Re: Financial Irregularities-JP2
August 24, 2001
Dear Mr. Nobles:
For nearly two and a half years, this publication has received
scores of complaints regarding financial irregularities within JP2.
Until several weeks ago, however, not one defendant had the courage to
publicly step forward with documentation and allow investigation, --
fearing retribution from corrupt and abusive law enforcement and their
shills in the judiciary. Finally, that has changed.
Patrick Lewis of 1609 Old Spanish Trail, Buchanan Dam, Tx. has
provided this publication with documents germane to Cause #23173,
Failure To Stop At Stop Sign Operation and Cause #23080, Speeding,
dated August 5, 1999 and August 12, 1999 respectively. Mr. Lewis
complained to your predecessor, Lanny Stephenson, of mistakes made on
the original ticket in the stop sign offense. First, the defendant
claimed the location of the alleged offense was incorrect.
The ticket, #6441, Lower Colorado River Authority, Austin, Tx.
indicated it occurred at the intersection of 1431 and 261. When Mr.
Lewis complained he was stopped at County Road 203A, former JP2 Lanny
Stephenson had a second ticket created, #6077 with the offense location
changed to "Stopped: 1431/261 @ Co. Rd 203." ... Notice, sir, the
second ticket did not state whether it was 203A or 203B? -- Apparently,
"Her Majesty" couldn't get it right even the second time.
Mr. Nobles, Co. Rd 203A is NOT at the intersection of 1431 and 261. Not
only that and at the very least, it is highly unethical for a
magistrate to have a second ticket issued to correct an earlier
mistake. Additionally, the second ticket indicates Mr. Lewis had no
Driver's License. The first ticket indicated that he did. Respectfully,
sir, which is it? Or couldn't Officers Sparks and Woods get their story
straight? More importantly, there is indeed an issue of whether or not
both LCRA officers even had jurisdiction.
In the second Cause related to the Speeding violation, Mr. Lewis
claims to have never received a ticket. Worse yet, the Cause appears to
have been tacked on subsequently to the first offense because the
defendant had the audacity to challenge "Her Majesty" regarding the
alleged stop sign offense. Access to the second ticket is respectfully
requested, Mr. Nobles. Does it exist?
The defendant paid the stop sign fine with two payments by check.
Interestingly, he was billed radically different itemized expenses for
each. Outrageously, he was also charged $25 interest on the second
payment. ... Is the "judiciary" in the loansharking business, sir? The
total cost for the alleged stop sign offense amounted to $274.25. Is it
your assertion this figure conforms to state schedule requirements?
The defendant claims to have not agreed to nor signed documents
requesting or accepting deferred adjudication of the charges. ...
Especially interesting in light of the fact his driver's license check
came back "no reported convictions or accidents with citations in last
three years." Access is respectfully requested to all germane documents
in possession of JP2 regarding Causes #23173 and #23080. Surely, Mr.
Nobles, it is in the best interests of your office to cooperate if
there is indeed no substance to the issues contained in this letter.
... Stonewalling, however, would only substantiate Mr. Lewis'
allegations and draw additional attention to glaring corruption and
abuse within JP2.
Sincerely,
Tim Chorney, Publisher

Subsequent to the above letter and during this past weekend, Mr. Lewis
provided this publication with three checks used to pay Ms. Stephenson,
former JP2. That's right, three checks. The third check was in the
amount of $5 and was payment for a jury trial Mr. Lewis never received.
It is his assertion the Llano County Attorney's office denied him the
right of trial by jury. Interesting, isn't it?
Anyone dealt with in a similar fashion by our four current justices of
the peace is encouraged to step forward. Unless the corruption and
abuse are exposed to the light of day, things will never change in this
hell-hole of a county. Corrupt and abusive officials indeed depend upon
the gutless fear of those abused to continue egregiously looting them
as well as the taxpayers. This publication since launch nearly two and
a half years ago has repeatedly called for an independent criminal
investigation of all County operations including the schools and the
hospital. Fear, however, rules Llano County.
Continuing the main thrust of this edition, readers are advised The
Ledger has long sought to do a series of articles coherently dedicated
to a comprehensive expose' of "justice" in Llano County, linking a
variety of concerted offenders at the heart of the corruption and
abuse. Recently a source came forward, perfectly suited and in a
position to provide an opportunity to do so. Over the next few weeks, a
considerable amount of time will be spent examining a variety of issues
linked by the determined effort of those in power to impose their will
and take care of their own.
Interestingly, this includes a sophisticated web of abuses perpetrated
by officials involving a bogus eviction, protective orders or more
precisely the lack thereof, a worthless and apparently corrupt County
Attorney, Narcotics Enforcement Team searches without benefit of search
warrants or even probable cause, a fugitive from justice recently
caught, firearms irregularities, and much, much more. -- All from the
perspective of a woman who has been egregiously left hung out to dry by
a corrupt and abusive legal system, an uncaring community, "friends",
and family.
