Texas Re-Districting Illegal Says Internal DOJ Memo December 2, 2005
The Washington Post reported a recently obtained internal "Justice" Department memo stating Texas re-districting is illegal and in violation of the Voting Rights Act was overruled by higher-ups. The memo was written by career DOJ attorneys who are not political appointees. Interesting, isn't it?
Pundits claim the disclosure will likely amount to nothing, however, two years after the fact and this late in the game. Sad, isn't it? Whatever happened to justice? The Supreme Court is now considering whether or not to take the case.
Apparently,
indicted Texas Cong.
Tom DeLay's influence and power extended to the highest echelons of the
"Justice" Department. In Nazi America.
Where a corrupt
and abusive fascist judiciary is never confused
with the truth.
Since the Supreme Court allowed resumption of executions in 1977, 1000 have been killed by government in the name of the people. During that period, reportedly, 61 were removed from death row, exonerated by DNA and/or other evidence. Can only wonder how many innocent people have been murdered by the state, in the name of "justice."
The United States is the only supposedly civilized country to still execute criminals. The Fascist Right believes the death penalty to be a deterrent. Is it? Most who kill don't consider the consequences of being caught. They're too focused on the murder itself. Others foolishly believe they're far too smart to get caught.
The Nazi Right complains effectiveness of the death penalty is compromised by the usual extended period of time from conviction to execution, -- due to what it considers to be interminably excessive appeals. Their claim is nonsense for at least three reasons.
First, most murders are crimes of passion and not pre-planned. In the heat of the moment, the would-be murderer does not have time or the inclination to think of the consequences. He or she blindly wants to kill.
Second, the murderer who carefully pre-plans a killing always thinks he'll get away with it. Foolishly and stupidly believes he's too smart to get caught by aggressively stupid authorities.
Third, most ironically, amusingly, and rhetorically, the death penalty can have no deterrent on a "murderer" who has been mistakenly convicted or framed for a crime he did not commit. He's simply unjustly executed, murdered by the government in the name of the people.
Shortening the time of appeals, or limiting their number, will only result in the killing of more innocent people by execution than already is happening. -- One mistaken conviction and execution is one million too many. Especially, if the innocent person executed is a family member, friend, acquaintance, neighbor, etc.. ... To say nothing of what it does to faith and trust in the judiciary.
The Fascist Right claims capital "punishment" to be justice, not revenge. Absolute BS, and clever distortion of reality. First, punishment is inflicted on criminals to change future behavior. -- Duh, one can't change behavior of the dead.
There's no future behavior to presumably correct, since they're dead as a result of the punishment. Furthermore, punishment is extremely ineffective in controlling long-term behavior. -- Positive reinforcement works much better. Decades of research supports this indisputable fact, conveniently and mindlessly ignored by the Fascist Right.
Nearly all executed in our formerly great country were "spanked," that is, beaten as children. It did not correct their undesired behavior. It exacerbated it. One of the reasons why they were on death row in the first place.
Prison is a place to house recalcitrant or dangerous criminals who prey on society. To protect the public. Without rehabilitation, however, punishment has no effect on future behavior. Only makes criminals more dangerous. Rehabilitation, i.e. "correction," is no longer stressed in our prisons. Precisely, why most criminals released after their prison terms re-offend.
Second, justice and revenge are not one and the same. -- Despite claims to the contrary by some in the Nazi Right. Justice dictates change in future behavior, and restitution to victims. Executions deny both to survivors of victims killed by capital murderers.
Execution does not bring back the dead victim. It does, however, produce another grieving family. The "pound of flesh" secured by murdering the murderer rings hollow. Many family members have remarked the death of the murderer brings no long-term comfort, no sense of resolution.
Worse, it allows the murderer to get off easily. He or she dies and no longer has to deal with the consequences of the crime. Never has to worry about the drudgery of spending the rest of life in prison. Ironically and amusingly, capital punishment denies revenge. -- The very same "punishment" the Fascist Right desperately wants.
Furthermore, keeping a prisoner caged for life with no chance of parole is far cheaper than the appeals process. ... An appeals process that can't and won't change without killing additional innocent people. In addition, work should be required of prisoners, -- or they don't eat. ... Why shouldn't prisoners be productive? Why shouldn't they at least partially, if not fully, pay for their incarceration through work?
