Judicial Nominees

The "President" is increasingly chagrined right-wing extremists nominated to the judiciary are ferociously stonewalled by the Senate.  Tough, isn't it?  The "Chief Executive" is so annoyed he proposed October 30 changes in the confirmation process, designed to supposedly expedite the process.  -- A mandated vote of the full Senate within 180 days of nomination.

Mr. Bush bitterly decried the "poisoned and polarized atmosphere" declaring:  "Today our federal courts are in crisis. The judicial confirmation process does not work as it should.  Nominees are too often mistreated, votes are delayed, hearings are denied and dozens of federal judgeships sit empty."

… Hey, George?  They remain empty precisely for one reason, and one reason only, -- the bona fide extremists you continue to nominate.   With a court system already right-wing and glaringly fascist, a move further to the right and Nazism is unacceptable. Senate Judiciary Committee Chairman Patrick Leahy hit the nail on the head in a recent letter to the "President":  "If you would work with us and nominate less divisive, less controversial nominees, that would contribute greatly to the process and our mutual success."

Mr. Bush and his Republican cronies, however, remain adamantly determined to stack the courts with extremist ideologues who will legislate the "President's" perverse and immoral "religious" beliefs from the bench.  … Beliefs that will eviscerate a woman's right to do with her uterus as she damn well pleases.  Re-introduce school prayer in direct violation of the First Amendment.  Ratify the glaringly unconstitutional "Patriot" Act, cleverly designed to destroy liberty and rights through shameless evisceration of the Fourth, Fifth, Sixth, and Eighth Amendments.  Destroy First Amendment mandated church-state separation via school vouchers and "charitable" aid in an effort to establish a "Christian" theocracy.

The list can go on.  All these issues, however, have been repeatedly addressed on this website and elsewhere.  -- And will continue to be.  The "President" obviously does not want full vetting of his nominees.  Only quick cursory review and confirmation.  A shameless rubberstamp for his fascist agenda.  Hopefully, Democrats will continue to stonewall.  The "President" knows full well the battle to impose fascism and a "Christian" theocracy lives or dies in the judiciary.  Precisely, why the appointed "Chief Executive" remains resolute to seat Nazi judges on the bench.

The fact the proposed change in Senate rules came a week before the election demonstrates the profound politicization of the judicial process.  … Despite false phony assurances to the contrary by "Presidential" spokesman Ari Fleischer: "The fact this was announced this week underscores the nonpolitical nature of it."  ... Is that right?

... And manure smells sweet, right, Mr. Fleischer?  To the extremist ideologue, day is night, night is day, and "sh-t 'don't' stink."  GOP partisans hypocritically forget Republicans similarly stonewalled Clinton judicial nominees.  … Nominees, surprisingly well-right of center.  -- Still not unacceptably fascist enough for the Republican Party, apparently.



First Amendment Re-Affirmed

A 9th U.S. Circuit Court of Appeals three-judge panel unanimously ruled the "Justice" Department cannot revoke physicians' prescription licenses for recommending marijuana to ill patients.  Courageously, Chief Circuit Judge Mary Schroeder declared: "An integral component of the practice of medicine is the communication between doctor and a patient. Physicians must be able to speak frankly and openly to patients."

The ruling upheld a two-year ban on government goons stripping doctors of licenses to prescribe medications for simply discussing medical marijuana with patients.  Not surprisingly, fascists in the Department of "Justice" are not happy campers.  Particularly, with eight states having passed medical marijuana laws.  … Disingenuously, ludicrously assert these statutes "will make it easier to obtain marijuana in violation of federal law", according to attorney Michael Stern.

… Hey, Mikey?  Pot, along with every other chemical substance, is cheap and plentiful on the streets.  Despite, an insane thirty-year war on drugs, -- that has done no more than corrupt law enforcement across the nation.  Wake up.  Most glaring local example?  The 33rd Judicial District Narcotics Enforcement Team (NET).

Nazi government falsely claims marijuana has no medicinal value.  Not true, according to the medical community.  Has been used in treatment of glaucoma, nausea, multiple sclerosis, pain, etc..  For the government to claim otherwise, betrays its two-pronged agenda.  First, consolidation of federal power by this "Administration" and earlier ones to establish a fascist police-state.  Second, and of equal importance, protection of the enormous cash cow maintained and reinforced by continuation of drug prohibition.

