail to financially and/or materially support those fighting for all civil and constitutional rights and liberties at great personal cost and risk?  Get what you truly deserve.

This is nothing more than goddamned bullshit.  This money finds its way into the pockets of the corrupt, abusive bastards who falsely believe they run and own this hell hole.

Would you believe the last time the Sheriff's Office happened to be 'audited' during the Garrett regime, reportedly, auditors couldn't figure out what went where and why? Yet, surprise, surprise.  Nothing was done.  There has to be transparency.  There is none.  Why would these thieving bastards want any?  ... Right, Sheriff?  TL?  How else could they so easily steal and loot with virtual impunity?  Worse, this reinforces jackbooted power in this goddamned, godforsaken hell hole County.

The public has a right to know the histories of the Sheriff's goons.  Clearly, the Sheriff doesn't think so.  That is, where they came from.  Why they left where they were.  What is happening here is the Sheriff is using 'personnel matters' as a convenient excuse to deny the public access to the history of outrageously corrupt, abusive, inept officers who are no more than criminals themselves.

He's protecting his outrageously corrupt, abusive, inept jackbooted bastards.  Worse, the standards imposed by sheriff's offices statewide with the exception of metropolitan counties are well below those of DPS and city police departments.  Why?  So the corruption, abuse, ineptness, and outright stealing can continue unabated?  This has to change.  ... The public should understand Llano County authorities have it all sewn up.  Did you know the Texas Attorney General does not have the authority to investigate and prosecute County authorities on his own?  The District Attorney has to call for an investigation by the Texas Rangers.  Then, the State can prosecute if it so chooses.

Consequently?  Guess what?  Nothing will happen.  Nothing ever does.  The goddamned corruption continues unabated until you, the public, pressure authorities.  Precisely, why we all enjoy the 'best' government money can buy. Interestingly, the former Sheriff and District Attorney were reportedly forced to retire after an outrageous scandal involving a drunk driving police officer from out of town.  Including special treatment of the drunken son of a bitch that no other citizen caught doing the same would have been afforded.  An honest, honorable Llano County Deputy suffered the consequences. Forget? Great officers do not last in this hell hole County. ... Right, Sheriff?  TL?  "Sonny Boy?"  Madam County Attorney?

It was the second deadly shooting at U.S. naval base this week. Federal and state officials confirmed that the gunman was participating in aviation training, although they would not disclose details on his status with the Saudi military."

The following rings hollow, lacks credibility:

"President Trump said on Twitter that Saudi King Salman had called him “to express his sincere condolences and give his sympathies.” “The King said that the Saudi people are greatly angered by the barbaric actions of the shooter, and that this person in no way shape or form represents the feelings of the Saudi people who love the American people,” Trump tweeted."

Considering the recent brutal murder of a U.S.-based reporter by Saudi authorities outside this country, the 9/11 catastrophe committed by Saudi nationals, as well as the egregious looting of Americans for Saudi crude last four decades, those condolences ring hollow, seriously lack substance.

"Authorities would not release the name of the shooter and have said little else about the shooting, or their investigation into the deadly attack. It was unclear whether the three deceased victims were service members or civilians, said Lt. Cmdr. Megan Isaac, a Navy spokeswoman. Multiple people were taken to area hospitals, including two Escambia County sheriff’s deputies who are expected to survive. “I can tell you lives were saved because of the response of people both in uniform with the Navy and in uniform with Escambia County Sheriff’s Office,” Florida Gov. Ron DeSantis (R) said. “In one of the darkest days, I think, in the base’s history, you still saw some of that bravery and grit come out.”

The shooter in that incident was identified as an active-duty U.S. Navy sailor and his three victims as civilian Defense Department employees working on the base’s shipyard."

"Joshua Kaleb Watson was one of three people killed by a gunman Friday at Naval Air Station Pensacola, CBS News has learned.  The 23-year-old graduated this year from the United States Naval Academy, CBS News' David Begnaud reports. As a student, the Alabama native made the Dean's List, and he was captain of the rifle team. Watson's brother said in a Facebook post his final act saved countless lives.  "After being shot multiple times he made it outside and told the first response team where the shooter was and those details were invaluable," Adam Watson posted. "He died a hero," he said, adding, "we are beyond proud."

Uncommon Valor.

"CBS News has learned the gunman's name was Mohammed Saeed Alshamrani, a Saudi Arabian national and a pilot-in-training for the Saudi Air Force. He had been training in the United States since 2017. The FBI is investigating Alshamrani's social media posts and whether he acted alone. According to the Middle East Media Research Institute, a nonprofit based in Washington, D.C., someone matching Alshamrani's identity had an extensive online footprint. In a Twitter post, the writer says, "O American people, I'm not against you for being American, I don't hate you because your freedoms, I hate you because every day you supporting, funding and committing crimes not only against Muslims but also humanity."

Be interesting to see if this post is indeed that of the killer.

"Investigators are looking for any signs of radicalization going back to Alshamrani's upbringing in Saudi Arabia.  Investigators are not saying if the shooting was an act of terror. They have not stated a possible motive. "We are not prepared at this hour to confirm what may have motivated the shooter to commit this horrific act today," Rachel Rojas, special agent in charge of the FBI Jacksonville Division, said Friday. The sprawling naval base was locked down on Friday after Alshamrani – one of a few hundred foreign nationals training at the Naval Air Station Pensacola – stormed a classroom and opened fire with a handgun.  The FBI is trying to determine how a foreign national obtained a handgun, which is prohibited by law, and brought it onto the base. Defense Secretary Mark Esper said Friday he'll look at the vetting measures that go into accepting foreign nationals to be able to train."

"Police say the “emergency takedown,” which was caught on cellphone video, happened after the 29-year-old suspect spat in the officer’s face. Two Chicago police officers have now been relieved of their duties as officials investigate an arrest that was caught on camera and showed one of them slamming a man to the ground. The Civilian Office of Police Accountability opened an investigation into the Nov. 28 incident last week and recommended that the officer who was seen throwing the man to the ground be relieved of his police powers until the case is closed. On Wednesday, the agency recommended the second officer at the scene also be relieved, according to a statement."

This is, indeed, a highly-convoluted case.  Had thought about including it in last week's edition, but decided to hold off until additional information became available.  At that time, only one of the officers had been relieved of his duties.  Now, both are relieved, under investigation, an indication civilian oversight itself has a problem with how all this went down.  Complicating matters is the issue of the victim's mental illness as well as troubling claims made by the woman who took the video.

"Two officers could be seen in the video, which the city's mayor called "very disturbing," but only one was seen picking up the man and throwing him to the curb. Police say that Bernard Kersh, the 29-year-old man in the video, was under arrest for drinking in public when he became verbally abusive and then spit on, as well as threatened, one of the officers. Kersh has since been charged with aggravated battery of a peace officer, assault and resisting arrest. The young woman who took the now-viral video told ABC News that she did not see Kersh resist arrest. "That gentleman didn’t do anything wrong," Jovonna Jamison told ABC News in a telephone interview last Friday."

Additionally:

"Kersh's attorney told ABC Chicago station WLS that his client has been diagnosed with schizophrenia. "He's suffered from it for the last six years. He needs some serious help and the fact that the officer reacted the way he did was completely out of control," attorney Sami Azhari told the station. Chicago police spokesman Anthony Guglielmi previously said on Twitter the arrest was under investigation and the "actions depicted on a social media video" are being taken very seriously. Mayor Lori Lightfoot called the video "very disturbing." "While a single video does not depict the entirety of the interactions between the police and the individual, this particular video is very disturbing," she wrote on Twitter last Friday. Kersh was taken to the University of Chicago following the incident and treated."

The perpetrator should have simply been arrested, taken to jail.  Not body slammed.  Lack of professionalism, stunning.

"A Chicago police officer caught on video smashing a mentally ill man's head into the pavement is now facing a probe into whether he used excessive force. A new video is raising questions about the technique he used. In cellphone video taken by a bystander, officer Jerald Williams is seen body-slamming a man he'd been ticketing for drinking in public. It looked less like something he learned in the police academy, and more like something from a mixed martial arts cage match. Video shows him doing the same move. In the ring, Williams is known as Jerald "Bacon and Eggs" Williams. On the Chicago streets, he's assigned to the area south gang enforcement unit."

"The victim's family says he is a man with schizophrenia named Bernard Kersh who was unarmed and accused of threatening the officer and trying to lick him. He was knocked unconscious and hospitalized. His mother, Keshia Johnson, said he's still having headaches. "My son could have been killed. I think more needs to be done," she said. Kersh's attorney called the body slam "excessive force." "We think, based on that martial arts take down, it was potential lethal force," attorney Andrew Stroth said."

Could have killed him.  Become judge, jury, and executioner.

"While the body slam incident is under investigation, Williams and his partner have been taken off the street and put on desk duty.  CBS News reached out to the police and were told Williams would not be available for an interview."

Another rogue former trooper.  CBS News reports:

"A former Pennsylvania state trooper who served a sentence for sexually abusing women and girls while on duty two decades ago has been sent back to prison after another sex crime involving a teen, reports CBS radio affiliate KYW. Michael K. Evans, 52, reportedly pleaded guilty in 2000 to sex crimes involving three women and three girls in Montgomery County between 1997 and 1999. He was sentenced to five to 10 years in prison and ordered to resign from the force. Evans was released on parole in 2008, but was still under supervised release when he admitted to indecent assault with a 15-year-old girl in Berks County, KYW reports."

Question asked is exceptionally simple.  How does a guy like this become an officer in the first place?  Where was the vetting?  Didn't they do a full background investigation prior to and ongoing during his term of employment?  Hard to believe he wasn't a predator well before his initial arrest.

"He was a predator," prosecutor Roderick Fancher said, reports KYW. "He was using a badge as a disguise to prey on women. Twenty years ago, he got a significant state sentence and is out there doing it again now that he's out of prison. He's engaging in the exact same behavior, the exact same thing."

System certainly failed.  No question.