Eliminating capital punishment, however, would end the blood sport of executions. There would be no pompous, self-righteous, self-serving, disingenuous pontification of legalized murder, by people who condescending and patronizingly believe themselves to be morally superior to the condemned. No more self-righteous crowing by the Nazi Right at legalized murder spectacles.
No more getting their cookies off while the condemned dies on the table. Sickeningly, many proponents of legalized murder demand far more excruciating forms of execution. A few sick puppies have called for crucifixion of the condemned. Others prefer beheadings. The list can go on. After all, there's no end to the desperately mentally ill in the United States.
Time to televise all executions. When the aggressively stupid people of our formerly great country finally understand what legalized murder is truly about, absent the sterility of closed execution chambers, they may finally wake up.
Precisely,
why graphic battlefield
images should also be run during newscasts. Let the people
truly
understand the meaning of death, promulgated by the leadership of our
once
great nation. Nazi America.
For years, the Fascist Right correctly complained of crass commercialization of Christmas. Also, rightfully claimed the Christmas Tree has its roots in paganism. No question.
Now, amusingly, the Right is shamelessly whining about "Holiday Trees" and other euphemisms substituted for the venerable, previously vilified, "Christmas Tree."
Laughably, government authorities have recently succumbed to political correctness and have ludicrously re-named the Christmas Tree, -- to supposedly ensure non-Christians are not offended. ... Got it?
Who cares? This is a non-issue. The Fascist Right should wisely address and check its seemingly unlimited hypocrisy. Just as pointedly and conversely, anyone offended by calling a Christmas Tree a "Christmas Tree" is nuts. Again, who cares?
There
are far more important First
Amendment church-state separation issues to be considered and
fought.
... Such as getting the Fascist Right the hell out
of the bedroom,
a woman's uterus, and her doctor's office. In Nazi
America.
Supreme
Court nominee "Judge"
Samuel Alito met with Senate Judiciary Committee Chairman Sen. Arlen
Specter
earlier today. Mr. Alito assured Specter his memorandums
issued during
the Reagan Administration, regarding how to gradually and eventually
deny
a woman's right to an abortion, would not affect
his "judgment"
and "impartiality" while on the Supreme Court. Comforting,
isn't it? ... There's a bridge for sale in Brooklyn, Sen.
Specter
and his shills may also be interested in buying.
Yesterday, the U.S. Supreme Court heard a New Hampshire abortion case challenging parental notification of underage women. Not surprisingly, a number of "Justices" had no problem further restricting abortion. Others were more concerned with the fact the New Hampshire law allowed no provision for health concerns of the mother.
New Hampshire legislators had deliberately left out such provisions in an effort to make it much harder for women to get an abortion. Whatever happened to freedom in our formerly great country? Roe v. Wade is settled law. ... Even our outrageously fascist Chief "Justice" disingenuously said so to attain Senate confirmation. Women have a right to an abortion. Yet, the Fascist Right has repeatedly and deliberately forced legislation and court rulings abrogating that right.
The blatant intentions of these Nazis is to finally outlaw all abortions, doing so incrementally. Recently-appointed Chief "Justice" John Roberts made no attempt to hide his perverse religiously-based anti-abortion views during oral arguments. He and his fellow Nazis wouldn't know freedom and constitutional rights and liberties if they bit them hard on the ass.
All these unabashed judicial fascists are trying to do is further restrict liberty and rights guarantied by the Constitution and Bill of Rights. Rights and liberties severely restricted in the last thirty-five years or so. Conservatives want as little government and restrictions on liberty as possible. Fascists seek the direct opposite. They falsely claim to be "impartial," while shamelessly "legislating" their perverse religious views from the bench.
If an underage "girl" has reached puberty and is old enough to be charged as an adult if she commits a variety of felonies, she's old enough to decide when she's ready for sex and with whom. Furthermore and bluntly, if a woman is old enough to willingly spread her legs and risk getting pregnant, she's old enough to decide what she can and can't do with her uterus.
Whether she gets an abortion is up to her. Not her parents. Not a damned legislator, judge, or preacher. When will parents and a condescending patronizing government and religious establishment finally allow young people to grow up? Instead of keeping them in the nest and dependent until they're in their late twenties, thirties, or even forties?
Conversely and without question, Internet sexual predators are an enormous problem. Law enforcement is not the solution, however. Parents are. By their own admission, police can't keep up with the problem. Entrapment is ineffective. -- They only entrap an extremely small number.