Interestingly, Republicans supposedly champion states' rights and reduction of federal power.  Yet, the current "Administration" continues to strengthen federal jurisdiction over that of the states.  Not only in regard to drug policy, but across the board.  Most recent glaring example?  "Justice" Department oversight and intentions to prosecute the snipers.  Why?  What business is it of the Bush "Administration?  Why aren't they backing off and allowing the states involved to bring both men to justice?



Pot Decriminalization

To the profound chagrin of Bush "Administration" officials, Canada is considering decriminalization of pot.  Office of National Drug Policy Director John Walters strongly declared: "The drug problem will increase in Canada.  It is the single biggest drug of addiction that we have to provide treatment resources for.  It's 60 percent of the problem. It's twice as important as cocaine. Americans don't appreciate this enough and I fear Canadians don't either."

Sadly, Mr. Walters is a liar.  At the very least, severely and self-servingly distorted reality.  Precisely, why our young people foolishly ignore true dire warnings about immensely harmful drugs such as heroin, cocaine, methamphetamine, Ecstasy, and many other poisonous substances.  Wake up, Mr. Walters.  No one is listening.  When you refuse to tell the truth regarding marijuana, you cannot expect our young people to believe anything else you say.

There is no evidence pot is physically addictive.  Absolutely none.   It is false propaganda put out for years by corrupt and abusive government.  In an effort to deliberately maintain drug prohibition for one reason and one reason only, -- illicit money to be made by corrupt and abusive government organizations such as the 33rd Judicial District Narcotics Enforcement Team (NET).

Should Canada decriminalize marijuana, American government goons are promising retaliation.  Imposition of tougher border controls, slowing trade.  Fascinating, isn't it?  Especially, coming from an "Administration" in bed with Corporate America, -- that thinks it can do no wrong.  Coupled with an earlier decision to reportedly fingerprint Canadian visitors to this country, relations with our neighbors to the north are apparently beginning to deteriorate.  Canada already warned its citizens not to visit because of increasingly repressive border controls, such as the fingerprinting issue.  All, courtesy of a Nazi Bush "Administration."

... As the Founders knew well and fully understood, anyone willing to trade liberty for "security" deserves and winds up with neither.  The fascist occupying the White House is taking full advantage of the glaring cowardice of the American people.  You get what you deserve.  Too bad, the rest of us have to suffer for it.  Sieg Heil.



Secret Evidence

Fascist government attorneys continue to defend use of secret evidence against Global Relief Foundation.  Douglas N. Letter, Aryan arrogantly declared, although ordinarily "something to be avoided…the ongoing efforts to identify foreign terrorists and their supporters depends in part on the use of intelligence that, if disclosed, could cause grave damage to the national security of the United States."   If so, Counselor, prosecution and/or seizure should not occur until government has completely investigated its case and is ready for court.

Readers are reminded the Foundation had, and continues to have, its assets frozen by government goons with NO due process.  None.  In direct violation of the United States Constitution.  Government thugs will not share with defense attorneys its supposed "evidence" for such drastic action.  … What we have here is no less than glaring establishment of a fascist police-state, -- with no constitutionally guarantied rights to defend oneself against any and all charges.

Funds have been frozen for one reason and one reason only, -- to deliberately prevent Global Relief access to monies badly-needed to defend itself against Nazi government.  The Fifth Amendment clearly prohibits asset seizure prior to court action:

We have no formal declaration of war by Congress.  None.  In addition, no one from Global Relief was captured by the American military.  No one.  Therefore, by what constitutional authority does the appointed "President" freeze assets, -- other than an unconstitutional federal statute supposedly allowing him to do so?  In direct violation of the United States Constitution, the highest law of the land?  Where are our courts?  The "President" is not only targeting foreigners, but American citizens as well.  Can falsely label anyone he pleases an "enemy combatant", incarcerate them indefinitely with no access to an attorney or the courts, freeze funds.  On his authority alone.  Supposedly, with no right of review by the courts, -- according to the Nazi appointed to the Oval Office.  Wake up.

