Re: 15th Update To October 14, 2004 Correspondence

Dear Senator:

The following is additional correspondence germane to this writer's earlier letter of October 14. Experian has criminally re-posted the fraudulent Datasearch on behalf of Baptist Air Life listing earlier removed, and has refused to immediately post the re-submitted File Explanatory Statement as allowed by law.

Ludicrously, they have falsely claimed the re-posted fraudulent Datasearch on behalf of Baptist Air Life was never investigated. Absolute nonsense, as indicated by the earlier removal of the fraudulent listing. It is time for a criminal investigation and prosecution. Yet, your office remains silent.

Transunion appears to have finally capitulated and has removed the fraudulent Alltel listing. Also, they indicate they have not re-posted the fraudulent Datasearch on behalf of Baptist Air Life listing as perpetrated by Experian. They have not, however, removed the fraudulent telephone number given them by Alltel still posted on the reports.

Furthermore, CSC Credit Services has yet to respond to all earlier correspondence. Apparently, the criminals at this abusive corporation are egregiously stonewalling the issue and have no intention of responding. Yet, your office remains silent.

The continued unsigned, canned, computer-generated form letter response of "credit" reporting agencies to all correspondence, as well as the criminally clever shell game played, is serious indication of the desperate need for congressional oversight and change. Yet, your office remains deafeningly silent.

You and your colleagues have allowed this nation-wide, population-wide fiasco to progress unchecked. Citizens do not know who has what information and where. No standards enforced. No one prosecuted on an individual basis. Not one piece of correspondence from these criminal corporations was personally signed. Not one.

-- The criminals gutlessly hide behind the mantle of anonymity. Yet, Congress remains silent.

Worse, Choicepoint considers itself an "intelligence" agency, since government and law enforcement routinely obtain private information from this outrageously abusive corporation. … Information that no citizen has knowingly or willingly given them permission to collect or disclose.

Now, a hacker has stolen Choicepoint data and created a false identity crisis for well over a hundred thousand consumers. With no federal law requiring this outrageous corporation to inform victims. Yet, Congress remains deafeningly silent.

-- As repeatedly stated in earlier correspondence, criminals at Experian and Transunion until January 12, 2005 had taken actions, regarding two fraudulent listings, directly opposite of one another.

… Proof-positive, the "credit" reporting industry is incapable of posting accurate information, serves only itself and the best interests of the business community. Certainly, not consumers. Yet, Congress remains gutlessly silent.

Sadly, Senator, we live in a fascist police state. Aided and abetted by outrageously unconstitutional laws that egregiously violate privacy, civil liberties, and constitutional rights. -- Statutes such as the USA "Patriot" Act, Homeland "Security" Act, and a number of equally unconstitutional Executive Orders. … As Franklin wisely stated over two hundred years ago, anyone willing to trade liberty for security deserves and winds up with neither.

Sadly, Senator, you and your colleagues are part of the problem. To date, the issues, including the criminal alteration and fraudulent posting of the File Explanatory Statement, remain unresolved. Ignored.

Why hasn't your office pressured an outrageously unresponsive Federal Trade Commission to thoroughly investigate these matters?

If not the Commission, precisely who in government is responsible for investigating and prosecuting individual complaints against criminal employees of "credit" reporting agencies?

Better check your reports, Senator. Anyone is subject to the abuse and fraudulent activity these criminal agencies wantonly engage in. Reportedly, 70% of all listings are false.

Why have you remained publicly silent regarding all these issues? Why haven't you supported recent efforts of your colleagues to force change? … Or are you too busy considering a run for governor and supporting our corrupt and abusive business community at the expense of your constituents? Do you really think your indifference to privacy issues and constitutional rights will conveniently remain hidden from voters?

Finally and respectfully, Senator, are you and your equally unresponsive colleagues politically beholden to the "credit" reporting "industry?" Is that the problem? … Or is it only "generous" corporate lobbyist "bribes" that secure your attention and that of your fellow legislators?

Dear Sir or Madam:

Your unsigned, computer-generated form letter dated March 30, 2005 is outrageously unresponsive. Worse, it contains the following egregiously false statement: "You requested that we add a statement of continued dispute to your credit file regarding an item that has never been investigated." Nonsense.

The fraudulently obtained "item", (re-posted Datasearch on behalf of Baptist Air Life listing), had been earlier "investigated" by Experian and removed. How could it have been removed had there been no "investigation?" Wake up.