"Tuesday, according to the Times Herald, a Montgomery County judge ordered him sentenced to an additional 2-½ to five years in prison for violating the terms of his parole-- the maximum sentence allowable under state sentencing guidelines. The judge reportedly said his latest offense was similar to his previous crimes. "Certainly, he poses a danger to young women, who need protection from the courts from people like this defendant," Montgomery County Judge William R. Carpenter said, according to the paper. Evans additionally will be sentenced in Berks County for the latest crime, reportedly to 5-10 years in a negotiated plea for indecent assault, corruption of minors and indecent exposure. The paper reports he admitted to fondling a 15-year-old girl at his Mertztown home while engaging in a sex act with a woman, and instructing the teen to pose for suggestive photographs."

This guy has some serious mental issues.  The system to date has failed to protect the public.

"At his 2000 sentencing, the Allentown Morning Call reported at the time, prosecutor Risa Ferman called Evans a predator who used his authority as a police officer to prey on vulnerable women. In the 1990s cases, Evans admitted in one instance to having sexual contact with a 15-year-old runaway he was transporting and offering to pay her for sex, the Morning Call reported. In another case, he admitted asking a 16-year-old to pose for suggestive photographs after responding to her home on the report of a burglary. In a third case, he reportedly admitted groping a teen girl he was transporting to a shelter. He also reportedly admitted soliciting sex from a woman accused in a high-speed chase in exchange for leniency, offering to protect a woman in a domestic abuse case in exchange for sex and exposing himself in front of a woman hospitalized after a drug overdose and failed suicide attempt."

How will the following protect the public from this incorrigible predator?

"Evans' attorney sought a sentence of 1½-to-3-years in prison for Evans latest offense, according to the Times Herald, arguing the new crime had nothing to do with his previous role as a state trooper. During questioning in court, Evans said "I'm pretty upset with myself" and said he realizes the latest incident re-opened wounds for his previous victims, according to the paper. "I feel the blame for that and the blame for my new victim," Evans testified."

Rings hollow.

"Francher reportedly said he hopes Evans' sentence in Berks County will be imposed consecutive to the Montgomery County term. "I hope he gets as much time as possible. He needs to be incapacitated," Fancher said."

To protect the public, needs to be institutionalized rest of his life.  Laws need to change to allow this.

"A law enforcement scandal that could impact thousands of criminal cases in Orange County, Calif., is pitting the region's top attorneys and sheriffs against one another. The county's public defender's office on Wednesday suggested that top prosecutors covered for law enforcement, helping to keep widespread lapses in evidence booking out of public view. Now, Assistant Public Defender Scott Sanders is demanding to know who knew what and when."

Good luck.

"An internal investigation conducted two years ago by the Orange County Sheriff's Department, the findings of which were not made public at the time, uncovered systematic mishandling of evidence. Deputies are required to turn in evidence at the end of their shift, but the audit found that more than 70% of them failed to do so. Instead, officers frequently waited days, weeks or even months to submit key evidence, including seized drugs, cash, photos and videos pertaining to criminal cases."

Nazi justice.  Adolf and Benito would have been proud.

"According to the report obtained from the Orange County public defender's office by NPR, nearly a third of evidence collected between February 2016 to February 2018, which included more than 98,000 department records, was submitted after the department's mandated end-of-shift deadline. On average, deputies delayed booking evidence for 3 1/2 days. Additionally, 27% of deputies had held on to evidence for 31 days or longer. In some cases, they never submitted any evidence at all, even when they said they had."

Law enforcement cannot be trusted.  Every one of these cases could be bogus or negatively impacted in some way or other.  Every one of them.  Each now in question.  How could anyone be sure these cases were not trumped up by corrupt, abusive, lawless, criminal officers?

How can a jury convict when the evidence trail remains in dispute?  Questions could go on and on.  Certainly don't want the guilty to go free.  At the same time, how can there be any certainty the jackbooted bastards aren't lying to cover their sorry asses?

"The alarming results prompted a second, much smaller audit of a sample group about a year later, in February 2019, according to sheriff's officials. That brought even grimmer news. After extensive research, auditors determined that 47% of the reports that were supposed to include evidence did not."

How can a jury reliably convict under such circumstances?  Nazi justice.

"The auditors concluded that "cultural idleness" within the sheriff's department had led to inconsistent and inaccurate entries into the property evidence system. They also found insufficient booking software and "no system of accountability."

How can the system be trusted?  How did it get to this point?  Who is ultimately responsible?

"The findings cast doubt on the authenticity of evidence, raise concerns about chain-of-custody rules and could possibly force a reexamination of adjudicated criminal cases. The ramifications could be immense, potentially reversing sentences for people whose convictions relied on tainted evidence."

The issue is not only those outrageously, falsely, perniciously, unjustly accused that is of great concern, here.  How about all those truly guilty who will wind up getting off the hook as a result?

"The implications are massive," Sanders told NPR. "If we take their numbers, take them at their word, then by their own account we're in the zone of 9,000 missing pieces of evidence," he said."

Think for a moment about that.  The irreparable damage done.

"Despite the risk to defendants' constitutional rights, the sheriff's department did not share the information with any outside agencies or county departments. It wasn't until Nov. 18, when the Orange County Register was on the brink of publishing a story detailing the audits, that the sheriff's department told county supervisors of their existence. "Of course, they're going to want to minimize the impact, because the truth is they have no idea how many cases this affects," Sanders said. Sanders said he learned of the internal audits while working with a source on a different case. It was his request for the report that tipped off reporters, he said."

Clearly, there is no effective oversight.  This happened in a major city.  Imagine what happens in other far less-populated areas of the country, including right here in Nazi Llano County.  ... Right, Sheriff?  Madam County Attorney?  "Sonny Boy?"

"District Attorney Todd Spitzer told NPR that his office was also kept in the dark about the scope and disturbing results of the audits until a reporter called with questions on the same day. Since then, he said, the sheriff's department has ignored two requests from his office to share the initial report and all information pertaining to cases where evidence was mishandled."

How could this go on for as long as it did without you knowing, having any suspicions of wrongdoing, Counselor?

"But Sheriff Don Barnes disputes that version of events. He told NPR that Spitzer's office was notified that an audit was in the works as early as 2018. That's when the department identified 15 deputies suspected of wrongdoing and began referring deputies to the district attorney for criminal investigation. Since then, Barnes said, none of those deputies has been charged by Spitzer's office."

If that's the case, Sheriff, why didn't you resign in protest?  If you're truly an honest cop, how could you let it go on?

"I did not call the DA, nor would I be obligated to call the DA," about the results of the internal investigations, Barnes said, adding that Spitzer's office should have been aware of the audit because it "was referenced in many" of the criminal submissions."

Not credible.  Sounds like self-serving bullshit.

"Spitzer finds the claims outrageous. "There was no indication in any way whatsoever that this was a departmentwide audit and that they were looking at really tens of thousands, almost 100,000, cases," said Spitzer, who was elected to the post in January. The general impression within his office was that the individual cases of wrongdoing, which trickled in over a two-year period, were not part of a larger pattern. "Never with the disclosure that there was a systematic problem or failure within his department that may have implicated ... many more cases," Spitzer said."

You're not stupid, Counselor.  Had to have known something was not quite right.  -- The problem that massive.  Certainly, had the authority to investigate.  Credibility of both you and the Sheriff, sadly, remains non-existent.

"Following the publication of the story by the Register, sheriff's department spokeswoman Carrie Braun issued a statement saying, "immediate measures were taken to ensure personnel were educated on policy and procedure for booking evidence." The department had also implemented a new protocol "requiring supervisors to check that all property and evidence has been booked prior to approving any related reports." As a result of the audits, four deputies have been dismissed, seven have been disciplined and four internal affairs investigations are ongoing, the sheriff said. However, on Wednesday, Barnes downplayed the results of the two audits, saying continued investigations into missing evidence show that all but "a few remaining pieces" have "always been in our possession." He insisted that the sheriff's department has had custody of all evidence involved in cases that have already been decided by the courts."

Not credible, Sheriff.  Too many unanswered questions, contradictions, etc.

"Barnes called Sanders' estimate that 9,000 pieces of evidence could be missing "completely embellished and inaccurate." He says the practice by deputies of first submitting digital evidence — including photos, video and audio recordings — to a crime lab for processing before submitting it to the property and evidence room created the appearance of a delay. "That gap does not mean that evidence was mishandled or treated outside of the law," Barnes said, adding that deputies will no longer be allowed to do that."

If that's the case, there should be a written record.  Where is it?

"Meanwhile, Sanders said it is getting harder to believe that the district attorney's office was oblivious to the internal audits. "They were referred 15 cases for potential prosecution, so it's not really credible that the sheriff's department was hiding the evidence," he said. Sanders noted that under Spitzer's predecessor, Tony Rackauckas, there was a history of ignoring questionable behavior within the sheriff's department."

That right?  ... Can't dazzle 'em with brilliance, baffle 'em with bullshit?  LOL.  Sounds like they're all covering their sorry asses.

"Rackauckas' office was kicked off the largest mass murder case in the county's history in 2015 after Sanders discovered that the sheriff's department, under Barnes, had failed to disclose it was misusing jail informants in violation of inmates' rights. "They're scrambling like mad right now because in reality they never fixed the problem," Sanders said. Spitzer argues that he and Sanders are both after the same thing: "Our only focus is to determine with certainty how many cases my office may have prosecuted where the evidence was never booked or it was booked in such a fashion that it calls into question the sanctity of that evidence." He said a meeting with the sheriff's office has been scheduled for next week to dive into the results of the internal audits."

"Officials are investigating a group of West Virginia corrections trainees who were photographed seemingly making a Nazi salute in their uniforms. A blurred copy of the photo was provided to NBC News by the state's Department of Military Affairs and Public Safety on Thursday. The group, Basic Training Class 18, appeared to be graduating based on dates in the picture's caption."

Why blur the image?  The public is entitled to know who their jackbooted oppressors are.

"They're seen making the salute under a sign that reads "Hail Byrd." News of the photo was first reported by NBC affiliate WSAZ. West Virginia Gov. Jim Justice said in a statement that he ordered the termination of any state employees to be found involved in the photo. "This will not be tolerated on my watch — within the Division of Corrections and Rehabilitation — or within any agency of state government," Justice said."

The public is entitled to know the identity of these officers.  If fired, they'll go on to other jobs in law enforcement, and/or the penal system, making them an exigent threat to the public they clearly don't serve.

