In
the bloodiest attack in months,
a car bomb in Iraq killed at least 66 and wounded approximately
100.
-- Despite a severe crackdown by the Iraqi government. In a
separate
incident, an Iraqi lawmaker and her seven bodyguards were kidnapped.
A normally Right Wing, partisan Republican, fascist U.S. Supreme Court seemingly dealt the "President" a severe body blow this morning. In a 5-3 decision with Chief "Justice" Roberts having recused himself, the Court ruled Mr. Bush may not try Guantanamo "detainees" in military tribunals. ... Stating to do so would be in direct violation of the Geneva Conventions, legislative authority given him by Congress to fight the war, the U.S. Constitution, as well as the Uniform Code of Military Justice. Imagine that.
Finally, supposedly a breath of fresh air. Remarkable coming from a Court that not only installed Mr. Bush as "President" after he stole the 2000 election, but has continually rubber stamped his evisceration of civil and constitutional rights and liberties, supposedly in the name of "national security."
The case involves the "detention" of Salim Hamdan, a former driver and body guard of bin Laden, held for four years on a charge of "conspiracy against the United States." -- Whatever the hell that means. The Court ruled the "President" must either try "detainees" at courts-martial, in the civilian courts, or set them free.
Sadly, a military tribunal is no more than kangaroo justice, where the defendant intentionally has greatly reduced rights, -- can be barred from the proceedings and viewing evidence against him, denied access to witnesses on his behalf, can be convicted on a standard much lower than beyond a reasonable doubt without the decision being unanimous, with hearsay "evidence" allowed, no right of appeal in the civilian courts, final appeal up to the "President" whose stooges brought charges against him in the first place, etc.. -- Nazi "justice" at its worst. Be interesting to see where the "Chief Executive" takes things from here, no? Then again, we already sadly know.
Perversely,
the Republican-owned
Supreme Court has cleverly given the "President" an out,
--
the option of seeking authorization
from Congress to conduct such tribunals nonetheless. Despite
the
fact it also stated conducting such commissions under the circumstances
would in fact be a violation of the Geneva Conventions, the U.S.
Constitution,
and the Uniform Code of Military Justice. Particularly
perverse,
in addition, since it was indeed military attorneys, officers,
who
took the "Commander In Chief" to court in the first place.
Men,
who courageously placed their
oaths of office to protect and defend the Constitution,
ahead
of their military careers
as well as the perverse interests of their Nazi "Commander In
Chief."
That is, to deliberately abrogate rights of "detainees," supposedly in
the name of "national security" according to the "President."
Mr.
Bush has perversely claimed
he will indeed do all he can to fight to secure the "right" from
Congress
to deny "detainees" their rights and try them at military
tribunals.
This is again proof positive the "President" and his henchmen have no
bona
fide winnable cases against these men.
Otherwise,
they would immediately
charge them in the criminal court system.
This is also proof positive the "President" has no regard for civil and constitutional rights and liberties afforded all under the jurisdiction of the United States. If "detainees" are successfully denied rights, who next? Critics of the Bush "Administration?" Anyone who questions corrupt and abusive government? Anyone who doesn't go along to get along? Regardless, the "President" and his henchmen Aryan arrogantly interpret the latest Court ruling as a "technicality." Apparently, they're right.
Laughably, the "President" and his henchmen falsely claim prosecution in the criminal justice system would greatly place "national security" in jeopardy. The "President" is a liar. He knows the government has no case against most, if not all of them. Especially, since these "detainees" have been tortured and abused to extract "useful" "information." Having been tortured and abused, they have been rendered unprosecutable in the criminal justice system. To say nothing of the fact authorities have little to no evidence against them. Precisely, why the "Administration" wants kangaroo tribunals.
Sadly, Congress has already begun the process of giving the "President" the "out" conveniently provided him by the outrageously fascist Court. Sen. Arlen Specter, R-Pa, also affectionately known as "Anal Sphincter," reportedly quickly introduced legislation "authorizing" such tribunals. Despite the fact the Court just ruled such commissions are in violation of the Geneva Conventions, the Uniform Code of Military Justice, and the U.S. Constitution. Nazi "justice." In Nazi America.
Not
surprisingly, the three most
fascist members of the Court dissented in the latest ruling,
--
Scalia, Thomas, and Alito.