Worse, at some point, a truly innocent person will be entrapped, severely calling such police tactics into question, constitutionally. Despite severe penalties and lifetime ramifications such as registration of sex offenders, children are still victimized. Sadly, the problem is so pervasive and insidious law enforcement can't even scratch the surface.
Parents can, and must. Why are children granted unsupervised unlimited Internet access? Any parent who allows Internet access in a child's room is outrageously incompetent, -- or insane. Why don't parents insist the computer be located in a very "public" area of their home? Like the kitchen, dining room, living room, rec. room, or anywhere everyone gathers? Where the child has no privacy? Why are kids in chat rooms, period?
When
will parents finally wake
up and start doing their job, -- instead of expecting police to solve
the
problem for them? The police can't do it alone.
Parents must
actively control what their children do. It all begins in the
home.
The community can only do so much. Our children deserve
better.
The "President" did a reasonably good job delivering a well-written Iraq pep rally speech to naval cadets at Annapolis. Surprise, surprise, shills of the "Commander In Chief" immediately praised and embraced the vision of our fearless "leader." Touching, isn't it?
Pressured by war critics, Mr. Bush and his cronies had earlier published a partially-declassified 35 page treatise on the war called National Strategy For Victory In Iraq. Leaning heavily on this material, speech writers for the "President" eloquently produced a speech, delivered in front of an extremely friendly audience, that was supposedly designed to be a "Plan For Victory" as claimed by the backdrop to the "President."
No more than a re-hash of "Administration" propaganda the last two and a half years, the "President" stressed three major goals. -- To create a free society, provide security, and rebuild the country.
Disturbingly, Mr. Bush presented an extremely rosy picture of progress in the war that does not jive with reality on the ground. Worse, he neglected to mention according to recent polls 80% of Iraqis want Americans to leave. Sadly, 45% think killing American occupiers is okay.
... Once again the "President" assured cadets and the nation the United States would not cut and run during his "Administration." -- A promise he cannot deliver should Congress cut off funding of the fiasco in the future.
Interestingly, the "President" in his speech praised support from Democrat Sen. Joe Lieberman of Connecticut. Lieberman has broken ranks with his party on the current status of the war. He believes the military is winning and making remarkable progress.
-- Unlike Democrat Sen. John Murtha who recently reversed his stand and came out against the war, after supporting the "President" for years.
It must be remembered Sen. Lieberman is an unabashed long-term supporter of Israel and a shill of the Israeli lobby. Apparently, believes Israel can do no wrong and should be financially supported no matter what it does vis a vis the Palestinians.
Precisely, why it is politically expedient for him to support the "President" and his closely related Iraq policy. -- Mr. Bush, a cunning politician, was not beneath taking advantage of this fact.
Sadly, Mr. Lieberman, along with other Israeli lobbyists, would prefer to see American troops fighting and dying combating terrorists in Iraq, rather than Israelis having to do it in Israel.
... After all, the "President" of the United States has deliberately and foolishly created a haven for terrorists in Iraq that did not exist before the American invasion. Sparing the Israelis, whose intransigence and ill-treatment of Palestinians is directly responsible for modern day terrorism, from having to fight them themselves. Convenient, isn't it? Pernicious, as well.
Ironically,
the most poignant
quote of the speech, however, ignores the reality of the "President's"
war against civil and constitutional rights in our formerly great
country:
"...
freedom is destiny of every
man, woman, and child in this country." Indeed, Mr.
"President,"
indeed.
Particularly
galling and disingenuous,
however,
since you have signed into law outrageously unconstitutional
legislation
deliberately designed to stifle liberty such as the USA "Patriot" Act,
Homeland "Security" Act, "Real" ID Act, etc., and equally
unconstitutional
Executive Orders.
--
All cleverly designed to eviscerate
the Fourth, Fifth, Sixth, and Eighth Amendments. In the name
of "national
security," of course. In Nazi America.
Amusingly, the "President" carefully neglected to mention in his speech American troops are currently writing propaganda articles in Iraqi newspapers. Military personnel are craftily submitting these articles without disclosing their identity. Paying Iraqis to publish material, no more than blatant propaganda. Reportedly, $6 million in taxpayer dollars to date.
Readers are reminded the "President" and his "Administration" have repeatedly and surreptitiously bribed "conservative" radio talk show hosts in this country to get their point across. Have also surreptitiously released propaganda pieces to American media. Have also paid columnists to advance their agenda.