"Jeff Sandy, secretary of the West Virginia Dept. of Military Affairs and Public Safety, said in a memo to employees Wednesday that he condemned the photo "in the strongest possible terms." “It is distasteful, hurtful, disturbing, highly insensitive and completely inappropriate," Sandy said. "It undermines the high standards that have been set for our Division of Corrections and Rehabilitation."

That right?  If so, what are you specifically doing to ensure they don't move on to other penal institutions, and/or positions in law enforcement?

"A number of employees have been suspended amid the official investigation, according to the memo. The photo has also been taken out of circulation to "keep its harm from spreading." Sandy also said that the department has spoken to faith and community leaders to ask for helping in addressing the incident, including additional training programs."

Training is not the answer.  Better vetting is required.  More comprehensive background checks.  To root out the egregiously unfit, including the nazi element in our formerly great country.

"A sick Guatemalan boy who died in government custody was lying on the floor for hours before someone found him dead, a video first obtained by ProPublica shows. The boy, identified by a US Customs and Border Protection official as Carlos Gregorio Hernandez Vasquez, 16, died on May 20 at a Border Patrol station in Weslaco, Texas, days after he crossed into the US and was apprehended by immigration officials, CBP said."

Nazi America.

"Surveillance video of a holding cell at the Weslaco facility first obtained by ProPublica and published on Thursday show the last moments of the boy's life. ProPublica analyzed the video and compared it with police and emergency services records to create a timeline. CNN later obtained a copy of the video. The boy was waiting to be transferred to the custody of the Health and Human Services Department, as is customary for unaccompanied minors, when he was diagnosed with the flu and taken to the Weslaco facility, the CBP official said. In the video, Carlos first appears walking inside a cell in the Weslaco facility, wearing blue jeans, a dark long-sleeve shirt and a disposable white mask. He lays down on a cement bench as another boy, who was not identified, is sleeping under a Mylar blanket on a bench across from him. The teen shifts around on the bench and moves out of the camera's view for some time before he can be seen again as he collapses, face down on the ground."

Jesus Christ.  Where were the guards?  Where?

"Carlos stays mostly still on the floor for about 10 minutes, based on ProPublica's analysis of the footage. He gets up, walks to the toilet and appears to collapse soon after. He is moving and bending his legs for a few minutes until he stretches them out and stops moving. Only Carlos' legs, an arm and part of his torso are visible in the video. The rest of his body is blocked by a privacy wall on the toilet area. The video abruptly ends and restarts about four hours later, ProPublica's analysis found, and shows Carlos in the same position as his cellmate wakes up, finds him in the toilet area and flags a Border Patrol agent. The Weslaco Police Department, the agency that provided the video to ProPublica and briefly investigated the boy's death, said the footage was turned over to their investigators, split in two parts, according to the media outlet."

Congenital liars:

"CBP had previously said in a statement that agents at the Weslaco station found Carlos unresponsive during a welfare check. But Border Patrol logs obtained by ProPublica indicate that three welfare checks were done on Carlos over the period in which the video suggests the boy laid on the floor. The logs do not indicate how those checks were done or note that anything was amiss. CNN has not independently obtained the Border Patrol logs. When asked about the video, a CBP spokesperson said the investigation into Carlos' death was ongoing. "While we cannot discuss specific information or details of this investigation, we can tell you that the Department of Homeland Security and this agency are looking into all aspects of this case to ensure all procedures were followed," the spokesperson said."

In follow up to a case covered earlier in this publication and elsewhere, The Washington Post reports:

"The violent scene unfolded on live television. Dozens of police officers, guns drawn, swarmed a hijacked UPS truck hemmed in by rush-hour traffic at a busy intersection. Inside the vehicle, two men suspected of armed robbery had taken the driver hostage. Outside, the officers took shots with innocent bystanders trapped in the cars in between. It was, experts later said, a nightmare scenario. The Thursday shootout in South Florida left four dead — the two hijackers, the 27-year-old abducted UPS driver and a 70-year-old man who happened to be idling at the light on his way home from work. It also left a mountain of unanswered questions."

No question.  Aggressive stupidity at its very worst.  Needless loss of life.

"As video of the violence circulated on national news and social media, some, including the UPS driver’s family, criticized police tactics, saying it was irresponsible for officers to exchange fire on a crowded street. Others saw that the first responders had no other option, that they had no choice but to confront a deadly threat. In the weeks to come, investigators will have to address some thorny and complex issues about police use of force, researchers and law enforcement officials said. Who fired the shots that killed UPS driver Frank Ordonez and motorist Richard Cutshaw? How many bullets were fired and from where? Did the officers’ actions put innocent lives in danger? “Just about everything that could go wrong did go wrong,” said David Klinger, a criminal justice professor at the University of Missouri in St. Louis. The incident “was really, really bad.” But as chaotic and calamitous as the episode was, it was also “a perfect example” of why police are allowed to use deadly force against dangerous criminals, Klinger said. Authorities said Lamar Alexander and Ronnie Jerome Hill had left a trail of violence behind them that evening. Stopping them by any means — even with bullets — was “absolutely the right thing to do,” Klinger said."

Was it?  Truly think so?

“In a situation like this, the police are reactive,” Klinger added. “This is not a situation they want to be in. Their hand was forced.”

"The dramatic exchange of gunfire followed a high-speed chase through two counties that thwarted residents’ commutes at rush hour. They said a female employee of the store was injured as the robbers and the store owner shot at each other. The gunmen fled north in a truck, then commandeered a UPS truck while the driver was making a delivery, police said. Several police cars pursued the UPS truck, with the UPS driver trapped inside, until the vehicle was boxed in by traffic in Miramar and officers surrounded it."

Here's the problem:

"When Heather Taylor, a homicide sergeant in St. Louis, watched the footage, she saw police who refused to retreat and who put innocent lives in jeopardy because of it. Instead of opening fire in the crowded intersection, she said, officers could have engaged the robbers when they had a clearer shot. “We don’t always have to be the warrior,” said Taylor, who is also president of the Ethical Society of Police in St. Louis. “Sometimes we have to understand that retreating is okay. You don’t always have to get the bad guy.”

Certainly, not when innocent people are at extreme risk of losing their lives.  Almost always, the criminal will wind up arrested, anyway.  Matters not, if there is a delay due to overwhelming danger present at any given moment.

"She acknowledged that the officers were in a difficult situation but said the video was “one of the most tragic” she has seen. “Yes, the suspects are responsible, absolutely, but we are also responsible for every single round that went toward innocent bystanders,” Taylor said. “Each one of them had the potential to kill someone.”

That's right.  Must always be taken into consideration.  Also, danger present in high-speed chases in congested traffic.  Resultant loss of innocent life.

"On a GoFundMe page that had raised more than $100,000 by Friday evening, Roy Ordonez wrote that his brother, the UPS driver, had been gunned “down like a criminal by the Florida police.” He asked people to share the fundraising page to “make people aware of trigger-happy police officers.” “They could have killed many more people, could have been one of your loved ones,” Roy Ordonez wrote. “Please don’t let my brother’s death be for nothing. Police need to be held accountable.” Joe Merino, who told the South Florida Sun-Sentinel that he was Frank Ordonez’s stepfather, said his stepson “was murdered.” “The police are here to serve and protect,” Merino said, “but where was the protection for my son?”

Non-existent.

"Autopsies may determine who fired the shots that killed Ordonez and Cutshaw. Tania Rues, a spokesperson for the Miramar Police Department, referred a question about the timeline for the autopsies to the Broward County medical examiner’s office, which did not immediately respond to a request for comment. The Florida Department of Law Enforcement is investigating the shootout, Rues said. “The armed suspects engaged law enforcement in open fire,” said FBI agent George Piro on Thursday. He said the first shot was fired during the chase but declined to provide more details. Piro said it would be “completely inappropriate” to discuss whether the UPS driver or the bystander may have been hit by officers’ gunfire."

Irrelevant whose rounds killed the innocent.  What is relevant is the needless danger law enforcement placed innocent bystanders and the hostage in.

"David Harris, a policing expert and a law professor at the University of Pittsburgh, said the police officers' actions should be judged against their departments' policies about pursuits and deadly force. Most professional police associations urge officers to engage only in a chase in very serious situations so as not to unnecessarily endanger officers, the criminals or bystanders, Harris said. He said most police forces, however, would allow officers to chase the vehicle of people connected to a violent felony, like the firing of shots during a jewelry store robbery. “A situation like this with a hijacked truck, a kidnapping and maybe hundreds of civilians in danger is very unusual,” Harris said. “And you won’t find but a handful of police officers in the United States who’ve had an experience like this."

All the more reason these policies should be reconsidered, revised.  The lack of experience increases the danger for all involved.  Not only that, technology has also increased the chance perpetrators will ultimately be caught, brought to justice even if police are forced to delay capture.

"Geoff Alpert, a criminology professor at the University of South Carolina, said that other than having a SWAT truck with heavily armed tactical police officers, he did not know of alternative ways that police could have safely ended the pursuit. The gunmen had proved that they were willing to resort to violence to escape and could have endangered other people in the area, such as by hijacking other cars, Alpert said. “This is why the police are trained to do what they do,” he said."

That's short-sighted, aggressive stupidity at its most dangerous, very worst.  The chase itself exponentially increased the danger.  Could certainly have backed off, remained in pursuit, however.  Advised other agencies in the region.  Been less aggressive, far more patient.  Always, a judgment call.  Safety of innocent bystanders should take priority.

"The overwhelming use of force is being questioned after a chase in Florida ended in a deadly shootout with police. It started when two men, who the FBI said were already wanted for two similar heists near Miami, robbed a jewelry store and hijacked a UPS van. After a 23-mile chase, the officers opened fire when the gunmen shot at them, leaving drivers in rush-hour traffic panicked and scrambling. The two men who police said robbed the jewelry store were killed. But so was 70-year-old Richard Cutshaw, who was waiting in his car at the intersection. The UPS driver who was taken hostage, Frank Ordonez, was also killed. Ordonez was father of two daughters, ages 3 and 5. Now his stepfather is criticizing the officers' actions. "They disregard the hostage, they disregard the people around the scene. They went out there like the old West," said Joe Merino. Miami-Dade's police director, Juan Perez, explained why officers had to move in on the suspects, saying the suspects weren't just fleeing, they were being violent and "confronting officers shooting at them." But Manny Orosa, who was Miami-Dade's police chief from 2011 to 2015, questions the tactic given the number of civilians and the hostage. "If you're shooting into a truck and you don't have a clear vision of who you're shooting at, you don't just shoot at the truck," Orosa said."