Chief "Justice" Roberts, who recused himself since he earlier presided
over the case as an appeals court "judge," would indeed have joined the
minority otherwise. All four would have certainly rubber
stamped
the actions of a Nazi "President" without reservations imposed by the
less
fascist five.
Saddest of all was the performance of Associate "Justice" Clarence Thomas at the time the ruling was handed down, -- who felt pompously compelled to read his dissenting minority opinion from the bench. ... The second time in fact he has done so since taking office. Mr. Thomas whined this is the first time in history a President has had his powers clipped during war time. Tough, isn't it?
... Hey, Clarabell, pardon, Clarence, since when is a President's power unlimited during a war? Since when do we have a king, an emperor and not a President beholden to the Constitution and Bill of Rights? A check on unlimited power? Wake up, "Judge," your ignorance is stunning. Further proof you have no business on the Court.
Reportedly, there are currently 450 "detainees" at Guantanamo, 310 have been released, and 80 are being considered for trial. No question, if the "President" and his henchmen conduct kangaroo tribunals, the rest of the world will see them for what they are. Nazi "justice."
Sadly and ominously such kangaroo "justice" will endanger captured American POWs, since our enemies will be all too willing to reciprocate in kind, or worse, and apply their brand of "justice" when it comes their turn.
Worst
of all, if the "President"
and his henchmen are successful in denying "detainees" their rights,
who's
next? Anyone critical of the Nazi occupying the Oval
Office?
Anyone critical of the GOP and the Fascist Right? Anyone
critical
of outrageously corrupt and abusive government? Anyone who
won't
go along to get along?
In a 7-2 decision written by six Supreme Court "justices," the Court ruled, with the exception of one instance unfair to Hispanics, Republican gerrymandering of Texas congressional districts is constitutional.
Amusingly, Tom DeLay's redistricting plan is the most gerrymandered in history. ... With some narrow districts extending hundreds of miles. The Court, however, saw nothing wrong with any of it. -- Despite the fact the GOP re-drew the districts half way through the census period.
Then again, wouldn't want to confuse anyone with the truth. Regardless, nothing less could be expected of a Court that indeed not only allowed, but facilitated "President" Bush in his successful attempt to steal the 2000 election. ... A supposedly un-partisan Court.
The Court took things dangerously further in this re-districting decision, however. It ruled states can re-district any time they please during the ten-year census period. In addition, they can re-district as frequently as they choose. Likely result?
Districts will become permanently Republican or Democrat. Worse, there will be no incentive to cooperate. Both parties will become locked in dispute with no resolution possible. Think the atmosphere overly partisan currently? You 'ain't' seen nothin' yet, friends.
Why, how can there be cooperation when districts permanently belong to either party? Why should they cooperate since they'll be returned to office no matter what they do? Who will run against them when there is so little chance of breaking the partisan stranglehold in a given district?
A partisan Republican, fascist, Right Wing Supreme Court demonstrated its tunnel vision in this decision. While it will immediately favor the GOP as intended, think Democrats won't eventually develop killer, cut-throat tactics perfected by the Republicans?
The Court has myopically ensured nothing substantive will be accomplished by either party for the foreseeable future. Then again, the Fascist Right clearly believes such gridlock preferable to any movement from the Right.
As readers will recall, radio talk show host Rush Limbaugh recently successfully plea bargained a prescription drug fraud charge. Seems Mr. Limbaugh can't seem to stay out of trouble, however. He was detained for three hours at the Palm Beach Airport after officials searched his baggage and found a bottle of Viagra that was in his doctor's name.
Seems Mr. Limpbough, pardon, Mr. Limbaugh, had it put in his physician's name to protect his privacy. Highly likely, there will be no charges. After all, the rich and powerful nearly always buy their way out of trouble.
Had
it been anyone else, their
sorry ass would have graced a jail cell on the earlier offense, -- as
well
as the latest. So much for equal "justice," no?
After all,
equal justice is amusingly decried as "class envy" by the Fascist
Right.
Then again, day is night, night is day, and manure smells perversely
sweet
in Nazi America.
That's
right. The "Justice"
Department is extremely good at "prosecuting" terrorists at news
conferences.
When it comes to the court room, however, it is an entirely different
matter.