Moussaoui Update

Readers will recall Zacarias Moussaoui and his court-appointed attorneys are fighting for access to captured terrorist kingpin Ramzi bin al-Shibh and others.  Moussaoui is constitutionally mandated access to any and all witnesses on his behalf.  Government thugs continue to deny this man his rights.  Have finally provided a copy of bin al-Shibh's broadcast Al Jazeera interview, however.  The tape purportedly makes no mention of Moussaoui.  More interestingly, bin al-Shibh reportedly admits to being the 20th 9/11 hijacker.  … Precisely, what the United States government and prosecutors accuse Moussaoui of.  Fascinating, isn't it?

Moussaoui and others detained continue to be outrageously denied Sixth Amendment rights, -- to confront any witnesses against them, as well as obtain witnesses on their behalf.  An absolutely critical right.  The linchpin of liberty.  … What has formerly distinguished this once great nation from Nazi Germany and the Soviet Union.  Due process.  Apparently, no more.  Since government prosecutorial thugs continue to deny access to witnesses and all evidence against him, why haven't all charges been dropped?  Why does the "judge" refuse to do her job?  What she has sworn by oath to do?  Should this outrageous fiasco be allowed to stand, who's next?  All of us are at risk of being falsely accused, -- denied the right to legally fight, a right guarantied by the United States Constitution.


Denial Of Due Process

The Bush "Administration" continues to deny constitutional rights to American citizens Jose Padilla and Yasser Esam Hamdi "detained" in jail, -- without benefit of counsel and access to the courts.  In direct violation of the United States Constitution.  The "Administration" continues to assert in court American citizens, and others detained, have no right to judicial review.  None.  Callously, refuses to share "classified" evidence with defense attorneys.  The disgraced "President" has treasonously betrayed his oath of office, should be impeached, convicted, and removed from power.



Wellstone "Rally"

Republicans are exceptionally unhappy with the memorial service for the late Senator Paul Wellstone.  Are disturbed the service reportedly turned into a political rally.  Tough, isn't it?  Certainly, don't want the Democrats to gain any momentum in the struggle to hold the Senate.  … Conveniently, have hypocritically forgotten the "President" has shamelessly beaten war drums for an unprovoked attack on Iraq, -- at every goddamned political rally he's attended.   Cost of attending, gallingly paid for by taxpayer funds.  … The kettle outrageously calling the pot black.



Airport Screeners

The airport screener problem apparently has not improved.  Women have repeatedly been fondled.  People, outrageously hassled and harassed, -- in the name of "security."  … While vendors and others enjoy practically unrestricted access to supposedly "secure" areas.

Couple screener ineptness and abuse of power with a nut-case, -- and one gets a glimpse into how truly dysfunctional the system has become.  French national Eliane Yvonne Marcele Aguillaume, 56, of Paris, was arrested for felony disorderly conduct at an Indiana airport, resisting arrest, and public indecency.  … What in hell could an older woman do to warrant such charges?  Simple.

Seems Ms. Aguillaume was apparently not pleased with treatment at the hands of airport screeners who continued to wave a metal-detecting wand over her body for quite some time.  What did she do in response?  Stripped nude to the waist, taking off her sweater, blouse, and bra.  When a goon attempted to cuff her, she fell to the floor, and refused to get up when ordered.  Brutally sad, isn't it?  While obviously a nut-case, apparently, had more than enough harassment by government goons during check-in to drive her over the edge.  Compounding the problem was the language barrier.

Readers are also reminded Europeans have a far more liberal view of public nudity.  … Unlike stodgy Americans, who walk around with a stick up their ass in regard to such matters.  ... Piously for good measure, however, give thanks each Sunday in church for their looted good fortune, -- while nailing every piece of tail available, ready, and willing.  Tough, isn't it?

Think authorities would have been glad to just quietly send her on her way, wisely asking her not to return to this country?  Do something reasonable and quickly resolve the problem after the incident?  Hell, no.  What for?  Been released on $5,300 bond from jail.  -- For baring her breasts and throwing a tantrum against goddamned abusive "security" personnel.  Imagine that.  Who'd a 'thunk' it?