The young woman's name is Carolyn Alsobrook. Her story is credible and
indeed backed up by documentation. Ms. Alsobrook is bright and gifted.
Articulate and a good writer, she will tell her poignant story in her
own words and provide readers with an explanation as to why she has
decided to come forward and place herself at personal risk. As always,
those targeted are invited to reply and will be given unlimited space
to respond to any and all charges.
*********************
Ms. Alsobrook's Statement:
I am coming forward for one reason and one reason only: to make sure no
other woman has to undergo the abuse I've undergone. I know this won't
change the damage done in my own personal life. I want victims of
abuse, however, to know there is no shame in speaking out. There is a
way out. There's always a way out.
For all you women or anyone who has ever lived in an abusive
situation, I am a victim too. I don't understand so many things in
life, but I have been questioned numerous times "Why do you stay?" It's
so heartbreaking a question to ask a victim of abuse because you only
want to see the good side of the one you love, trust, and hope would
change. You close your eyes to all physical, mental, and verbal abuse,
-- until you get so entrapped you believe there's no way out. The
abuser feeds off your weaknesses and insecurities to cover up their own
insecurities.
My abuser, Danny O'Leary, has been trying desperately to discredit me,
ruin me, and hurt me so deeply. This has been a seven-year, ongoing
saga of abuse from a man who's lived the majority of his life in crime,
deception, and denial. I've known the O'Leary family all my life and
loved them as much as my own, but I nor any family members personally
really knew Danny due to the fact he was never present and started his
life of crime at the age of 17 as a smuggler of marijuana and cocaine
with some of the largest Columbian cartels.
When I met Danny the summer of '94, I had recently been divorced from
my children's father, had just started dating, and heard from a sister
of mine the O'Leary brothers had a marina in Orlando, Florida. Danny,
himself, was going through a divorce and asked my sister if I would
date him. I also found out he had recently been released from federal
prison, having been incarcerated on drug smuggling and fugitive
charges. He was on parole, but I do believe in not holding one's past
mistakes against them and more importantly, I believed him to be like
other members of his family.
Until we moved to Kingsland, Tx. in February '95 did I really learn the
truth that he still was affected by his criminal past. This started the
saga of abuse and it was that summer of '95 that the first physical and
verbal assaults took place. One of my sons saved my life by physically
stopping Danny long enough for me to call 911. After being examined by
paramedics, my son was taken to Kerrville Juvenile Detention Center and
Danny and I were taken to the Llano County Jail. After being released
the following day and returning home(614 Link), I and my children were
kicked out of our home by Danny.
We moved into the cottage of my best friend, Joanne Myatt, in Sunrise
Beach. Only to find out later, Joanne was indeed employed as County
Attorney Cheryll Mabray's personal secretary. She was asked to take a
temporary leave of absence by the County Attorney, and that it would be
permanent if our friendship didn't end and if I wasn't directed to
leave her residence. Since I didn't want her to lose her job, I left
and gave in, being the victim I was, to Danny and moved back in with
him. Then, we hired attorney Eddie Shell to represent us, because of
charges pressed by the state for assault. These charges brought to my
attention recently are still pending, but interestingly only against
me. ... And I was the one who clearly received the most physical
injuries from the fight. -- From a man on parole and a career criminal.
Yet, I'm the one who still has charges pending, but Danny has been let
off the hook. Why?
How is it ethical for the same attorney, Eddie Shell, to represent both
of us? Remember? We were both combatants. As supposedly my attorney,
how come I've never been advised legally by Mr. Shell, yet Danny has?
Obviously, I had no legal counsel and thought all charges had been
dropped. Apparently, they had already been reduced from Class A to
Class C. How can these charges be still pending after six years?
Charges that the state is responsible for bringing, not me. What about
the statute of limitations?
Are my charges still pending because, as I've heard, nearly everyone
represented by Shell does personal work for him in payment for services
rendered, -- and I have nothing to offer Mr. Shell personally? ... Or
is it because I refuse to take blame for charges they brought against
me and will not give in to their schemes and deals, which brings us to
the present. As I stated, it has been an ongoing saga of abuse and
deception for the last seven years, making up and giving in to Danny,
only to be deceived and lied to numerous times, to be thrown out of our
home yearly or more frequently as it suited him.
I myself, my daughter and son, were just recently evicted this June
from 614 Link and all properties owned or leased by Danny O'Leary in
Kingsland, including Advanced Marina, our marina. -- Not actually just
kicked out, but formally evicted. How is an eviction take place with
someone you have a seven-year relationship with, and as the community
and all others have known as a married couple? Sounds like retaliation
to me. Is this how the legal system works? But to clear things up,
however, Danny and I never had a ceremonial marriage, but there was one
planned to take place, September 7, 2001.
Rather than rehash all past history, let me go to the most recent
incident of abuse. Even though Danny has been in the marina business
whether for smuggling or legitimate purposes for years, the lease of
Advanced Marina paved the way to another dark and illegal life.
