Re: 16th Update To October 14, 2004 Correspondence

Dear Senator:

The following is additional correspondence germane to this writer's earlier letter of October 14.

For months, you and your office have conveniently ignored outrageous abuses perpetrated by "credit" reporting agencies as delineated in 15 earlier letters.

Conveniently for criminal "credit" reporting agencies, the Federal Trade Commission does not investigate individual criminal complaints against offenders of the "Fair" Credit Reporting Act. Once again, Senator, who in the federal government is responsible for investigating and prosecuting such criminal complaints against these agencies?

Experian has criminally re-posted the fraudulent Datasearch on behalf of Baptist Air Life listing earlier removed, and has refused to post the re-submitted File Explanatory Statement as allowed by law.

Ludicrously, they have falsely claimed the re-posted fraudulent Datasearch on behalf of Baptist Air Life was never investigated. Absolute nonsense, as indicated by earlier removal of the fraudulent listing. It is time for a criminal investigation and prosecution. Yet, your office remains silent.

Transunion appears to have finally capitulated and has removed the fraudulent Alltel listing. Also, they indicate they have not re-posted the fraudulent Datasearch on behalf of Baptist Air Life listing as perpetrated by Experian. They have not, however, removed the fraudulent telephone number given them by Alltel still posted on the reports.

Furthermore, CSC Credit Services has yet to respond to all earlier correspondence. Apparently, the criminals at this abusive corporation are egregiously stonewalling the issue and have no intention of responding. Yet, your office remains silent.

Sadly, Senator, we live in a fascist police state. Aided and abetted by outrageously unconstitutional laws that egregiously violate privacy, civil liberties, and constitutional rights.

-- Statutes such as the USA "Patriot" Act, Homeland "Security" Act, and a number of equally unconstitutional Executive Orders.

… As Franklin wisely stated over two hundred years ago, anyone willing to trade liberty for security deserves and winds up with neither.

Sadly, Senator, you and your colleagues are part of the problem. To date, the issues, including earlier criminal alteration and fraudulent posting of the File Explanatory Statement, remain unresolved. Ignored.

Why hasn't your office pressured an outrageously unresponsive Federal Trade Commission to thoroughly investigate these matters?

An additional criminal complaint will be filed against Experian for its failure to post the re-submitted File Explanatory Statement. Your statement "We are unable to process your request" is disingenuously specious and false.

All information requested by Experian in its latest correspondence of May 4 has already been repeatedly provided by this writer in months of earlier correspondence dated: October 16, 2004; October 25, 2004; November 2, 2004; November 7, 2004; November 9, 2004; November 21, 2004; December 17, 2004; January 28, 2005; February 8, 2005; March 9, 2005; March 23, 2005; April 4, 2005; April 26, 2005.

-- Some of these dates include letters sent to more than one Experian employee.

Your renewed request for the same information, already provided, using the same canned, computer-generated form-letter is no more than continued stonewalling, and denial of the right to post a File Explanatory Statement as allowed by the Fair Credit Reporting Act (FCRA.)

Amusingly, you state: "If the issue is not resolved, then the consumer credit reporting company must offer to include a consumer statement on the personal credit report." The issue has not been resolved. For months. Yet, you have repeatedly refused this writer the right to post a File Explanatory Statement as allowed by law.

Precisely, why the additional complaint will be filed against Experian, -- along with other earlier criminal complaints against Experian, Datasearch, Baptist Air Life, and Alexander Billing & Consulting, with federal and state authorities.

All four parties have knowingly, deliberately, falsely, and fraudulently posted and re-posted private information obtained under false pretenses when this burn survivor was in no condition to give informed consent.

Additionally, Experian employees criminally and fraudulently twice altered this writer's File Explanatory Statement. When challenged, Experian employees then criminally, deliberately, and falsely attributed the criminally altered File Explanatory Statement to a "Creditor."

This ongoing criminal activity by Experian employees was deliberate, intentional, knowing, not inadvertent, -- as demonstrated by months of correspondence.

Additionally, Experian criminally and falsely stated: "You requested that we add a statement of continued dispute to your credit file regarding an item that has never been investigated." Nonsense. A deliberate, intentional, knowing lie.