Deputy Prosecutor Dawnya Taylor is seriously considering prosecuting her on a felony disorderly conduct charge.  Interesting, isn't it?  Why waste taxpayer money pursuing a foreign nut-case, Counselor?  What good will it do making an example of her?  Think punishment deters the irrational from acting irrationally?  If so, need some professional care yourself.

… Should also consider the same for a "President" insanely willing to spill the blood of innocent Iraqi civilians and American military personnel.  How could anyone supposedly in his right mind seriously consider launching an unprovoked attack?  Simple.  Political expediency, a golden opportunity to get his cookies off, as well as avenge Daddy's abysmal failure twelve years ago.

Subsequent to writing the above, government officials finally came to their senses and allowed the woman to plead guilty to resisting arrest and public indecency.  Imagine that.  The felony disorderly conduct was never filed.  Fascinating, isn't it?  Kicker?  The woman was fined one dollar on both misdemeanor charges and ordered to pay some $130 in court costs.

... Too bad she didn't make things a bit more interesting, no?  ... Could have refused to plea bargain, -- forced the government to prosecute.  ... Imagine the courtroom circus?  ... Some high profile straight-faced attorney repeatedly instructing the jury:  "If the bra does not fit, you must acquit..."  Hell, would have been the best courtroom drama since O.J..



Bush Interference With Scientific Process

In a determined effort to revoke a woman's right to do as she damn well pleases with her uterus, the "President" ordered embryos be considered 'human subjects' for research purposes.  … Along, with fetuses.  Why?  Mr. Bush intends to see Roe v. Wade overturned.  All these supposedly insignificant changes in policy have been deliberately and cleverly designed to callously eviscerate liberty and reproductive rights.  The "President", as his equally fascist cronies, apparently wants women barefoot, pregnant, ignorant, and in their 'proper' place, -- the home.  Despite a few token women in high "Administration" positions, -- for the sake of political expediency and correctness.


Employers vs. Employees

In  follow-up to remarks in last week's edition of this publication, seems a study conducted by CCH, a human-resource and employment-law information firm, reinforces exponentially increasing employee dissatisfaction.  Layoffs result in fewer people doing far more work.  Wages remain stagnant, however, and employers continue to reduce employee vacation and sick time.  ... In a desperate effort to increase the bottom line and maintain executive compensation at record levels.

Employees are getting even.  To the chagrin of management.  Increasingly taking time off, regardless of whether or not they're sick.  Tough, isn't it?  Management is furious, claiming to being outrageously ripped off.  How so?  Such employees seek and get no more than what they've already earned, -- and are not being paid.  Why shouldn't they "take" what's already theirs?  As management gleefully laughs its financially portly ass off all the way to the bank, -- after properly giving thanks to God every Sunday in church.  ... And continues to enjoy record-high compensation packages, despite a foundering economy.  American, as mom and apple pie.



Israeli Coalition Government Collapses

Over a Jewish settlement funding dispute on occupied Palestinian territory, the Sharon coalition collapsed October 30.  Apparently, the Israeli Prime Minister and his cronies are determined to continue occupation and pursue eventual annexation of Palestinian land.  Still unclear whether this barbaric war criminal will have to dissolve Parliament and call for elections.

Sharon is courting the extreme right in Israel, seeking to make them part of his regime.  Certainly, complicates matters for the Bush "Administration", since the Israeli radical right insists on annexation of Palestinian land.  Should that occur, would exponentially increase the difficulty of obtaining Arab acquiescence and support for the "President's" planned unprovoked attack on Iraq.



Possible Chemical Weapons Violations

The "President" of the United States has cowardly remained silent after Russian use of an until recently unidentified chemical agent employed during the raid at the Moscow theater recently. Why?  A chemical that may indeed have violated chemical weapons agreements.  Russian officials did not prepare for the aftermath of the attack.  No antidotes, supplied ahead of time.  Even refused to tell doctors what the gas was, -- preventing medical personnel from adequately treating victims.  Yet, Ole' George "The Tush" Bush maintains his cowardly silence.  -- Without question or reservation, refuses to condemn Russian ineptness and recklessness during the botched raid.  Why?  Simple.  Ole' George "The Tush" desperately needs Russian support for his planned atrocity, -- an unprovoked attack against Iraq.



