"President" Claims Domestic Spying Powers December 19, 2005
In an exceptionally testy and aggressive news conference this morning, the "President" repeatedly claimed statutory and constitutional authority to eavesdrop on American citizens placing international phone calls and emails. Statutory authority claimed is the Afghanistan war resolution passed by Congress soon after the 9/11 catastrophe. Constitutional authority cited is power as Commander In Chief, Article II, Section 2.
The "President" once again lied to the American people. At no time did Congress debate domestic eavesdropping during consideration of the resolution authorizing an attack on Afghanistan. Nor is there mention of it. Furthermore, nowhere in Article II is the President constitutionally empowered to eavesdrop on American citizens with no court oversight.
Yet, the "President" and Attorney General Alberto Gonzales strongly assert Mr. Bush indeed has the authority to precisely that. In Nazi America. Just because the "President" and his henchmen persistently argue non-existent powers doesn't make it so. Furthermore, nowhere does the Fourth Amendment grant the President the power to eavesdrop without a warrant. In fact, the Fourth Amendment is quite clear.
The people indeed have the right to be free from "unreasonable searches and seizures." A warrant must be issued upon probable cause by a judge to execute a search. In addition, the "place to searched" must be described, as well as the "persons or things to be seized." The Founders made themselves abundantly clear.
For many decades, however, this exceptionally precious right has been eviscerated and bastardized by "judges" "legislating" their perverse ideology from the bench. Fascists, who have no respect or regard for civil and constitutional rights and liberties. Also, by legislators just as eager to rescind these very same principles.
The aggressively stupid public has gutlessly, foolishly looked the other way, -- or even cheered the bastards on. Falsely, in the name of "national security" and "law and order." Allowing this outrageous atrocity to continue unabated. Whatever happened to liberty?
Did it ever occur to most readers nearly all warrants are granted by "judges" with or without bona fide probable cause? "Judges," clearly in the pocket of law enforcement, far from impartial. -- Are police that perfect, that pristine, that nearly all warrants should be granted?
At
least, however, the charade
of impartiality and due process remained in effect, -- until the Nazi
occupying
the Oval Office thought otherwise and signed a secret Executive
Order.
An Executive Order that shamelessly abrogates the Fourth Amendment
requirement
of judicial overview. In direct violation of the Constitution
and
his oath of office.
In his Saturday morning radio address, the "President" finally admitted he authorized the National Security Agency (NSA) to spy on American citizens with no court order. -- After refusing yesterday to confirm or deny the story.
Aryan arrogantly, he claimed he had the authority to do so, legally and constitutionally. Sadly, Mr. Bush is a liar. He deliberately abrogated the Fourth Amendment right of reasonable searches and seizures, -- to consolidate power.
The NSA and the fascist occupying the Oval Office had no warrant. No probable cause, reviewed by a judge as required by the Fourth Amendment. To their credit, some NSA operatives indeed reportedly refused to follow the Executive Order, fearing prosecution.
The "President" went on to criticize the press and described the New York Times article breaking the story as "unauthorized disclosure." Is that right, Mr. "President?" Revealing the fact you egregiously violated your oath of office and obligation to protect and defend the Constitution? Including the Fourth Amendment?
Apparently, Mr. Bush believes he is king, and not subject to statutorial and constitutional restrictions. As the rest of us, right, George? The "President," while clearly believing himself to be omnipotent and a dictator, has apparently forgotten we have no Fuhrer, no El Duce here, as in Nazi Germany and fascist Italy.
Outrageously, the New York Times sat on this story for a year, having been asked to do so by the Bush "Administration. For "national security" reasons, -- of course. Translation? The Times protected the "President's" sorry, outrageously corrupt and abusive ass. ... So much so, for a supposedly "liberal" press.
Worse,
Sen. Jay Rockefeller, Dem-W.Va.,
and others, knew of this atrocity by the "President," but were forced
to
remain silent. To avoid prosecution for violating federal
secrecy
laws.
--
Laws that were cleverly designed
to protect corrupt and abusive government officials and silence whistle
blowers.
Precisely, why at least 90% of classified material is unnecessarily classified. For decades. Certainly, not for "national security" reasons as alleged. In Nazi America.
Aryan arrogantly and defiantly, Mr. Bush also claimed he renewed the NSA domestic spying Executive Order more than thirty times, and will continue doing so every 45 days until he sees fit to end it.
The "President" should be immediately impeached, convicted, and removed from office. Then, criminally prosecuted, not only for this offense, but others repeatedly detailed in this publication.
Secrecy within the the Bush "Administration" is unparalleled. As President Nixon eloquently demonstrated, there is one reason, and one reason alone, for iron-fisted secrecy. To cover up abuse and corruption. Sadly, ole' George "The Tush" makes "Tricky Dick" look like a choir boy.
In his radio address, the "President" also complained of the filibuster of renewal of the USA "Patriot" Act. Tough, isn't it? Hopefully, the fortuitously timely disclosure of domestic spying by NSA in direct violation of the Constitution will only reinforce determination of the Senate to block renewal of this equally and outrageously unconstitutional, atrocious piece of legislation.
-- Designed to cleverly eviscerate civil and constitutional rights and liberties, falsely in the name of "national security." Diabolically and brilliantly, consolidate power of the fascist occupying the Oval Office and his cronies.