Your refusal to address this issue brought to your attention in the April 4 letter and failure to correct this knowing, deliberate false assertion are further indication Experian employees are criminal liars and have no regard for the truth.

The fraudulently obtained "item", (re-posted Datasearch on behalf of Baptist Air Life listing), had been earlier "investigated" by Experian and removed. How could it have been removed had there been no "investigation?"

Regardless, all four parties continue to criminally post private information obtained under false pretenses, when this burn survivor was in no condition to give informed consent.

The deliberate abuse, misuse, and distortion of provisions of the Fair Credit Reporting Act (FCRA) by Experian, Datasearch, Baptist Air Life, and Alexander Billing & Consulting are exquisitely illustrated not only by months of this ongoing fiasco, but by your disingenuous, distorted statement on p.1 of the April 19 report.

Your distorted, disingenuous statement, however, and FCRA itself do not absolve Experian of continued criminal responsibility for deliberately, knowingly, and willingly posting fraudulently obtained information. Nor does it protect and absolve Datasearch, Baptist Air Life, Alexander Billing & Consulting, and other credit reporting agencies from continued, fraudulent, criminal behavior in this matter.

Amusingly and moreover, no one ever suggested or asked the criminals at Experian to serve as "mediators" or "negotiators" as implied by your disingenuous, distorted statement. Rather, you have repeatedly been provided with evidence the Datasearch posting is fraudulent, yet have posted, removed, and then re-posted criminally obtained information.

In addition, your criminal alteration twice earlier and unlawful refusal to accurately post, both now and earlier the re-submitted File Explanatory Statement necessitated by the fraudulent Datasearch on behalf of Baptist Air Life listing, are highly indicative of knowing, deliberate, continuing, criminal activity on the part of Experian.

The deliberate use of unsigned canned computer-generated correspondence by "credit" reporting agencies to provide anonymity to criminal employees is not only unethical but criminal, -- which also should be of interest to the U.S. Attorney and Texas Attorney General.

All medical providers, with exception of Baptist Air Life, forgave all medical debt. When this burn survivor, however, refused to provide Baptist Air Life and its billing company, Alexander Billing & Consulting, with highly personal information unrelated to injuries and refused demanded prior consent to a future property search, they threatened further action.

-- But this burn survivor never heard from them again, or any other medical provider. The "action" subsequently taken was to illegally release highly personal information without permission, obtained under false pretenses at a time when this burn survivor was hospitalized and in no condition to give informed consent.

This egregious abuse of an indigent burn survivor with no assets, still disabled and unemployed, also demands publicity, media exposure. So others may protect themselves from the white-collar thugs at all four corrupt and abusive corporations.

While there may or may not be criminal prosecution and/or civil litigation, the white collar thugs at Experian, Datasearch, Baptist Air Life, Alexander Billing & Consulting, and other credit reporting agencies involved in this fiasco will be publicly exposed for the criminals they truly are.

First, all correspondence from all parties will be provided to national news magazines and other media. Second, all correspondence will be eventually posted on the Internet for public review. Indeed, a public service, so citizens can protect themselves from the thugs at all four corrupt and abusive corporations.

While this writer has not, and will not ever seek credit, can only imagine what those who do must be enduring. … With "credit" reporting agencies that have absolutely no regard for truth and accurate reports.

This fight is not about credit, however. It is about principle and an egregiously fraudulent, vengeful, criminal, abusive violation of rights of a still disabled burn survivor in an effort to collect an uncollectable medical debt. In Nazi America.

In response to the ongoing criminal activity of Experian employees and re-posting of the fraudulent Datasearch listing, the File Explanatory Statement is again re-submitted:

"As a burn survivor with no assets, all medical providers with exception of Baptist Air Life forgave medical expenses. Baptist Air Life did not do so because this burn survivor refused to provide highly personal information unrelated to injuries, declined demanded prior consent to a future property search. Vengefully, Baptist Air Life subsequently hired Datasearch to punitively post negative information on credit reports without knowing or willing permission of this burn survivor. Particularly punitive and vengeful, since at no time did Datasearch attempt or make contact with this burn survivor regarding the nearly $10,000 medically-required helicopter flight billing."