Barefoot And Pregnant

Despite a few token women in high "Administration" positions, the "President" has an exceptionally chauvinistic view of the opposite sex.  Not only does he purport to tell a woman what she can and cannot do with her uterus, apparently he prefers them home, taking care of domestic duties.  -- To the chagrin of the First Lady.

Mrs. Bush was obviously not pleased when dear Ole' George praised her before a group of supporters, claiming she was home taking care of housework, -- ahead of a planned visit by the president of China: "It's been raining, so she needs to sweep the porch."  … Is that right, Mr. "President?"  … Lil' lady takes care of things, does she, sir? Isn't that special?

Awaiting the Chinese leader with her husband on that very same porch, the First Lady was amusingly asked if she appreciated her husband's earlier comment.  While the "President" smiled and nodded, Mrs. Bush shook her head and mouthed "No."  … Who'd a' 'thunk' it?  Couldn't be, could it?

Had it come from Clinton, would have been outrageously funny, -- considering the former President indeed had great respect for his wife's intellectual abilities and prowess.  Coming from Bush, however, it backfired.  Especially, since all earlier comments, although loving, were highly patronizing.  Readers are reminded Mrs. Bush is well-educated, a truly gifted woman.

Interestingly, the current First Lady has a history of taking no crap from her husband.  Although offering no stiff resistance, has publicly come out against his stand against Roe v. Wade when asked shortly after Ole' George was appointed "President."

The comment regarding her domestic chores so enthused his Southern Republican audience, however,  he repeated it at two later speeches.  … Clearly, demonstrates the "President's" exceptionally narrow view of women and their "place" in society.  Hypocritically, has wisely included a few in the top echelons of power, though, to secure the female vote.  -- Eminently practical and expedient, no?

Had the comment not been made in a vacuum, it would have gone unnoticed.  Considering the group, however, and previous condescending public remarks about his wife, it clearly did not endear him to the First Lady.  Tough, isn't it?  … Think he would have finally wised up, no?

The "President" conveniently and cleverly blamed the press for his wife's irritation and subsequent problems at home, -- for amusingly widely publicizing the remark.  … Certainly, would not have wanted to be in his shoes, however, the moment she had an opportunity to privately tell him what she thought.  Reportedly, has the finely-honed knack of verbally whacking him upside the head every time he desperately needs it.  … Hell hath no fury.  -- After all these years, think he finally would have learned.  Right?  Nah.  ... No way in hell.  ... Too aggressively stupid.

Big 'Morning-After' Contributions Evade Detection Before Elections
 
 
 

· In Last Days of Primary, Texas Donors Moved $1.7 Million.
 

Austin, TX: Texas voters stood little chance of being informed about
the

sources of $1.7 million raised in the last nine days of the March 2002

primaries, including $343,328 that was reported after the election was

over, a new study found.
 

Texans for Public Justice released The Morning After: Last-Minute

Contributions in Texas' 2002 Primary Elections today, as special
interests

again are eluding public scrutiny by contributing in the last days of
the

general election campaign.
 

"Texas politics became more dangerous than unprotected sex in February

1997," said Texans for Public Justice Director Craig McDonald. "That's
when

the FDA approved the morning-after pill to let a woman who has had
unsafe

sex prevent pregnancy. There is no such remedy for Texas voters, who do
not

learn about massive influxes of campaign money until after the affected

election is over."
 

The last regular campaign disclosure filed by Texas candidates in
contested

races covers contributions made up until 10 days before an election.
During

the last nine days of a campaign, contested candidates file
little-noticed

"telegram reports" to disclose large contributions. Because these
reports

must be filed within 48 hours, donations made in the last two days of a

campaign often are reported after the election is over.
 

Because last-minute contributions favor candidates in tight races, this

money can determine electoral outcomes. The No. 1 recipient of

eleventh-hour money in the 2002 primary was Senator Jeff Wentworth, who
won

a primary marred by voting irregularities by just 1,216 votes.
Wentworth

and his opponent received large last-minute contributions from

controversial donors who only donated in the last days of the campaign.
 