While officials publicly slap each other on the back after an arrest is
made, nearly all these cases are drastically plea-bargained down or
dismissed.
Of 261 convictions since the 9/11 catastrophe, the average sentence
obtained
by federal goons is one year. That's right. One
year.
Fascists in the U.S. Senate nearly managed to pass the Flag Amendment getting 66 votes, one short of two-thirds passage. No question, the closest the GOP and a handful of Democrats have come in the last few years.
Desecration of the Flag is despicable. Not only does the Flag represent what our formerly great country used to stand for, it is a symbol of the sacrifice of millions who have served their country and died for it.
At
the same time, the Flag is
a symbol of civil and constitutional rights and liberties.

Precisely, what our soldiers
valiantly fight and die for. Despicable as it may be, Flag
burning
or desecration is a right of free expression provided for by the First
Amendment.
Exactly, why both Republican and Democratic fascists remain so eager to abrogate this most precious of all the Amendments in the Bill of Rights. Without free expression, none of the others has any meaning or significance.
Flag desecration is not akin to yelling "Fire!" in a theater or making a terroristic threat. Although it is extremely offensive, it puts no one at risk, -- other than the jackass doing it. An otherwise increasingly fascist Supreme Court has repeatedly ruled it permissible. Free expression. Only a matter of time before fascists in the Senate, however, eventually pass this abomination and abrogate this most precious of rights. Perversely, in the name of "patriotism" and "freedom."
The "President" and his sidekick, "Slick Dick" Cheney, amusingly, have their shorts tied up in knots over recent disclosures by The New York Times of two domestic spying operations. The first involves ongoing warrantless interception of international phone calls of American citizens. The second, access of millions of international banking records of tens of thousands of other citizens. All without warrants.
The "President" and "Slick Dick" disingenuously whine such disclosure by the media jeopardizes "national security." Unadulterated self-serving BS. The "Administration" itself has repeatedly informed the media it was tracking international banking records. Also, terrorists know they're being tracked through phone calls, banking transactions, etc.. Both foreign and domestic. To claim otherwise is to dangerously underestimate their intelligence. At true great peril to our national security.
Disclosure of warrantless spying, however, politically endangers the fascist occupying the Oval Office and his henchmen. It demonstrates they have no regard for civil and constitutional rights and liberties. As Franklin wisely stated well over two hundred years ago, anyone willing to trade liberty for security deserves and winds up with neither.
The Bush "Administration" is the most secretive in history. -- Indeed, even putting President Nixon to shame. As proven over thirty years ago, however, Nixon had something to hide. Precisely, why he did all he could to maintain secrecy. Apparently, exactly why Mr. Bush is doing the same.
"National security" is the excuse the "President" and his henchmen are cleverly using to perniciously consolidate power through abrogation of civil and constitutional rights and liberties. A gutless, cowardly public is apparently buying the ruse, with the "President's" approval rating rising five points in the last month.
Slamming the media for disclosure of lawless unconstitutional domestic spying tactics is a sure sign of a tyrant. ... A tyrant who is desperately trying to cover his ass and cleverly maintain the ruse. GOP congressional fascists are calling for an "investigation" by the "Justice" Department of The New York Times.
-- A sure sign the Fascist Right is indeed soiling its collective pants. One Right Wing fascist, Rep. Peter King, R-NY, has even gone so far as to claim The Times should be prosecuted for espionage. ... Nothing quite like the pot calling the kettle black, or the criminal calling the victim the perpetrator. Nazi distortion of reality at its worst.
Secrecy has been used as a tool, a convenient weapon, by the Bush "Administration." In all areas of domestic life. Think about it, dear readers. Think recent outrageous gas gouging a fluke? Think again. -- We still don't know the substance of the agreement made by the "President" and the oil companies very early in his "Administration."
Mr.
Bush indeed successfully kept
it secret, using the courts as a rubber stamp. A few years
later
we're paying record high energy prices not
justified by anything
other than profound greed. At a time of record profits for
energy
companies. Who'd 'a 'thunk' it, no? Proof positive
the fix
is in. ... If it walks like a duck, looks like a duck, quacks
like
a duck, it's got to be a duck. Then again
when you're aggressively
stupid you deserve the ungreased shaft.

To date, no response, other than a canned autosponder message has been
received from national ACLU headquarters to the latest complaint
filed.