Kindly, continue to send unsigned, unresponsive, irrelevant, stonewalled, computer-generated drivel in response to ongoing correspondence from this writer alleging continued criminal activity by Experian and other parties.

… Including, unlawful denial of the right of this writer to have the File Explanatory Statement posted by Experian as allowed by the Fair Credit Reporting Act, and for months criminally abrogated by Experian.

All of it will be forwarded to federal and state authorities. Certainly, conveniently illustrates a pattern of deliberate and intentional criminal activity. Provides evidence of ongoing criminality and useful fodder. Most importantly, it proves ongoing criminal behavior on the part of Experian employees.

Your gutlessly unsigned, outrageously untimely, canned, computer-generated form letters of April 12 received April 16, remain outrageously unresponsive to this writer's earlier letters of March 22 & 23.

Clearly, the March 23, 2005 letter from this writer authorized posting of the earlier submitted File Explanatory Statement only if the Datasearch on behalf of Baptist Air Life listing was re-posted by Transunion. By your own admission, it was not. So, why then post the File Explanatory Statement anyway? What is the point? … Is the problem an inability to read, aggressive stupidity, criminal harassment? All three? Certainly, not accurate reports.

Your amusingly untimely posting of the File Explanatory Statement, re-labeled "Consumer Statement" by Transunion, months after the fraudulent Datasearch in behalf of Baptist Air Life listing was rightfully removed by Transunion, is further indication of the seemingly unlimited ineptness of your corporation. … Or Transunion's utter disregard of law and accurate reports.

… After all, the Statement was sent in response to the fraudulent Datasearch listing that you refused to remove for months. Why finally post it now? After the fraudulent Datasearch listing was rightfully removed by Transunion? After enormous pressure was indeed applied?

Worse, since you apparently now insist on posting it under conditions not authorized by this writer, why not at least correctly and accurately post it? … Datasearch was twice misspelled. So was the word "regarding." Don't you proof-read posted Statements that have no expiration date?

If, however, Transunion has no mechanism or policy to prevent Datasearch from periodically re-posting the very same fraudulent Datasearch on behalf of Baptist Air Life listing in the future, then it is the wish of this writer that the corrected File Explanatory Statement remain permanently on the record. … Do you finally understand the dilemma faced by this writer in regard to this seemingly unending medical catastrophe?

In addition, Transunion continues to fraudulently list a telephone number for this writer that does not exist. -- That was earlier criminally and fraudulently provided by Alltel. Why?

What does it take to get relief on all unresolved issues? Complaints to the U.S. Attorney and Texas Attorney General? Is Transunion truly that inept, -- or is it merely harassment and absolutely no regard for accurate reports?

Your use of three different mailing addresses, egregious failure to personally identify the sender of each piece of canned "correspondence", is exceptionally cowardly and designed to hide the identity of the Transunion employees engaged in fraudulent criminal behavior.

Sadly, the tactical employment of anonymity used by all "credit" reporting agencies (CRAs) and the amusing shell game played by each to obfuscate the truth are highly indicative of the criminal nature and tactics used by Transunion and its "competitors." … Can't dazzle 'em with brilliance, baffle 'em with BS.

As stated in earlier letters, this entire criminal matter including the earlier false Datasearch on behalf of Baptist Air Life listing will have to be resolved by the offices of U.S. Sen. Kay Bailey Hutchison, the Texas Attorney General, and the U.S. Attorney. It will also be widely circulated in the media regardless of outcome. The public must protect itself from the fraudulent criminals at "credit" reporting agencies. Predators, who must be exposed for what they are.

Sadly, due to egregious stonewalling, continued posted fraudulent and/or false information, criminal and congressional investigations of Transunion and other "credit" reporting agencies are desperately warranted and badly needed.

While this writer has not, and will not ever seek credit, can only imagine what those who do must be enduring. … With "credit" reporting agencies that have absolutely no regard for truth and accurate reports.

Again, the continued unsigned, unresponsive, canned, computer-generated form letter response of "credit" reporting agencies to all correspondence, as well as the criminally clever shell game played, is serious indication of the desperate need for criminal prosecution. Be sure to kindly continue stonewalling, sending similarly fraudulent material so it all may be forwarded to the U.S. Attorney.