The Morning After analyzes 102 Texas candidates who faced contested

primaries for statewide and district-based offices in March 2002 and

electronically reported raising $1.7 million in the last nine days
before

that election (9 percent of their primary total), including $343,328 in
the

last 48 hours of the campaign. The report also tracks $501,495 in

last-minute money raised by 22 of these candidates who had runoff
elections.
 

Morning After highlights include:

· Four senate candidates were the top money raisers in the primary's
last

nine days, led by Wentworth, Bill Ratliff, Kim Brimer and Juan Hinojosa

(Mary Denny was the House's top recipient);

· Next came Supreme Court candidates Elizabeth Ray, Xavier Rodriguez
and

Wallace Jefferson;

· The No. 1 late-money donor was trial lawyer Mikal Watts, who gave
$60,000

in late money to his mom, district judge candidate Sandra Watts;

· The Republican National State Elections Committee was the No. 2 late

donor, giving $50,000 to boost the primary campaigns of minority High
Court

Justices Jefferson and Rodriguez;

· The Tigua Indian Reservation, which has had casino battles with the

state, was the No. 3 late donor, giving to Wentworth and Hinojosa.

To recognize and honor those courageous men and women who have served and are now serving in the armed services of the United States of America, Kingsland Memorial Post #437, The American Legion, will hold a Veterans Day program at its Post Home Monday, November 11, at 11:00 a.m. To get to the Post from Kingsland, take Farm Road 2545 at highway 1431 (the Conoco Station across from Ace Hardware) and go east about two miles to Legion Loop.

Similar Post programs have been very well attended in the past, so you are advised to get there early. All are invited and encouraged to attend – particularly those with children of school age. As in the past, an outstanding speaker is planned for the event and several local dignitaries are expected to be on hand to commemorate the occasion. Refreshments will be provided courtesy of the Auxiliary Unit.



Harvey Klee

Mr. Klee recently informed this writer he's once again considering running for the Llano Independent School District Board.  Rightfully and tirelessly, has been highly critical of waste and corruption in the District for many years.  While willing to do whatever is necessary regarding public appearances, writing of campaign literature, etc., he desperately needs financial backing and assistance with the "grunt" work.

Tasks, such as placement of signs, distribution of fliers, and similar legwork.  Readers are reminded the Board is not paid.  Pointedly, only get what they can steal or receive in bribes.  -- While slapping the Good Ole'Boy occupying the Superintendent's office hard on the back, sharing in the wealth.  Looted taxpayer money.  Time for a breath of fresh air.  Klee could and would do some good, rattling a few cages in an effort to force badly-needed change.

LISD is suffering severe financial distress due to years of neglect, greed, theft, misuse of taxpayer money, etc..  From launch of this publication until recently, has always been aggressively targeted on this website.  No one would listen, however.  Sadly, the chickens are finally coming home to roost.  Tough, isn't it?

LISD Superintendent Jack Patton has a history of financial disaster and problems left behind in both Menard and Hereford.  They were glad to get rid of him, according to a former board member and newspaper editor from both communities contacted by this writer about a year and a half ago.  Has done no better here. This outrageous jackass has deliberately run the District into the ground.

If you support badly-needed change and a fresh point of view on the Board, why not contact Mr. Klee at hklee@tstar.net?  Should the Superintendent and current Board continue unchallenged, expect the tax burden to become far more severe.  Sadly, these white-collar thugs will never get enough, and will continue to mercilessly loot, picking your pockets clean, until you courageously take action and put an end to it.  … Should you insist on remaining deafeningly and cowardly silent, however, you get precisely what you richly deserve.

spoofing and illicit signing up of this publication
for unrequested "services" has not deterred you from
renewed spamming activity and additional squandering
of company time and good corporate image.

-- Stupidly, using the same spoofed Yahoo.Com server
IP address a second time to retaliate against ongoing
posting of extremely unflattering material on The
Ledger website, regarding outrageously poor Dell
support.  Tough, isn't it?

Couldn't at least use a different spoofed IP address
to make things a little less boring?  ... Be a bit

Thought others at Dell needed to be aware of what is

Dear Mr. DeRosier:

The following ignored snail-mailed letter to Mr. Dell
has been published in the last two editions of The
Llano Ledger.  Readers are entitled to know precisely
how Mr. Notebook and Dell Computer do business.
Indeed, a public service.  Will continue to be posted
weekly for months.  -- Until I get tired of it.