Everything seemed to be going well until two summers ago. Danny started
his first incidents of not returning home. At first, I was greatly
concerned, thinking it was stress or health problems. I thought he was
being loyal and honest, and trusted him. Then, he started making
excuses of his whereabouts and becoming more aggressive, cruel, and
controlling. Consequently because of my suspicions and questioning of
him, my daughter and I were kicked out and moved to Llano, where all
was going well, so I thought. -- Just to be led astray and manipulated
to returning home to our house at 3264 Hermosa, Kingsland.
In the meantime, I finally found the reason for Danny's mental and
physical changes. Ironically, it was drugs. Due to this, not only was
it affecting me to the point where love was lost, but I knew ultimately
my future life with Danny would probably come to an end. I truly
believed he would never kick me out again as he promised, but he did.
Not only that, it had such a profound effect on his son and my
daughter, that his son ran away to Florida and my daughter and I moved
there as well. This story is far more complicated than just indicated,
and will be addressed in further detail in future editions.
Through correspondence, e-mails, and phone conversations, Danny begged
me to return to Kingsland, stating he finally honored his promises to
finalize his divorce, seek counseling and rehab. Two days before
Thanksgiving 2000 when I foolishly returned, he became more possessive,
extremely paranoid, and abusively controlling. In the past, I worked
independently. Now, he desperately needed me for employment at "our"
marina. My own friends, appalled at my return to Danny after providing
generous aid and assistance, no longer wanted social contact with me.
Also, as someone whose lifestyle included physical conditioning, I was
no longer allowed by Danny to go to the fitness center without his
accompaniment. ... Due to his irrational jealousy.
I, instead of seeing a future of peace, longevity, and happiness with
Danny, became deeply imprisoned, depressed, stressed out, and
physically ill. Due to my state of anger, heartache, and having nowhere
to turn, I did everything I could to keep the peace, including allowing
him to foolishly manipulate me to try the very drug he was using and
abusing, -- methamphetamine. I tried it and it almost killed me, due to
prior health problems. The reason why I stupidly gave in was I thought
it would indeed scare him to sobriety. Not so. What a FOOL! During this
time, I overheard Danny in conversations make comments of helping
someone supposedly evading the legal system.
... This person, a dear friend and victim himself, used to cover up
illegal actions of law enforcement authorities and the judiciary was
known to me only as "Little Dan". Danny O'Leary, known as "Big Dan",
really the wolf that he is in sheep's clothing, turned on his supposed
friend to have his own charges reduced and also to use "Little Dan" as
a scapegoat of the abusive actions that O'Leary directed towards me,
hoping it would end our friendship and hurt me deeply. I'll explain
more of this at a later time.
Readers should understand Danny strictly controlled my access to his
new-found friends and employees. I came to find out, however, my real
purpose to returning home was to cover Danny's ass. He had me and
another employee lie to customers for him. He had me lie to creditors,
friends, and family. He had become not only indebted in the business,
but had become indebted as well due to financial loans from friends.
His own health continued to deteriorate and his abilities of parenting
and social activity were seriously affected.
The day I finally stood up to him and told him no more, is when I
received my last physical assault. He wanted me at the marina and I
wouldn't go. This time instead of going to our home at 3264 Hermosa, I
went to 614 Link to rest and get some peace from Danny. Readers should
understand both of these addresses are different homes, but located on
eleven acres of property in Kingsland my Uncle Jack owned and recently
put in Danny's name, only for purposes to secure a loan. The marina is
located separately.
At approximately six that evening, Danny came to 614 Link in a rage,
but couldn't get in and went to 3264 Hermosa to call me and stated if I
didn't get over there all my daughter's belongings in her bedroom would
be destroyed and thrown out. Half asleep and scared, I jumped out of
bed and ran to 3264 Hermosa to confront him. We were alone. The
following is an excerpt of what happened as written in an affidavit to
the County Attorney in response to a request for a protective order
that was subsequently denied. Readers should clearly understand due to
my emotional state there are some misspellings, grammatical, and
punctuation errors: "... when I went to unlock the door he pushed it
open causing me to fall backwards off the steps (3 steps of unstable
granite) on to the ground, there was a shovel where I fell, I picked it
up for defense... " I broke the window, got in, was walking to my
daughter's bedroom when he came up from behind and began choking me. At
that time, I realized I had a cordless phone in my hand and also saw
the blood and granite gravel embedded in my palm and started hitting
him, knowing this time he was going to kill me.
Finally, I broke free from him, ran back to 614 Link, and didn't call
the police, but a friend in Austin. ... The last thing an abuse victim
wants to do is get the authorities involved, knowing the abuser will be
quickly released only to return and finish what they started. At the
same time, the abuser seeks vengeance and falsely tries to manipulate
you into thinking it will never happen again, but only to repeat the
same vicious circle. ... BUT NOT THIS TIME.