...
When caught and called on
it, the "President" quickly reversed the practice, -- supposedly.
Certainly,
still doing it overseas,
however. Deliberate, contrived, concerted effort to interfere
with
a supposedly free media. The cornerstone of
democracy. "Ain't'
hypocrisy grand?
Regardless of what ultimately happens in Iraq, the "President" has no chance of winning the war on terror under current "Administration" policy. To win, the United States must immediately implement three policy changes.
First, we must adopt an even-handed approach in the Middle East vis a vis Israel and Palestine. To date, the United States has been grossly one-sided, pro-Israel no matter what. No matter how abusive to Palestinians. Precisely, why modern terrorism got its start.
Second, American forces must be quickly removed from all Muslim territory with exception of Afghanistan and the hunt for bin Laden. Ironically, bin Laden himself stated one of the most important reasons for his declaration of war on America was the presence of American troops in Saudi Arabia before and during Gulf War I. -- The country of Mecca, the heart of Islam. Considered by devout Moslems to be a sacrilege.
Third,
we must quickly become
energy independent and immediately halt import of Arab oil.
--
Money historically used by
the House of Saud to repress other Arabs and impose its will.
Why
are we still energy dependent on these insatiably greedy thugs?
Why do we continue to bow to domestic energy companies mercilessly looting us for decades? -- Corporations that have done all they could to discourage alternative energy and renewable energy sources to continue the looting. When will we finally wake up?
When will a courageous President of either party finally rise to the occasion and announce a "Manhattan-style" project, designed to implement energy independence within a five to ten year period?
Should the United States immediately change all three policies as stated above, the air would be quickly removed from al Qaeda's sails. Support by moderate Moslems would ultimately force change. -- The only way the war on terror can be won.
It
must come from the moderate
Islamic community itself, -- the majority of Moslems, not the
relatively
small lunatic fringe represented by bin Laden and Zarqawi. No
question,
however, die-hard Islamists would still have to be hunted, captured, or
killed one by one. The overall situation, though, would
quickly improve.
... Can't have that, can we? Wouldn't fit in with the fascist
agenda
of the Bush "Administration."
Reminiscent
of Nazi Germany and
the former Soviet Union, Miami police have announced they will
routinely
conduct "Shock and Awe" assaults of banks and other public
facilities.
This entails quickly surrounding a building, "detaining," and demanding
all citizens entering, leaving, or in the vicinity to produce
identification.
Papieren,
bitte! -- "Papers, please!" In
Nazi America.
Where the Fourth Amendment and probable cause no longer have any
meaning.
Storm troopers in the Miami Police Department claim they will conduct
these
assaults in the name of "national security" since Miami has supposedly
received credible terrorist threats.
The "President" is apparently preparing plans to withdraw troops from Iraq over the next year despite strong and continued claims to the contrary. Must be particularly galling to Mr. Bush, however, to have to bow to political reality since he apparently believes he has a "divine mission" in Iraq.
Military commanders privately say the war is going badly. Publicly, though, they are forced to tow the "Administration" line. Cowardly, "won't speak truth to power." Too afraid of losing their careers. Conveniently, the "President" only hears what he wants to hear.
Political reality eventually sets in, however, as poll numbers continue to drop and Republicans grow increasingly wary of pending domestic midterm elections. Consequently, the "President" will likely slowly remove a token number of troops from Iraq, and step up bombing of insurgents from the air in the coming year. ... Disingenuously and falsely claiming "victory" before the elections next November.
The "President" is facing increasing pressure to remove troops from a public that is clearly tired of the war and wary of his truthfulness. The situation in Iraq has deteriorated, particularly over the last twelve months. So much so, former Iraq Interim Prime Minister Ayad Allawi recently claimed current human rights abuses are worse than during the regime of the brutal former dictator.
The "Administration" conveniently dismissed Allawi's comment to political considerations generated by the coming Iraqi election in December. Iraqis, however, continue to be tortured, abused, and killed by their own. American troops recently liberated Iraqi prisoners tortured, starved, and beaten by Iraqi security forces.
... To say nothing of American abuses at Abu Ghraib and elsewhere in country. Clearly and sadly on the whole, there is far more killing and abuses than during the Saddam regime. Yet, the "Administration" continues to lie to the American people regarding reasons, progress, and prognosis of the war effort.