"A female Chicago police officer, allegedly seen drinking with then-police superintendent Eddie Johnson before he was found asleep in his vehicle, has been accused of tampering with evidence linked to an ongoing investigation of the incident. Cynthia Donald is under investigation for allegedly damaging her police-issued mobile phone and removing the SIM card, which stores the cellphone data. The device reportedly had been sought as potential evidence by the city's Office of Inspector General, which is investigating Johnson over the October drinking incident. Authorities discovered the damage Oct. 20, three days after Chicago police officers found Johnson asleep behind the wheel of his SUV. Donald was required to return the device after being transferred out of the then-superintendent's security detail. The city's inspector general is now investigating why the phone was returned damaged, according to the police department. Sources with knowledge of the matter told ABC Chicago station WLS Johnson was seen dropping Donald off at Chicago Police Headquarters around two hours before he was found asleep behind the wheel. The department declined to comment on local media reports that claimed the phone had been sought as evidence by the office of city Inspector General Joseph Ferguson."

What took so long?  The damage was discovered 10-20-19, three days after the Superintendent was found asleep at the wheel.  Why the foot dragging?

"I can confirm media reports that we opened an investigation to determine why the phone was returned damaged," Chicago Police Department spokesperson Anthony Guglielmi told ABC News in a statement Sunday. "At this point, we are not making any additional statements as we are awaiting the final report from the Inspector General and cooperating fully with his review." Chicago Mayor Lori Lightfoot fired Johnson on Dec. 2, just weeks before he was scheduled to retire, due to what she called "ethical lapses." Johnson said he pulled over because he was feeling light-headed and later fell asleep, but Lightfoot accused him of intentionally misleading city officials and the public in the aftermath. Lightfoot also said the inspector general's report, which hasn't been released publicly, showed Johnson exhibited "flawed decision-making." "It has become clear that Mr. Johnson engaged in a series of ethical lapses that are intolerable," Lightfoot said in a statement last week. "Mr. Johnson was intentionally dishonest with me and communicated a narrative replete with false statements regarding material aspects of the incident that happened in the early morning hours of October 17." "Had I known all the facts at the time," she added, "I would have relieved him of his duties as superintendent then and there."

Get this:

"An official briefed on the probe into Johnson's conduct told ABC News that during the traffic stop in question, the superintendent showed his police ID when asked to present identification. The officers apparently didn't recognize Johnson immediately. Once the superintendent showed ID, he and the officers exchanged some words, and Johnson said he was OK to drive away. The cops let him, raising questions about why Johnson wasn't given a field sobriety test."

The payment was ordered last month by a New York state judge in an extraordinary rebuke to a sitting president. Trump had been sued in 2018 by the New York attorney general, who alleged that the president had illegally used funds from the Donald J. Trump Foundation to buy portraits of himself, pay off his businesses’ legal obligations and help his 2016 campaign."

Amazing, isn't it?

"The money was split among eight charities, according to a statement from New York Attorney General Letitia James (D). The charities were the Army Emergency Relief, the Children’s Aid Society, Citymeals-on-Wheels, Give an Hour, Martha’s Table, the United Negro College Fund, the United Way of National Capital Area, and the U.S. Holocaust Memorial Museum, according to the statement. In addition, Trump agreed to distribute the remaining $1.8 million left in the Donald J. Trump Foundation to the same eight charities. In all, each charity received $476,140.41."

Why is it Trump's sorry ass isn't sitting in prison?  Why no criminal prosecution?

“Funds have finally gone where they deserve — to eight credible charities,” James said in the statement. “My office will continue to fight for accountability because no one is above the law — not a businessman, not a candidate for office, and not even the president of the United States.”

Trump also used the charity to boost political campaigns — first, Pamela Bondi’s Florida attorney general campaign, and then his own 2016 campaign. Trump gave away Trump Foundation checks onstage at rallies, despite strict rules barring nonprofit charities from participating in political campaigns."

"Now, the foundation will be shuttered. But the consequences of this case will linger for Trump. Under the terms of the settlement, he has agreed to special supervision if he ever returns to charity work in New York."

"When students in wilderness EMT Alice Henshaw's training courses grab practice dummies for CPR drills, they have their choice of a traditional, flat-chested training manikin or one that looks a little different: a manikin zipped into a neoprene vest with silicone breasts. That's the Womanikin, a universal attachment for CPR dummies created by New York-based ad agency Joan Creative in partnership with The United State of Women. The idea behind this breasted vest — and the related awareness campaign — is to address gender disparities in training and performance of CPR, which is vital for anyone experiencing cardiac arrest. Research shows that bystanders are less likely to perform CPR on women than men, and experts say superficial anatomical differences may lead people to assume chest compressions must be performed differently on men and women, which is not true. The Womanikin campaign is part of a larger discussion among public health advocates working to solve this problem. "It's not just men who have sudden cardiac arrests, and it's not just men we have to save," says Dr. Holly Andersen, a cardiologist, professor of clinical medicine, and director of education and outreach for the Ronald O. Perelman Heart Institute."

Here's the problem:

"A 2017 study looked at data from more than 19,000 people experiencing cardiac events and found that only 39% of the women received CPR from strangers in public as compared to 45% of the men, and that men's odds of surviving were 23% higher than those of women. Even in a virtual reality setting, study subjects were less likely to use CPR on female avatars. The same held true for use of an AED, also called a defibrillator, the device that can help shock hearts back into a regular rhythm. Andersen, who has worked with Joan Creative to promote the Womanikin since its launch, says the majority of out-of-hospital cardiac arrests occur in public settings, followed by private residences and nursing homes. Because every minute without CPR decreases a person's chances of survival by 10%, Andersen says, it is not enough just to wait for emergency responders to arrive — bystanders must be willing to act. There are many reasons why people might hesitate to perform CPR or use an AED on women, explains Marion Leary, the director of innovation at the Penn Nursing, who was the lead author on the virtual reality study. For instance, people don't want to be perceived as assaulting a woman, and might be fearful of hurting the victim or ending up in a lawsuit. According to Andersen, legal action is unlikely because variations of Good Samaritan laws offer some protection in all 50 states. Leary says no potential embarrassment or injury is worth refraining from CPR. "You can't hurt someone worse than dead," Leary says. "If you do nothing and they're in cardiac arrest, a person will die."

Joan Creative has already developed ten Womanikin prototypes, and an open-source toolkit on their website can help others recreate the breasted vest on their own. The American Heart Association has formed an all-female working group of resuscitation experts to think about how to decrease disparities in gender, race and ethnicity in CPR training and application, Leary says.

"Wilderness EMT Henshaw, a lead instructor at Wilderness Medical Associates in New York, started using a Womanikin in August after her employer asked her to test it out. While Henshaw thinks the Womanikin is a great training tool and conversation starter, she has chosen not to draw attention to it in her classes. She simply makes it available for drills and is prepared to talk about what it represents if anyone asks. Putting too much emphasis on exterior differences, she believes, detracts from the main issue of cardiac arrest and the importance of taking immediate action, since compressions should be performed the same way on every body type. Correct CPR doesn't necessitate touching a woman's breast, according to Andersen, because compressions should be on the sternum, which is in the middle of the chest. She has started placing a sticker on the sternum to guide people when she brings Womanikins to community events. She also notes that as of 2015 AHA guidelines don't require or even recommend rescue breathing (mouth-to-mouth), except for in certain cases like drowning or overdose. Henshaw says feedback about the Womanikin has been "overwhelmingly positive," including from some students who have been doing CPR training for decades and had never thought about gender disparities. Some male students initially felt awkward, Henshaw says, but that hesitation dissipated after a few cycles of practice and her urging them to see the dummy as an important woman in their life who "didn't get CPR because somebody was embarrassed."

The following is another issue to be considered:

"Turner was diagnosed with breast cancer about a year and a half ago, and has since undergone a bilateral mastectomy. After that, it dawned on her that training classes only use male manikins, and that could be an issue. "I was like, if someone should start CPR on me, that's not something they're going to be used to seeing," Turner says. "How do we help women survive in pre-hospital type conditions in this circumstance?" The first step was to get trainees comfortable removing shirts and bras from mannikins. That's because she's teaching them both CPR and the use of AEDs, which can be crucial to survival and are recommended to use whenever available — and AEDs should be used on bare chests. Now Turner is trying to figure out what to put inside of the bras. Ideally, she would like to see breasts with a variety of nipple types, no nipples, and body jewelry. So far, she has been adding sticky boobs to flat-chested manikins. Though Turner says it began as an experiment, the school is now starting to offer bra-clad manikins in every class. As she observed students selecting their training manikins at the beginning of each class, she noticed an interesting pattern: Students would often choose a dummy based on its attire because, for example, they assumed a pink jacket indicated a bra underneath. At first the manikins only wore pink or blue clothes, but Turner has since added greens and reds to mix things up. "The big thing that we're really working towards is basically ... looking at the person and not the parts," she says. Turner is looking for more ways to be inclusive in CPR training. She would like to have some manikins that appear masculine and have some sort of scar across their chests, to promote dialogue about performing CPR on transgender people."

Michael Orlando Clark Jr. was officially adopted on Thursday and all his friends showed up to the Kent County Courthouse in Michigan to celebrate with him.  The Kent County's Facebook page shared a photo from Clark's hearing and it showed the boy, his parents and his classmates holding up heart signs. They captioned the photo: "Michael brought his entire kindergarten class with him today to witness his adoption."

Clark could not contain his excitement when he was interviewed by a local television station. "I love my daddy," he told WZZM. "We began the school year as a family," Clark's teacher said. "Family doesn't have to be DNA, because family is support and love."

There are many who live full lives, go to their graves having not learned that.