Ironically, the "President" already had power granted him by the Foreign Intelligence Surveillance Act (FISA) to wiretap anyone he chose for 72 hours without approval of a secret FISA "court" "judge."
Rubber
stamp "jurists," who 99%
of the time, allow the government to do as it pleases. In
Nazi
America. This outrageously unconstitutional power,
however, was
apparently insufficient for the Nazi occupying the Oval
Office. He
wanted more.
In a stunning blow to the "President" and Republican leadership, the Senate blocked renewal of the USA "Patriot" Act. Consequently, if there is no "compromise" by the end of the year, 16 of the worst provisions of this outrageously unconstitutional legislation will expire.
Hat's
off to 41 Democrats and
4 courageous Republicans who had the guts to stand up for civil and
constitutional
rights and liberties. ... At least, as of today.
Tomorrow,
will likely be different, another story, as the "President" and his
equally
fascist henchmen renew their efforts to reverse today's truly
courageous
stand for liberty and rights in our formerly great country.
Bush Authorized NSA Domestic Spying Without Court Order December 15, 2005
The New York Times finally broke a most interesting and chilling story it had been sitting on for a year. In 2002,, the fascist occupying the Oval Office signed a secret Executive Order authorizing the National Security Agency (NSA) to monitor international telephone calls and emails of hundreds, if not thousands, of American citizens. With no court order.
No review by a judge. No probable cause. An outrageous abrogation of the Fourth Amendment by a "President" who falsely swore to protect and defend the United States Constitution. Clearly, Mr. Bush has traitorously given the enemy a victory it never could have achieved on the battlefield.
The Founders of our formerly great country must be spinning in their graves. As Benjamin Franklin wisely and prophetically stated over 200 hundred years ago, anyone willing to trade liberty for security deserves and winds up with neither.
The true threat to "national security" is not al Qaeda, any domestic or foreign terrorist group, or sovereign power. Rather it insidiously resides right here. At all levels of government. Borne by bona fide fascists in power who deliberately ignore civil and constitutional rights and liberties.
In
Nazi America.
Where we no longer have a President, but a fascist dictator who is law
unto himself. If "national security" means loss of civil and
constitutional
rights and liberties, death is preferable.
Confronted
with strong opposition
to domestic spy operations, particularly of a Quaker anti-war group,
the
Pentagon has announced it will "review" its domestic
operations.
Generous, isn't it?
Facing insurmountable opposition in Congress, the "President" of the United States caved in to Sen. John McCain and will sign a defense appropriations bill including an amendment prohibiting torture, cruel, inhumane treatment of "detainees." This measure will apply to all American personnel, including CIA operatives.
Amazing,
isn't it, the "Commander
In Chief" had to be dragged kicking and screaming? -- A
fascist,
who sickeningly believes the Geneva Conventions of War to be
"quaint."
... Until American forces and operatives are sadly captured, tortured,
and abused.
Voter
turn out in the Iraqi parliamentary
election was spectacular, early indications, 70%. Violence
was much
lower than usual with "only" five killed. Time for the
"President"
to haughtily proclaim "victory," and get the hell out.
The
federal government will spend
in excess of $3 billion to rebuild the levees severely damaged by
Katrina,
that led to catastrophic flooding in New Orleans.
Problem?
The intended repairs will withstand a Category 3 storm. --
Katrina
was a 5. ... Anything wrong, here?
Billions of taxpayer
dollars will be expended, only to be wasted should New Orleans be
slammed
with a Category 4 or 5 hurricane. Sensible? ...
Only in America.
The Pentagon has awarded contracts worth $300 million to three companies who will disseminate American propaganda over the next five years. Think confidence and trust will be restored world-wide? Or will a profoundly and rightly skeptical world lose what little faith it has in the United States?
Liberty
is based on a free independent
press. Propaganda, whether true as claimed or deceptively
false,
always
kills credibility. Always. This outrageous,
aggressively stupid
attack by the Bush "Administration" on media independence will
ultimately
backfire. ... Leaving the "President" of the United States
looking
like the idiot he apparently is.
One
thousand days have passed
since the fascist occupying the White House invaded Iraq under false
pretenses.
The American death toll stands at 2,154 killed in action.
Well over
15,000 maimed. Estimates of Iraqi war dead range from 30,000
to 70,000.
The "President" of the United States bears ultimate responsibility for
all the carnage. ... How do you sleep nights with so much
blood on
your hands, George?
No question, EEOC is clearly in the pocket of the business community. Certainly, not employee-friendly. Worse, fascist "judges" continue to deliberately weaken it, -- conveniently "legislating" their perverse ideology from the bench in the process.
Abused by an employer? Tough. Buck up. Want to sue? Too bad. Certainly, not so easy to do any longer. ... After all, business is to be protected at all costs, right? -- You must first get permission to sue from EEOC. Imagine that. Whatever happened to the Seventh Amendment and the right to seek redress in the courts?
For years, the GOP, party of the rich, rich 'wannabes," and big business, has deliberately and intentionally eviscerated access to the courts by the middle class and those on the bottom. -- To further line the pockets of the insatiably greedy business community and its wealthy benefactors.
Tort
reform? A crock, imposed
on a gullible public all too willing to believe any
phony propaganda
and clever distortion of reality coming from the Fascist Right and its
shills. In Nazi America.