At that time, a new webpage on The Ledger website will
be created.  All correspondence between Mr. Notebook
as well as Dell "Support" and this writer will be
posted.  -- Again, the readership has the right to know
exactly how both companies operate.  … Particularly,
how poor "support" is at both firms.

Should your attorneys decide to sue, by all means do
so.  With an exceptionally corrupt and abusive court
system, Dell indeed would likely prevail.  Regardless
of the truth.  After all, your multi-billion dollar
corporation can easily financially impose its will.
Would be an empty victory for several reasons,
however.

First, would fully publicly demonstrate precisely how
abusive and repressive a powerful corporate entity can
be, -- ultimately costing market share.  After all,
why buy Dell when you can purchase HP, -- a company
far more attentive to customer concerns and
complaints?

Second, would certainly publicly expose Dell "Support"
for being inept, unresponsive, and profoundly
obfuscating.  Sadly, -- the number one problem in the
view of product users.   … Again, costing market
share.

Third, a suit would bring this publication additional
recognition nationally.  With readership exponentially
expanding, can only further aid and assist, no?

Fourth, should Dell prevail, this publication has no
assets, -- other than the piece of trash this message
is typed on.  Remember?  The supposedly "factory
refurbished" Latitude Mr. Notebook fraudulently sold
as rebuilt?

Fifth, this writer has no assets. Certainly, "judgment
proof", so to speak.  The truth regarding this entire
fiasco would come out in court for all to see,
regardless of whether or not Dell uses its
considerable assets to buy a favorable, self-serving
outcome.

So, should your legal beagles choose to file suit,
bring it on.  … Hardball?  You bet.  Can only wonder
how many others have had to put up with this same
crap, or worse.  While they had no options, this
publication certainly does.  Can indeed expose it to
the light of day.

Bottom line, Mr. DeRosier, is the fact the office of
the CEO has not had the courtesy nor seen fit to
answer the enclosed letter, preferring to stonewall.
-- Or possibly never received the letter at all.

… Could have been conveniently intercepted by a crony
in the Dell mail department?  After all, you knew full
well it was coming.  Nothing less than a response from
the office of the CEO is acceptable.

If his office indeed received the correspondence, it
is glaringly indifferent to unresolved customer
complaints.  Has apparently refused to right the wrong
regardless of legal culpability or lack thereof.

Certainly, aggressively stupid since you've already
likely lost more in sales than it would have cost to
correct the problem.  Corporate image is priceless,
isn't it, or has Dell Computer indeed grown too fat
and complacent to care?  -- Or is this merely a matter
of one Dell employee desperately trying to cover his
ass and/or that of his department?

Letter To Dell CEO

Dear Mr. Dell:

A Dell factory refurbished Latitude was purchased from Mr. Notebook by [redacted] of [redacted] and donated to this non-profit publication about a year ago.  Despite a nearly $900 expenditure, this machine has been a piece of trash since purchase.  Support from Mr. Notebook was non-existent.  Sadly, Dell Support was not much better.

Clearly, after a year's worth of problems, factory "refurbished" does not mean factory "rebuilt".  Apparently, the hard disk, floppy, and CD drives were never replaced.  -- The most likely sources of product failure.  In addition, the supposedly replaced lithium-ion battery module has a design flaw.  Although the machine has always been run on AC power and the battery maintained at 100% charge, intelligence circuitry in the module failed, rendering the battery worthless.  -- Coincidentally occurred during the latest email foray with Dell Support regarding floppy disk failure.  … Aren't I lucky?  Incredibly blessed?

All that was requested from Dell Support this time around, however, was a pointer to diagnostics that would have pinpointed the problem with the floppy drive.  … Not absolutely sure yet whether the failure lies only in the drive itself, or may also involve the socket and possibly bugs in drivers common to both the floppy and CD ROM drives.  Sadly, the CD ROM has never worked flawlessly either and has had occasional problems of reliability.  … At least, it's still working, however.  Unlike the floppy.