"At almost the exact moment hundreds of Japanese planes dropped armor-piercing bombs on Pearl Harbor — killing thousands of Americans and damaging eight battleships in a deadly surprise attack — Brig. Gen. Dwight D. Eisenhower decided to take a nap. Eisenhower, as usual, was working through the weekend. But around noon on Sunday, Dec. 7, 1941, he yawned and shoved aside the paperwork spilling across his desk in San Antonio, where he served as chief of staff for troops stationed at Fort Sam Houston. Telling an assistant he was “dead tired,” the 51-year-old struggled into his car and drove home. Don’t wake me, Eisenhower instructed his wife, Mamie, before falling into bed: “[I don’t want to be] bothered by anyone wanting to play bridge.” History compelled Mamie to disobey. Eisenhower awoke to an urgent call from military higher-ups informing him of the news from Pearl Harbor. The next day, President Franklin D. Roosevelt asked Congress to declare war on Japan." Four hectic, harried days after that, Eisenhower received another call — this one demanding he “hop a plane” and travel to Washington to develop the U.S. response to Japanese aggression, writes Stephen E. Ambrose in “Eisenhower: Soldier and President.”

Eisenhower certainly rose to the occasion.  Both vis a vis his war planning in the Pacific Theater after the devastating attack on Pearl Harbor, as well as the Allied invasion of Normandy in the European Theater to come in June of 1944.

Interestingly:

"It was a pivotal moment for the nation and for Eisenhower, who up to that point had “impressed every superior for whom he had worked,” but failed to garner any accomplishments worth mentioning “with pride [to] his grandchildren,” according to Ambrose. “Had he died in 1941, at an age when most great men have their monumental achievements behind them, he would be unknown today,” Ambrose wrote. Speeding to Washington, “[Eisenhower] may have dared to hope that the war would give him an opportunity to use his talents and skills … for the good of his country and perhaps even for the good of his own career.”

The very best never, ever, never give up no matter the obstacles:

"But things did not start well for the ambitious, anxious future president. Eisenhower had packed a small bag, told Mamie he would be back soon and boarded an afternoon plane to the nation’s capital — only to be grounded by bad weather a few hundred miles into the flight. Undeterred, he boarded a train in Dallas and chugged into Union Station relatively early on Dec. 15. He immediately rushed to the War Department offices on Constitution Avenue (at the time, the Pentagon was still under construction). There, Army Chief of Staff Gen. George Marshall met him with a stunning request."

Things indeed got very interesting, very quickly:

"Marshall, known throughout the military as an ingenious but stern and demanding taskmaster, fixed Eisenhower with a steely glare and demanded, “What should be our general line of action?” “Eisenhower was startled,” Ambrose wrote. “He had just arrived, knew little more than what he had read in the newspapers … was not up to date on the war plans for the Pacific, and had no staff to help him prepare an answer.” For a few seconds, an awkward silence reigned. Then, returning Marshall’s gaze, he replied simply: “Give me a few hours.”

No question, the survival of the United States at the time was threatened not only by the Japanese, but Hitler as well.  Eisenhower stood tall.  Rose to the occasion:

"He retreated to a desk, stuffed yellow tissue paper into a typewriter and — without any further preparation or research (and without the benefit of anything like the Internet) — came up with a strategy to fight the Japanese in the Philippines. His very first order of business: tapping out the title, “Steps To Be Taken.” Conventional military wisdom dictated a swift retreat from the Philippines to Australia, where U.S. troops could build a base to launch a counteroffensive, according to Ambrose. “But the honor of the Army was at stake, and the prestige of the United States in the Far East,” Ambrose wrote. As Eisenhower concluded in his report to Marshall: “The people of China, of the Philippines, of the Dutch East Indies will be watching us. … They may excuse failure but they will not excuse abandonment.”

Most wise assessment at a time of great peril.

"So he formulated a daring compromise. Eisenhower advocated shipping pilots, planes and weaponry out to Australia in preparation for a base there, while nonetheless keeping — and, as far as possible, bolstering — U.S. troops already stationed in the Philippines under Gen. Douglas MacArthur. Just as dusk settled over the nation’s capital, Eisenhower returned to Marshall’s office bearing his typewritten recommendations. He knew the plan was fraught with potential pitfalls: “We must take great risks and spend any amount of money required,” Eisenhower wrote in the document. “We dare not fail.” Marshall pored over the pages, looking grim, while Eisenhower watched. Once he finished reading, he paused and regarded the younger man with a piercing stare. “I agree with you,” Marshall said finally, in barely audible tones, according to Ambrose. “Do your best to save [the Philippines].”

The future president immediately rose to the challenge, a near impossible challenge with determination and everything he had.

"Marshall placed Eisenhower in control of the Philippines and the Far Eastern Section of the War Plans Division, according to Ambrose. That morning, Eisenhower had felt certain he was embarking on what would be a very short trip to Washington. Instead, he would not leave the nation’s capital again (apart from a 10-day visit to Britain) for almost eight months. During that period, he labored to the point of exhaustion in a desperate bid to save the Philippines and, later, to develop a strategy to fight Germany, as well as Japan. Eisenhower found a temporary home with relatives who lived in Falls Church, Va., though he hardly ever saw them. “He never saw the house in daylight,” Ambrose wrote. “His driver would pick him up before dawn to take him to his office on Constitution Avenue, and bring him back at 10:30 p.m. or later. … He wolfed down his meals, often no more than a hot dog and coffee, at his desk.” He missed Christmas 1941, countless family events and even his father’s death and funeral in March 1942. The only expression of grief Eisenhower allowed himself on the day of his father’s passing was to leave work slightly earlier than usual, at 7:30 p.m." “War is not soft,” Eisenhower wrote in his diary the next day. “It has not time to indulge even the deepest and most sacred of emotions.”

Survival comes first.

Cruel kicker?  Get this:

"Despite his work ethic, Eisenhower’s record in the Philippines is mixed at best. As Ambrose put it: “His efforts were worse than fruitless, as [General] MacArthur came to lump Eisenhower together with Marshall and Roosevelt as the men responsible for the debacle on the islands,” which the United States ultimately lost in a humiliating, morale-shattering defeat that cost tens of thousands of American lives. Nonetheless, Eisenhower proved his worth. “Throughout that period, and in the months that followed, Eisenhower impressed Marshall deeply,” Ambrose wrote. “So deeply that Marshall came to agree … that Eisenhower was the best officer in the Army.” Marshall promoted Eisenhower to major general, then commanding general of the European Theater of Operations and eventually (by Roosevelt’s dictate) Supreme Allied Commander in Europe. As Supreme Commander, Eisenhower’s successful oversight of the D-Day invasion earned him a place in history and set him on the path to the American presidency. The later, glowing successes — both Eisenhower’s personal victories and those won by the Allied Forces in World War II — would probably have been impossible without those initial, tense hours in Washington. Everything stemmed from Marshall’s decision to set Eisenhower a near-impossible task, and from Eisenhower’s refusal to back down."

Readers are reminded success of the D-Day invasion was not guarantied.  Eisenhower wrote two statements, only one of which would be released upon execution of the Allied assault of Normandy on D-Day.  One for success, -- the other for failure where Eisenhower took full responsibility.

... When America was indeed young, strong, brave, and free.  When principle mattered.  When all courageously rose to the occasion.


Trump has grown increasingly erratic since taking office.  More so lately as the strain of impeachment reaches fever pitch.  Two Democrats are also showing signs of strain.  NPR reports:

"House Speaker Nancy Pelosi, D-Calif., announced Thursday morning that House Democrats will move ahead with drafting articles of impeachment against President Trump, though she did not define the scope of those articles."

That's a problem.  A big problem.  Needs to go much further than simply the Ukraine fiasco.

"His wrongdoing strikes at the very heart of our Constitution," Pelosi said, referring to Trump's efforts to pressure Ukraine to investigate political rivals while hundreds of millions of dollars in military aid were on hold earlier this year."

What about the ten examples of obstruction of justice outlined in the Mueller Report?  What about lining his pockets in violation of The Emoluments Clause?  What about the paying of hush money to two women he had affairs with?  List can go on and on.

Pelosi is certainly showing signs of strain:

"In a later news conference, Pelosi reacted angrily to a question about whether she hates the president. "As a Catholic I resent your using the word 'hate' in a sentence that addresses me," she said. "I don't hate anyone." She added, "I pray for the president all the time. So don't mess with me when it comes to words like that." Trump responded on Twitter, saying Pelosi had "a nervous fit." As to her statement that she prays for the president, Trump said, "I don't believe her, not even close."

Already, a majority of the public supports impeachment.  As public opinion continued to increase in support of impeachment, Republicans would have been forced to reconsider as they did during the Nixon impeachment fiasco decades ago.  ... Or, not be returned to office.

"White House press secretary Stephanie Grisham responded to Pelosi's announcement on Twitter, indicating that the White House is focused on the next stage of the impeachment process — a Senate impeachment trial.

Both men have lost themselves.  Place partisan interests ahead of principle and the ongoing criminal activity in the Oval Office.  Trump presents an increasing exigent threat to life, liberty, all civil and constitutional rights and liberties.  So do those who protect and defend this fascist who continues to transform our formerly great country from the de facto fascist police-state we've lived in since 9/11 to the Trump nazi's Fourth ReichFascism, nazism, national socialism defined as the pernicious blend of government, business, and religion. 'Justified' by perversion and bastardization of the latter.

Biden is unfit for the presidency.  Clearly, does not have the temperament.  Neither does Trump.  Age is also a factor.  Not only in the case of Biden, but the Trump nazi as well.  To say nothing of others running for president.  Time for new blood.  Someone much younger.  Less jaded.  Less biased.  Less restricted in their thinking.

"Biden then moved to defending his son, Hunter, who previously served as a board member on the Ukrainian energy company Burisma. Hunter Biden is a frequent target of President Trump's attacks amid the impeachment inquiry. To this, Biden raised his voice and invoked a stern tone, saying "You said I set up my son to work on an oil company. Isn't that what you said? Get your words straight, Jack!" At one point, a staff member attempted to take the microphone away from the voter, but Biden said, "Let him go, let him go."

Give Biden credit for that.  Indeed, let the voter have his say.

"Biden then said that the reason why he is running for president is because he "has been around a long time," and he "knows more than most people know."

Jesus Christ.  Give me a break.  Crock of shit.  Sound like the narcissistic Trump nazi, Joe.  Wake up.