Wasn't
supposed to be that way,
was it, Mr. "President?" What happened to the flowers and
chocolates
American "liberators," not occupiers, were supposed
to receive
from eternally grateful Iraqis? Instead, Improvised Explosive
Devices
and deadly sniper fire have sadly become the order of the day.
California Republican Cong. Randy Duke Cunningham pled guilty to charges of bribery and resigned his House seat. Mr. Cunningham is a Vietnam-era Navy pilot who repeatedly bragged he was the inspiration for the 1986 Tom Cruise movie Top Gun.
Seems flying wasn't the only thing the former Congressman was good at, however. He admitted to taking approximately $2.5 million in bribes from defense contractors. ... For steering lucrative Pentagon projects to these insatiably greedy corporations.
Stick
up a convenience store and
you rightfully get 99 years in prison. Take $2.5 million in
bribes
as a Congressman, which amounts to stealing
billions from the taxpayers
in unwise unsubstantiated contracts, and the most is ten
years. ...
Anything wrong with this picture?
A
basketball-sized piece of marble
fell off the U.S. Supreme Court building earlier today.
Ironically,
below the "Equal
Justice Under Law" inscription. Chilling, isn't it?
Certainly,
eerie.
Especially, since at no point in history has "justice" been so badly and deliberately denied to the "have-nots" of our formerly great country. For a number of reasons, including tort reform and outrageously restrictive unconstitutional legislation.
... Implemented of course, courtesy of a corrupt and abusive fascist judiciary, where "justice" is demonstrably "sold" to the highest bidder. BS? Think again.
The one with the greatest assets usually prevails. -- Either the prosecution backed by unlimited financial resources of taxpayers, or the rich who have personal assets capable of buying the results they want either in criminal or civil court.
No matter the truth. Right or wrong, simply no longer matters. Money talks.
Laughably,
the crumbled chunk
of marble contained the word "authority." -- A portend of
things
to come? ... Even the mighty, supposedly eternal, supposedly
invincible
Roman Empire fell. Of its own weight and excesses.
The military is lobbying Congress to expand its domestic spying operations. It wants FBI and CIA to share their databases on American citizens. Remember "Total Information Awareness?" Military domestic dossier creation of American citizens on a national level that rightfully generated tremendous opposition months ago?
Sadly, this would dwarf the earlier program. What makes military domestic spying particularly pernicious and outrageously reprehensible is the fact the military has absolutely no constraints or prohibitions against abrogation of civil liberties and constitutional rights. ... Since it previously operated solely overseas.
Indeed,
domestic military abuses
earlier instigated passage of Posse Comitatus laws well over a hundred
years ago. For damn good reason.
Now, however, we've
got a fascist "Commander In Chief" determined to use military personnel
and assets against American citizens.
No question, American authorities are directing the Saddam trial. When the former dictator complained to the presiding "judge" he had no pen and paper required for his defense, the "judge" lamely asked an American advisor for guidance. Fascinating, isn't it?
Not missing a beat, the Butcher of Baghdad quickly lambasted the "judge," advising him Iraqis are sovereign and Americans are occupiers. -- That he, (the "judge"), shouldn't be lamely taking advice from an American.
For
weeks after the assassination
of two defense attorneys and the wounding of a third who subsequently
fled
the country, the former dictator has been without adequate counsel,
--
forcing the trial to be delayed
yet another week.
... But not before the "judge" read pre-recorded testimony before the defendant and showed a videotape of a deceased "witness." Clearly, this trial to date has been no more than kangaroo justice orchestrated by the American government. The "judge" is no more than a stooge for the "President" of the United States.
While no tears will be shed for Saddam should he be convicted and condemned to death, the charade in Baghdad will be viewed by the world community as American kangaroo justice at its worst, -- orchestrated by the Bush "Administration." ... Another black eye, courtesy of the fascist currently occupying the Oval Office.
Listen up, ladies. The Indiana Supreme Court thinks women are hopelessly stupid, ill-informed. Last week, the Neanderthals on this high court, blood seeping from knuckles dragged behind them as they walked, ruled women must be "counseled" and wait 18 hours for an abortion.
Appalled?
Why?
After all the bastards are only looking out for the "lil' ladies,"
aren't
they?
...
Or do they have a far more
pernicious intention? -- Like "legislating" their perverse
religious
views, beliefs, and ideology from the bench? In
Nazi America.