While Dell Support indeed provided a pointer to diagnostics, the download ironically requires use of boot disk and floppy.  Indeed, a problem of not being able to get from here to there.  When pointed out to Support, received no further assistance, -- just an outrageous run around.  … Despite assurances on the Dell website such email support supposedly exists for life of the product.

Mr. Dell, I can certainly understand you cannot be aware of all problems within a large corporation.  You do, however, have unaddressed flaws with "refurbished" machines sold by disreputable vendors fraudulently and phonily invoking Dell corporate name, image, and prestige, and more importantly, horrendous problems with a totally unresponsive Dell Support division.  No question, it is doing damage to corporate public image and reputation.  Sadly, although your machines are extremely popular, the greatest problem I've heard from users is lack of support.  Can certainly attest to that from personal experience.

Support outrageously refused to provide an email address for your office, -- unlike HP and other corporations more responsive to unresolved customer problems and complaints.  … An email address would have certainly provided an easy practical way of sending the entire email exchange over the last year.  Would have sorely indicated glaring obfuscation, non-responsiveness, and interminable intentional delay.  Hard to believe you're unaware.  Than again, Dell Corporation could apparently care less.

Mr. Notebook sold the Latitude as a Dell factory refurbished machine, supposedly tested by Dell-trained technicians, clearly so indicated on the bottom of the computer.  Again, the floppy, CD, and hard drives apparently were never replaced.  The most likely components to fail.   Since factory refurbished clearly does not mean factory rebuilt, the computer is no more than a used machine.  … A machine that could have been bought for half the price at a resale shop.  Even less if purchased privately.  With the price of new notebooks precipitously dropping recently to the $900 range and technically capable of running circles around this dinosaur, assuredly have no intention of dumping additional money into this piece of trash.

Mr. Notebook, on the day of purchase, claimed this machine to be factory refurbished.  Repeatedly made the claim.  Clearly, it was not.  Mr. Notebook quickly washed its hands of this lemon, failing to answer follow-up correspondence from this publication regarding product failure shortly after purchase.  Have no intention of wasting additional time and effort haggling further with Mr. Notebook, -- other than to publish an investigative article exposing this entire fiasco.  After all, the public is entitled to know exactly how business was done.

Due to several serious problems never corrected by Dell or Mr. Notebook since purchase of this falsely alleged Dell factory refurbished product, however, can honestly say at this point I would never again purchase a Dell computer, -- new, used, or "factory refurbished".  From anyone.  Certainly would never encourage others to purchase Dell either.  Indeed, why take the risk and put up with the hassle?

Regardless of whether or not Dell Corporation is technically or legally responsible for fraudulent claims made by a vendor of Dell machines, the damage done to corporate image is indeed severe nonetheless.  The lack of competent support and assistance from Dell Corporation in the matter is stunning.  Certainly, costly in terms of good faith and product loyalty lost.  Regardless of legal responsibility.

Have enclosed the last few emails from Support upper management refusing to provide an email address for your office and highly indicative and glaringly demonstrative of ongoing obfuscation over the last year.  Little more than canned, computer-generated messages containing phony platitudes and false concern designed to obfuscate and stonewall rather than provide technical assistance or resolution.  Apparently, the problem is top-down, since tone and substance of upper management Support is no different than that of lower level techs.  Although unquestionably a public service, have held off publishing an investigative article until I hear from your office.

Unbridled Fear

As strongly asserted in the last 79 editions, gut-wrenching fear generated by the Narcotics Enforcement Team is quite impressive. After all, these Nazi stormtroopers not only outrageously intimidate defendants and their gutless attorneys, but even innocent third parties who have suffered at their corrupt and abusive hands.

Recently, a source came forward with allegations regarding the death of a loved one under exceptionally curious circumstances. Sadly, the survivor got cold feet.

Most pointedly and quite publicly, how in hell do you expect these abuses to end if you don't have the guts to stand up and expose them to the light of day?

Every time a source cowardly runs the other way, the corrupt and abusive sons of bitches win. Every g-ddamned time. Worse yet, another nail is driven into the coffin of liberty.

If you don't have the courage to stand up and do the right thing, why should this writer continue to place himself in physical and legal jeopardy trying to expose the outrageous corruption and abuse?