Confronted with legitimate criticism, Biden remains clueless.  NPR reports:

"Former Vice President Joe Biden is defending himself against criticism over a heated town hall earlier this week in which he called a voter a "damn liar" and challenged him to a push-up contest and IQ test. The voter, an 83-year-old retired farmer, stood up to ask about Biden's and his son Hunter's work in Ukraine, making some false accusations about it. He also said Biden was too old to run for president. In a nearly two-minute exchange caught on video that was widely shared, Biden raised his voice as he forcefully pushed back on the voter's allegations. Biden also seemed to comment on the voter's appearance — after the the man said he saw one allegation on TV, Biden replied, "I know you do ... I'm not sedentary." "The fact of the matter is, this guy stood up and he was, in fact, lying," Biden said in an interview Friday evening with NPR Morning Edition host Rachel Martin on his campaign bus on the way to Decorah, Iowa. "And I just pointed out, you're a liar. It's it's a fact. He lied, period. And so, you know, maybe I shouldn't have kidded with him about that."

You're clueless, Joe.  Remain achingly out to lunch.  Let me remind you of something you already know far better than anyone.  The public will accuse candidates of all kinds of things that are blatantly false.  Up to you to retain your cool.  Carefully, engage.  Make your points without losing your composure.  When that happens, you clearly demonstrate your unfitness for office, display an egregious lack of temperament.  ... Just as the Trump nazi does day after day, month after month, year after year.

Here are the consequences for a loss of temperament:

"Voters say they felt Biden's tone was off-putting, especially from a candidate who talks a lot about restoring civility. Biden's argues he was just telling it like it is. "That's not civil?" Biden said. "To call someone who lied a liar?" One woman, Mary Clark, who is 94, told NPR before a Biden event Friday in Elkhart, Iowa, that she was "so disappointed in Biden. That is not the Joe I know. He sounded like Donald Trump in that clip." Biden wholly dismissed that comparison. "Donald Trump, he makes fun of people. He belittles people. He lies. I don't do any of those things. Period."

The latter story line asserts that Ukraine interfered in the 2016 election, including with the baseless theory that Ukraine, rather than Russia, was behind the hacking of the Democratic National Committee. The purported purpose of the trip was to conduct interviews for a documentary on a right-wing media network. But Giuliani’s travel also appeared designed to send a broader and more brazen signal of the disregard that he and Trump have for the unfolding impeachment process."

The flurry of messages seemed designed to taunt Democrats in Washington."

More than 13,000 people have died in the conflict. The disruption in U.S.-Ukraine relations caused by Giuliani’s activities and the resulting impeachment inquiry have led some Ukrainians to fear that Zelensky, who promised an end to the conflict during his campaign, will cut a bad deal with Putin, owing partly to a growing sentiment in Kyiv that Ukraine can no longer count on support from the United States."

Certainly, was a mistake for Ukraine to have allowed Giuliani back into the country.  Ukraine had nothing to gain, everything to lose:

During his trip, he sat down with a mustachioed Ukrainian lawmaker who has promoted Russian interests in Ukraine and once studied at a KGB academy in Moscow. He received a bon voyage message from a former Ukrainian parliamentarian, who once sent a peace proposal to the White House that would have lifted sanctions on Russia and recognized the Kremlin’s annexation of Crimea. The trip also served a practical purpose ahead of a likely Senate trial of his client. Giuliani brought a correspondent from the right-wing One America News to interview many of the Ukrainians he has interacted with in the past year — people who are willing to make allegations against Biden and the Democrats."

"The footage will help inject the theories Giuliani has gathered over the past year even further into the American public discourse, as the Senate prepares to embark on a trial that some Republican lawmakers want to make as much about Biden as it is about the president. Giuliani has alleged that Biden pushed for the 2016 firing of Ukraine’s top prosecutor to help his son, Hunter Biden, who at the time was a board member of a Ukrainian gas company whose owner was under investigation in Ukraine. Apart from a claim by the top prosecutor in question that Biden had him fired for that reason, no evidence has surfaced to show that is why Biden sought his removal. European Union leaders also wanted the prosecutor removed."

Quite true.  So did American officials including Obama.  Yet, Trump and his henchmen continue to lie, obfuscate, invent their own 'reality,' stonewall.

"During the trip, Giuliani said on Twitter that until the matter is resolved, the issue “will be a major obstacle to the U.S. assisting Ukraine with its anti-corruption efforts.”

"In Kyiv, Giuliani met with two members of Ukraine’s parliament, Andriy Derkach and Oleksandr Dubinsky, who have called for a joint U.S.-Ukrainian parliamentary investigation into the gas company. The One America News correspondent traveling with Giuliani posted photos of them interviewing former Ukrainian Prosecutor General Yuri Lutsenko in Budapest, where they stopped before traveling on to Ukraine. On Capitol Hill, Democrats were shocked by Giuliani’s nerve."

Raja Krishnamoorthi (D-Ill.), a member of the House Intelligence Committee, which led the impeachment inquiry. “This is emblematic of this White House: When they are in the wrong, they double down. And in this case, they are tripling down.” House Speaker Nancy Pelosi (D-Calif.) called the trip an indication of “the arrogance of it all” in comments at a CNN Town Hall on Thursday night. Some Republicans were left scratching their heads. Asked about the trip, Rep. Mo Brooks (R-Ala.) replied, “Rudy does what Rudy does.” Others were surprised. “The fact that Giuliani is back in Ukraine is like a murder suspect returning to the crime scene to live-stream themselves moon dancing,” said Dan Eberhart, a prominent Republican donor and Trump supporter. “It’s brazen on a galactic level.”

No question.  When will Republicans finally wake up?  Place principle ahead of partisan interests?  Finally uphold their oaths of office to protect and defend the United States Constitution?

DOJ watchdog on Russia probe discloses findings.  NPR reports:

"The Justice Department's internal watchdog determined the FBI had sufficient evidence to open the Russia investigation — but sharply criticized the bureau over its surveillance of a former adviser to the Trump campaign. In his highly anticipated 400-page report, inspector general Michael Horowitz also says he found no evidence of political bias in the FBI's decision to launch its investigation into possible ties between the Trump campaign and Russia."

Fascinating, isn't it?

"The report, which was released Monday, adds further fuel to the political whirlpool that has agitated Washington since President Trump was elected, including over issues surrounding foreign interference, "bias" and the credibility of investigators and institutions. Republicans seized on the finding of flaws and omissions to further their case that the FBI and Justice Department have run amok out of political animus toward Trump. Democrats underscored the overall solidity of the picture about the interference of 2016 and the insights yielded about it by the FBI. Trump, meanwhile, told reporters on Monday that he believed biased officials had been "caught" in an "attempted overthrow," although many of the events involved took place before the election. "It's a disgrace what's happened with the things that were done to our country ... it's incredible, far worse than what I ever thought possible," he said."

So is what's currently ensconced in the Oval Office.

"Attorney General William Barr cited the findings in a statement on Monday that faulted the Russia investigation and echoed the criticism of federal law enforcement voiced for years by Trump and his supporters. Barr criticized what he called "an intrusive investigation of a U.S. presidential campaign on the thinnest of suspicions that, in my view, were insufficient to justify the steps taken."

Barr is indeed everything Trump wanted and expected him to be.  An ardent supporter and shill for the narcissistic nazi currently occupying the Oval Office.  No separation, no independence between the 'Justice' Department and the Oval Office.  Raw nazism.

"Horowitz's inquiry is not the final word on the Russia investigation. The U.S. attorney for Connecticut, John Durham, was brought in by Barr earlier this year to examine the origins of the investigation, including the actions of U.S. and foreign intelligence services. Durham issued a rare statement of his own on Monday suggesting that he was reaching different conclusions from Horowitz. "Based on the evidence collected to date, and while our investigation is ongoing, last month we advised the inspector general that we do not agree with some of the report's conclusions as to predication and how the FBI case was opened," he said."

Bought and paid for?  LOL.

"Horowitz launched his inquiry in March 2018 following requests from the Justice Department and lawmakers. In the run-up to that announcement, Trump and many of the president's allies argued that the Russia investigation was a "witch hunt" to kneecap Trump's presidency. Overall, Horowitz's report found no evidence that the FBI and Justice Department acted with political bias in the broad frame of the Russia investigation. However, investigators discovered 17 significant errors and omissions in the application for surveillance on Carter Page, who had advised Trump's 2016 campaign. Horowitz's report concluded that the problems with the Page surveillance application represented "serious performance failures" by the FBI and other officials involved. Attorneys who were supposed to serve as gatekeepers standing between investigators and the Foreign Intelligence Surveillance Court were "unable to make a fully informed decision because information was kept from them." The investigators wrote: "Although some of the factual misstatements and omissions were arguably more significant than others, we believe that all of them taken together resulted in FISA applications that made it appear the information supporting probable cause was stronger than was actually the case."

If indeed true, that's a problem.

"The report issued today by the inspector general debunks the conspiracy theories about the Mueller report and the Russia investigation that President Trump and Republicans in Congress have pushed for years," the Democrats said."

Indeed, it does.

"Continued Nadler and Maloney: "Those discredited conspiracy theories were attempts to deflect from the president's serious and ongoing misconduct, first urging Russia and now extorting Ukraine into interfering with our elections to benefit himself personally and politically."

"Former FBI Director James Comey told NPR on Monday that he welcomed the Horowitz findings — which covered the actions of the bureau during the time Comey was in charge — because they exploded the myths told by Trump and supporters. "It's all made up. It's all lies. It's all nonsense," Comey said. The former director said he was pleased that Horowitz had uncovered the problem with the Page FISA application because now, he said, "they can be fixed." Overall, Comey said, the report validates what he said he's always argued about the FBI: "It's good people working really hard in unprecedented situations," but it's a "human institution" that makes mistakes and what the bureau must do now, he said, is "figuring out how we make sure they don't happen again."

"A confidential trove of government documents obtained by The Washington Post reveals that senior U.S. officials failed to tell the truth about the war in Afghanistan throughout the 18-year campaign, making rosy pronouncements they knew to be false and hiding unmistakable evidence the war had become unwinnable."

Same happened during the Vietnam fiasco.  History indeed repeats itself.

