Re: 17th Update To October 14, 2004 Correspondence

Dear Senator:

The following is additional correspondence germane to this writer's earlier letter of October 14, 2004.

For months, you and your office have conveniently ignored outrageous abuses perpetrated by "credit" reporting agencies as delineated in 16 earlier letters.

Conveniently for criminal "credit" reporting agencies, the Federal Trade Commission does not investigate individual criminal complaints against offenders of the "Fair" Credit Reporting Act. Once again, Senator, who in the federal government is responsible for investigating and prosecuting such criminal complaints against these agencies?

Experian has criminally re-posted the fraudulent Datasearch on behalf of Baptist Air Life listing earlier removed, and still has not accurately posted the re-submitted File Explanatory Statement as allowed by law.

Ludicrously, they have falsely claimed the re-posted fraudulent Datasearch on behalf of Baptist Air Life listing was never investigated. Absolute nonsense, as indicated by earlier removal of the fraudulent listing. It is time for a criminal investigation and prosecution. Yet, your office remains silent.

Transunion appears to have finally capitulated and has removed the fraudulent Alltel listing. Also, they indicate they have not re-posted the fraudulent Datasearch on behalf of Baptist Air Life listing as perpetrated by Experian. They have not, however, removed the fraudulent telephone number given them by Alltel still posted on the reports.

Furthermore, CSC Credit Services has yet to respond to all earlier correspondence. Apparently, the criminals at this abusive corporation are egregiously stonewalling the issue and have no intention of responding. Yet, your office remains silent.

Sadly, Senator, we live in a fascist police state. Aided and abetted by outrageously unconstitutional laws that egregiously violate privacy, civil liberties, and constitutional rights.

-- Statutes such as the USA "Patriot" Act, Homeland "Security" Act, and a number of equally unconstitutional Executive Orders.

… As Franklin wisely stated over two hundred years ago, anyone willing to trade liberty for security deserves and winds up with neither.

Sadly, Senator, you and your colleagues are part of the problem. To date, the issues, including earlier criminal alteration and fraudulent posting of the File Explanatory Statement, remain unresolved. Ignored.

Why hasn't your office pressured an outrageously unresponsive Federal Trade Commission to thoroughly investigate these matters?

Dear Sir or Madam:

As you state in your unsigned, untimely, computer generated form letter dated May 19, 2005, this writer is entitled by FCRA to "request a description of how we verified the information" regarding your fraudulent posting of the Datasearch listing.

Kindly, promptly provide this "description" in writing so it may be forwarded to the Federal Trade Commission, U.S. Attorney, and Texas Attorney General for review.

… In regard to pending criminal complaints to be filed against Experian, Datasearch, Baptist Air Life, Alexander Billing & Consulting, and other "credit" reporting agencies for knowingly and willingly posting fraudulently-obtained personal information.

Additionally, in the case of Experian, for twice fraudulently altering this writer's File Explanatory Statement, refusing to accurately post it for months, and making egregiously false statements in regard to Experian's supposed "investigation" of the fraudulent Datasearch listing.

This ongoing criminal activity by Experian employees was deliberate, intentional, knowing, not inadvertent, -- as demonstrated by months of correspondence.

Experian cannot claim ignorance regarding this criminal activity after all correspondence sent to date: October 16, 2004; October 25, 2004; November 2, 2004; November 7, 2004; November 9, 2004; November 21, 2004; December 17, 2004; January 28, 2005; February 8, 2005; March 9, 2005; March 23, 2005; April 4, 2005; May 10, 2005.

-- Again, some of these dates include letters sent to more than one Experian employee.

Amusingly, Experian still has not accurately posted the File Explanatory Statement. -- The "$" sign is missing in front of the "nearly $10,000 medically-required helicopter flight billing." … Are you that inept, or is it merely criminal harassment?

On another earlier unresolved issue, an additional criminal complaint will be filed against Experian for not honoring a written "opt-out" form earlier submitted to your corrupt and abusive corporation, permanently removing this writer from mailing lists. -- An abrogation, clearly implied on p.3 of your most recent report under "Requests for your credit history" and "Requests viewed only by you."

In addition, your failure to permanently extend the "Fraud Security Alert" will also be reported to state and federal authorities. This alert should have been indefinitely extended to protect this writer against fraudulent activity. -- As occurred not only in the case of Datasearch, but Alltel as well. Especially important, since this writer has never, and will never, seek "credit."

Interestingly, Experian also repeatedly made false statements in regard to the properly-deleted Alltel fraudulent listing and its supposed "investigation." -- An additional issue to be brought to the attention of state and federal authorities.