"The documents were generated by a federal project examining the root failures of the longest armed conflict in U.S. history. They include more than 2,000 pages of previously unpublished notes of interviews with people who played a direct role in the war, from generals and diplomats to aid workers and Afghan officials. The U.S. government tried to shield the identities of the vast majority of those interviewed for the project and conceal nearly all of their remarks. The Post won release of the documents under the Freedom of Information Act after a three-year legal battle. U.S. officials constantly said they were making progress. They were not, and they knew it. Bush and Obama had polar-opposite plans to win the war. Both were destined to fail."

Articles of Impeachment.  NBC News reports:

"House Democrats on Tuesday unveiled articles of impeachment against President Donald Trump about two and a half months after Speaker Nancy Pelosi, D-Calif., first announced a formal impeachment inquiry into the president. Judiciary Committee Chairman Jerry Nadler, D-N.Y., announced that his committee will consider two articles of impeachment — one for abuse of power and the other for obstruction of Congress — charging Trump "with committing high crimes and misdemeanors."

Woefully, inadequate.  Pathetically, incomplete.

"Nadler said the articles of impeachment were being filed in response to Trump allegedly soliciting foreign interference in the 2020 election, compromising national security, threatening the integrity of the upcoming election and concealing evidence from Congress and the American people. Trump, he said, violated his oath of office."

No question, certainly did.  The articles, however, are too narrowly focused, outrageously incomplete.

"Democrats released the draft articles later Tuesday morning. The articles allege that Trump "corruptly solicited the government of Ukraine to publicly announce investigations" into the Bidens and a conspiracy theory alleging Ukrainian interference in the 2016 election. Trump also "conditioned two official acts on the public announcements that he requested," Democrats wrote, citing nearly $400 million in military aid and an official White House meeting with Ukrainian President Volodymyr Zelenskiy. "Wherefore President Trump, by such conduct, has demonstrated that he will remain a threat to national security and the Constitution if allowed to remain in office and has acted in a manner grossly incompatible with self-governance and the rule of law," the articles read. "President Trump thus warrants impeachment and trial, removal from office, and disqualification to hold and enjoy any office of honor, trust, or profit under the United States." The second article, focused on obstructing Congress, states that Trump's conduct violated his oath of office and the Constitution, and that through that alleged obstruction, the president "sought to arrogate to himself the right to determine the propriety, scope, and nature of an impeachment inquiry into his own conduct, as well as the unilateral prerogative to deny all information to the House."

Democrats are rushing this fiasco to a conclusion instead of comprehensively including Mueller's ten examples of obstruction.  To say nothing of all the Emoluments Clause violations currently being slowly adjudicated in the courts, payoffs to two women for their silence during the campaign, etc.  List could go on and on.  Democrats are making it way too easy for Republican fascists in the Senate to rubber stamp their fuhrer, the Trump nazi:

"The articles are expected to be revised in the House Judiciary Committee this week and voted on soon after, which would send them to the floor for a vote on impeachment by the full House, possibly this month. If one or more of the articles pass, the Senate would then hold a trial to consider removing Trump. That would take a vote by at least two thirds of the Senate, most likely some time in January."

Highly unlikely Republicans will indeed stand on principle.  Rather,  GOP fascists will likely place narrow partisan interests ahead of justice, -- traitorously, treasonously ignore what's indeed best for the country.  That is, they'll rubber stamp and exonerate their clueless, out of control fuhrer.

"Trump, Nadler said, exercised "the powers of his public office to obtain an improper personal benefit" and engaged in "indiscriminate defiance of the impeachment inquiry." Trump fired back within an hour of the announcement, tweeting, "WITCH HUNT!" "Nadler just said that I 'pressured Ukraine to interfere in our 2020 Election,'" Trump wrote. "Ridiculous, and he knows that is not true. Both the President & Foreign Minister of Ukraine said, many times, that there "WAS NO PRESSURE." Nadler and the Dems know this, but refuse to acknowledge!"

Trump remains a congenital liar.  Increasingly, insanely out to lunch, devoid of, divorced from reality.  So are his henchmen, shills, and followers.

"The argument, 'Why don't you just wait?' amounts to this: 'Why don't you just let him cheat in one more election. Why not let him cheat just one more time. Why not let him have foreign help just one more time,'" Schiff said. "The president's oath of office appears to mean very little to him," Schiff added, citing Trump's chief of staff Mick Mulvaney's October call to "get over it" when asked about whether there was any link between the president's push for Ukrainian investigations and the withholding of nearly $400 million in military aid to that country. Mulvaney later walked back his comments. Pointing to Trump's personal attorney Rudy Giuliani's recent trip to Ukraine, Schiff said Trump "still wants Ukraine to interfere" in the 2020 election and boost his campaign."

"The Supreme Court on Monday declined to hear a case challenging a Kentucky abortion law from 2017 that requires people seeking the procedure to first undergo an ultrasound where a technician is required to provide a detailed description of what they see. The court rejected the case, without comment or dissent, leaving the law in place."

"A similar law exists in Louisiana where CBS News spent a week on the ground reporting on the state of abortion access. At the Hope Clinic in Shreveport, one of the state's last three abortion providers, the clinic administrator said it was one of the more emotionally taxing regulations they're required to follow, and patients often cover their ears or turn their head away so as not to see. Planned Parenthood said in a statement that the Supreme Court "continued to chip away at abortion rights" by allowing the law to take effect."

"This is the court's latest action taken against abortion, signaling a troubling road ahead for the fight to preserve abortion access across the country now that Justices Brett Kavanaugh and Neil Gorsuch have joined the bench and just months before oral arguments in a Louisiana abortion case," the statement said."

"Women facing an unexpected pregnancy deserve to have as much medically and technically accurate information as possible when they are making what could be the most important decision of their life," the statement said."

"Documents obtained by NPR shed new light on a bitter fight between defrauded student borrowers and U.S. Education Secretary Betsy DeVos. These borrowers — more than 200,000 of them — say some for-profit colleges lied to them about their job prospects and the transferability of credits. They argue they were defrauded and that the Education Department should erase their federal student loan debt under a rule called "borrower defense." DeVos disagrees: She says most student borrowers still got value from these schools and deserve only partial relief from their federal loans. Now, internal Education Department memos obtained by NPR show that career staff in the department's Borrower Defense Unit came down firmly on the side of defrauded borrowers. The memos show this unit reviewed thousands of borrower complaints against now-defunct, for-profit colleges, including Corinthian Colleges and ITT Technical Institute. Just weeks before DeVos was sworn in as secretary, the unit recommended to the department's political leadership that these borrowers deserve no less than full relief from their student debts."

Certainly, would have been the right thing to do.

"One memo, dated Jan. 9, 2017, begins: "Corinthian Colleges, Inc. ('Corinthian') consistently represented that all graduates obtained jobs after graduation or, relatedly, that its students were guaranteed employment after graduation. These representations were false and misleading. Accordingly, the Borrower Defense Unit recommends full relief for Corinthian borrower defense (BD) applicants." Another memo, dated the next day — Jan. 10, 2017 — arrived at the same conclusion for California-based students who allege they were lied to by ITT Technical Institute, and likewise recommended full relief."

Here's the problem:

"Until now, these internal department memos have been hidden from public view. Lawmakers had previously requested access to them, but DeVos and her department refused to hand them over. Instead, DeVos has criticized the Obama administration for lack of due diligence in processing borrower defense claims. In a Nov. 7 letter to Rep. Bobby Scott, D-Va., the chairman of the House education committee, DeVos wrote, "the clear intent of the prior Administration was to eventually provide blanket relief without review of the facts and evidence." In fact, the memos provide a robust review of the evidence, as well as a thoroughly researched counternarrative to DeVos' position. Instead of limiting students' debt relief by arguing, as DeVos does, that defrauded borrowers still got some value from their educations, these memos arrive at a different conclusion: that credits earned from Corinthian and ITT schools are essentially worthless. "Hundreds of unprompted student statements confirm that lack of value of an ITT education, as ITT students time and again report that their education was sub-standard and that their degree or affiliation with the school was an impediment rather than an asset as they sought employment," reads the Jan. 10, 2017, memo. It concludes: "Given this extensively well-documented, pervasive, and highly publicized misconduct, the Department has determined that the value of an ITT education — like Corinthian — is likely either negligible or non-existent. ... Accordingly, it is appropriate for the Department to award eligible borrowers full relief."

"The education secretary has the authority to override the recommendations of department staff, and DeVos has done just that. On Tuesday, the department unveiled a new plan to calculate how much defrauded students benefited from their educations and thus how much, if any, debt relief they deserve. Under this new model, most borrowers are unlikely to qualify for full relief.

"DeVos' new plan is the department's second attempt at resolving the more than 200,000 outstanding borrower defense claims. The first attempt was blocked in May 2018 by Magistrate Judge Sallie Kim of the U.S. District Court in San Francisco. Kim said the department's use of income data violated students' privacy, and she ordered DeVos to stop collecting on the debts of certain Corinthian students. In October, Kim fined DeVos $100,000 for contempt of court after it was revealed the department had not stopped collections. The department apologized, calling the collections a mistake, and said it was quickly moving to issue refunds. It is unclear whether DeVos' new use of earnings data will also run afoul of the law. News of the revised plan comes ahead of a much anticipated hearing scheduled for Thursday, when DeVos will testify before the U.S. House's education committee about her handling of borrower defense complaints."

Questions to be asked are simple.  Did she line her pockets, receive any remuneration?  Why wasn't she investigated, then criminally prosecuted if in fact there was any malfeasance?  Why is the top of the food chain afforded special treatment?

Trump loses another one.  NPR reports:

"A federal judge in Texas on Tuesday blocked the Trump administration from using $3.6 billion in funds allocated by Congress for military construction projects to help pay for a wall on the southern border. U.S. District Judge David Briones of El Paso ruled that the administration's use of an emergency proclamation last February to divert those funds to the border wall is unlawful. The ruling found that the administration was within the law in using an additional $2.5 billion intended for drug interdiction efforts for border wall construction. "The President's emergency proclamation was a blatant attempt to grab power from Congress," said Kristy Parker, counsel for the nonpartisan organization Protect Democracy, which represented the plaintiffs, in a statement. "Today's order affirms that the President is not a king and that our courts are willing to check him when he oversteps his bounds." The suit was brought by El Paso County and the Border Network for Human Rights. It argued that the administration overstepped its authority by "declaring a national emergency and violating laws of Congress limiting funds for barriers at the United States-Mexico border." The county also argued that it would suffer reputational and economic harm from the border wall project because the president's emergency declaration created the impression that the border city was dangerous. In October, Briones, a Clinton appointee, ruled that such claims had merit."

The following is a shameless, blatant effort by our fuhrer, the Trump nazi, to stifle free speech, abrogate the First Amendment.  NBC News reports:

"President Donald Trump planned to sign an executive order Wednesday that would effectively interpret Judaism as both a race or nationality and a religion under federal law so that the Education Department can take direct action against what he views as anti-Semitism on college campuses, administration officials said. The interpretation allows the Education Department, under Title VI of the Civil Rights Act of 1964, to withhold funding from college or educational programs it believes are discriminating in an anti-Semitic way. The law states that the Education Department can take such action against a program that discriminates based "on the ground of race, color or national origin" — but not on religion. The order comes largely in response to the Boycott, Divestment and Sanctions movement against the Israeli government for its treatment of Palestinians. The movement has become prominent on some campuses and resulted in actions that have left some Jewish students feeling targeted. In making the change, the Trump administration would be recognizing Jews as having a collective national origin."

The problem with this is the extreme likelihood it will be used to stifle criticism of the Israeli aggressor and its treatment of the Palestinians.  That, despite the following:

"The International Holocaust Remembrance Alliance defines anti-Semitism as "a certain perception of Jews, which may be expressed as hatred toward Jews," though “criticism of Israel similar to that leveled against any other country cannot be regarded as anti-Semitic." The definition also includes "denying the Jewish people their right to self-determination," which lists “claiming that the existence of a State of Israel is a racist endeavor" among such denials. Trump's order mirrors bipartisan legislation that stalled out in Congress, though critics have said the change could be used to stifle free speech and opposition to Israel's government."

That will not be tolerated.  First Amendment guaranties free speech.  Trump and his henchmen are attempting to change the definition to his political advantage:

"As The New York Times reported, the executive order was welcomed by the Anti-Defamation League and criticized by the U.S. Campaign for Palestinian Rights. "If President Trump truly wanted to address the scourge of anti-Semitism he helped to create, he would accept responsibility for his role emboldening white nationalism, perpetuating anti-Semitic conspiracy theories, and repeating stereotypes that have led to violence targeting Jews," Halie Soifer, executive director of the Jewish Democratic Council of America, said in a statement. "Instead, President Trump continues to view Israel and anti-Semitism solely through a political lens, which he attempts to use to his political advantage." The liberal Jewish advocacy group J Street also criticized the order. "This executive order, like the stalled congressional legislation it is based on, appears designed less to combat anti-Semitism than to have a chilling effect on free speech and to crack down on campus critics of Israel," J Street President Jeremy Ben-Ami said in a statement. "J Street is committed to fighting all forms of anti-Semitism — and we feel it is misguided and harmful for the White House to unilaterally declare a broad range of nonviolent campus criticism of Israel to be anti-Semitic, especially at a time when the prime driver of anti-Semitism in this country is the xenophobic, white nationalist far-right."

The hypocrisy?  Stunning:

"Trump has positioned himself as staunchly pro-Israel throughout his presidency, moving the U.S. Embassy to Jerusalem, recognizing the Golan Heights as Israeli and lambasting progressive Democratic lawmakers critical of Israel and U.S. support for it. The president has also been accused of perpetuating anti-Semitic tropes and emboldening white supremacists. He came under criticism this weekend for comments he made in Florida to the Israeli American Council, in which he said Jews had no choice but to support him in the face of Sen. Elizabeth Warren's proposed wealth tax on Americans whose net worth exceeds $50 million. "A lot of you are in the real estate business because I know you very well. You're brutal killers, not nice people at all," he said. "But you have to vote for me, you have no choice."

Jesus Christ.  Full of himself.  Full of shit:

"You're not going to vote for the wealth tax. ... Even if you don't like me, some of you don't. Some of you I don't like at all actually. And you're going to be my biggest supporters because you'd be out of business in about 15 minutes if they get it." The remarks drew cheers from the conservative-leaning crowd, but were met with condemnation from some Jewish groups."

and t15 FTP servers. This hacking attack apparently occurred the day
after Wells Fargo closed two accounts because I publicly accused them of
criminal activity.  Your company needs to look into this matter. Get these

the U.S. Attorney regarding all the ongoing criminal activity by Wells
Fargo, now extended to hacking and undue interference with the webhosts.

Welcome.   Liberty In Peril has been relaunched at a new URL:
libertyinperil.com. This is a new commercial site hosted in an overseas
country, which unlike our own, does value free speech, Net security,
privacy, equally importantly, despises hackers.  Banks too big to fail
should not have the ability to shut down ftp servers on four Liberty In
Peril websites, making upload impossible.  -- Simply, because they don't
want the truth of their criminal activity reported to the public.

Should this site not be kept up, running, and fully operational, the
libertyinperil.com domain will be quickly moved to a different host
despite cost and hassle.  No more bullsh-t.  Criminal complaints will be
prepared and filed against Amanda Wright, Lynn Massey, and the equally

Email notification of local businesses of these practices, has and will,

This site has finally been fully uploaded.  All links appear to be
properly working.  Typos in the rush to get material up have also been
corrected.  There will be a few additional changes to be made as time
allows.  Including, again, a smart phone-friendly abbreviated version of
each future Newsletter Edition starting with v434 that will be available
in addition to the regular edition.

Hopefully, now, I can finally get back to the business of this
publication, that is exposure of corrupt, abusive, inept, clueless
government lackeys beholden to their corporate masters, rather than
dealing with recalcitrant webhosts.  We'll see.  With the
libertyinperil.com domain, however, any necessary changes in webhosts will
be easy to make since all links won't have to be changed or deactivated.

The pressure on Wells Fargo will continue unabated.  Should they further
interfere with operation of this publication, it will simply provide
additional fodder for criminal complaints to be filed against them.

On 9-22-15, Kingsland Wells Fargo Store Manager Amanda Wright forced
closure of two accounts because for nearly three years this writer has
publicly accused her, her predecessor Lynn Massey, and the Wells Fargo
corporate management suite of engaging in criminal deceptive trade
practices, as well as pressuring, unduly interfering and/or bribing
webhosts to take these websites down.

Apparently, they have successfully managed to unduly influence and/or
bribe the federal Consumer Financial 'Protection' Bureau and Texas
Attorney General Consumer Protection Division as well.  Forget?  The bank
is considered too big to fail.  Considers itself government.

For all practical purposes, that's perversely true.  They have money and
resources to buy not only their human chattel, but their bought and paid
for government lackeys. Be interesting to see whether or not the U.S.
Attorney is untouchable, or sadly, similarly capable of being bought.

Immediately after closure of these accounts, the three operational Liberty
In Peril FTP servers were hacked.  What that means is that while all three
sites remained operational and accessible to readers, new material could
not be uploaded. This continues to date.

Worse, 'free' accounts on all three 'free' webhosts conveniently no longer
provide technical control panel support.  Clearly, they don't want to know
there are problems. Have managed, however, to find other ways to contact
webhost management and have done precisely that.

Will take a criminal investigation to determine who hacked the sites,
however.  Most likely, Wells Fargo had a hand in it.  Certainly, have the
resources.  Highly, unlikely the Llano County Sheriff's Office was
involved.  Hard to believe they would be that stupid.  The Bank, however,
has nothing to lose. Owns its government lackeys.  The Sheriff and his
outrageously corrupt and abusive goons, however, can expect further

The effort to expose Wells Fargo egregious deceptive trade practices continues.  Several years ago to determinedly apply renewed pressure on our truly worthless, egregiously self-serving Texas Attorney General, now Governor, an excoriating email was sent to the bastard. Copies of which were also passed on to both offending Wells Fargo officers. A copy was also sent to the Davis campaign and others at the time.

Voters did have a right to know as Attorney General, the GOP candidate for Governor apparently selectively investigated, or not, bona fide complaints filed by citizens against banks too big to fail.  Possibly, Wells Fargo could have lined his pockets in some fashion.  That has yet to be determined.

The bastard and his office, no matter what, failed to respond to the complaint originally snail mailed several years ago.  This material, figuratively targeting Wells Fargo and the governor 'wannabe' now Governor, had been posted and can be found by scrolling all the way down and clicking on the links well below.  ... Governor?  Wells Fargo bribe you to look the other way?

Will continue to do all I can to publicly expose this to all, both in this publication and elsewhere.  Have done precisely that with the following email sent to Matt Turner, Matt Turner Video Services, Marble Falls, TX.  A copy of it was also sent to Wells Fargo officer Amanda Wright.  She has, indeed, been promoted  branch manager. Not only by your corporate masters, but their bought and paid for government lackeys.  Too cowardly to stand up, allow disclosure of your identity when you rightfully complain to this publication of being mercilessly f--ked. Some of you falsely arrested, criminally assaulted, bogusly fined for 'offenses' you did not commit.  To line County coffers.  Keep the peasants in line and under control.  A fascist police-state. Nazi America.

Again, yet another reason why this publication is called Liberty In Peril.  Most galling? Nothing changes if you fail to step up and challenge corrupt, abusive, inept authority.  Too afraid, cowardly compliant to let the bastards know who you are.  Did it ever occur to the cowards out there if the identity of the accuser is kept under wraps the bastards will falsely claim it's all made up by this publication?  Thus, conveniently killing all credibility. Wake up.

Click here for a most interesting conversation between JP2 Linda Ballard and LCRA Communications Supervisor Mitch Hibbs who at the time was investigating a complaint made by the Henderson family against the 'judge.'  The recording had been made by Hibbs and provided by Phyllis Henderson who had gotten it through an open records request.   During the course of the recording you will hear the 'judge' make a terroristic threat against the Henderson family which the investigator laughingly shrugged off as a joke.

Seems former LCRA Ranger Lance Bilski, stepson of Llano County Sheriff Bill Blackburn, had been harassing the Henderson family regarding their tire business, Henderson Tire.  Worse? There are unsubstantiated allegations, that although very much attached, Bilski may have indeed engaged in improprieties, that is, egregiously unprofessional conduct relevant to the Henderson complaint.  All this had been covered in Newsletter Text V346.