Experian is again stalling and wasting this writer's time. For months. Time's up. If you do not remove the fraudulent re-posted Datasearch on behalf of Baptist Air Life listing, criminal complaints will immediately be filed with the U.S. Attorney and Texas Attorney General against Experian, Datasearch, Baptist Air Life, and Alexander Billing & Consulting.

… Both in regard to this matter, as well as the earlier fraudulent alteration of the File Explanatory Statement twice by Experian employees.

-- Ludicrously, the File Explanatory Statement had also been falsely, subsequently, and criminally attributed to a "creditor" (by criminal Experian employees) after this writer challenged the criminal alteration of the Statement by Experian. Interesting, isn't it? Will the criminality ever end? Apparently, not.

All four parties continue to criminally post private information obtained under false pretenses when this burn survivor was in no condition to give informed consent.

Any "investigations" conducted by all four parties are akin to the fox guarding the corrupt and abusive corporate chicken coop. -- Not one of whom, has any credibility. Zero.

Sadly, Experian is not the only offending "credit" reporting agency posting fraudulently obtained information in this case, -- which also should be of interest to the U.S. Attorney and Texas Attorney General.

The deliberate use of unsigned canned computer-generated correspondence by "credit" reporting agencies to provide anonymity to criminal employees is not only unethical but criminal, -- which also should be of interest to the U.S. Attorney and Texas Attorney General.

All medical providers, with exception of Baptist Air Life, forgave all medical debt. When this burn survivor, however, refused to provide Baptist Air Life and its billing company, Alexander Billing & Consulting, with highly personal information unrelated to injuries and refused demanded prior consent to a future property search, they threatened further action.

-- But this burn survivor never heard from them again, or any other medical provider. The "action" subsequently taken was to illegally release highly personal information without permission, obtained under false pretenses at a time when this burn survivor was hospitalized and in no condition to give informed consent.

Your criminal alteration twice earlier and unlawful refusal to accurately post, both now and earlier, the re-submitted File Explanatory Statement necessitated by the fraudulent Datasearch on behalf of Baptist Air Life listing, are highly indicative of knowing, continuing criminal activity on the part of Experian.

Experian cannot claim ignorance regarding this criminal activity after all correspondence sent to date: October 16, 2004; October 25, 2004; November 2, 2004; November 7, 2004; November 9, 2004; November 21, 2004; December 17, 2004; January 28, 2005; February 8, 2005; March 9, 2005; March 23, 2005. -- Some of these dates include letters sent to more than one Experian employee.

Interestingly, again, the criminal re-posting of fraudulently obtained information is no more than punitive action taken in revenge for an uncollectable medical debt. -- Not forgiven because this writer refused to provide Baptist Air Life, Alexander Billing & Consulting, and consequently Datasearch personal information unrelated to injuries, and refused demanded prior consent to a future property search.

This egregious abuse of an indigent burn survivor with no assets, still disabled and unemployed, also demands publicity, media exposure. -- So others may protect themselves from the white-collar thugs at all four corrupt and abusive corporations.

While this writer has not, and will not ever seek credit, can only imagine what those who do must be enduring. … With "credit" reporting agencies that have absolutely no regard for truth and accurate reports.

This fight is not about credit, however. It is about principle and an egregiously fraudulent, vengeful, criminal, abusive violation of rights of a still disabled burn survivor in an effort to collect an uncollectable medical debt. In Nazi America.

Dear Sir or Madam:

Your gutlessly unsigned, outrageously untimely, canned, computer-generated form letters of March 22, 2005 received March 28, remain outrageously unresponsive to this writer's earlier letters of March 9, 2005, February 17, 2005, January 28, 2005, January 11, 2005, December 17, 2004, November 21, 2004, and November 2, 2004.

… Letters sent in response to your equally unresponsive correspondence of March 16, 2005, March 2, 2005, February 11, 2005, January 19, 2005, December 30, 2004, December 6, 2004, December 3, 2004, November 9, 2004, October 25, 2004, and September 29, 2004. Each an exquisite example of corporate stonewalling and systemic deception.

In addition, this writer has received no response to two additional letters dated March 22, 2005 and March 23, 2005 sent to Transunion Consumer Relations.

The latest reports received from you, however, dated March 22 falsely indicate an "investigation" was conducted by Transunion. What "investigation?" This writer was never contacted by anyone at Transunion in regard to this "investigation." All correspondence to date from Transunion has been unsigned, computer-generated form letters unresponsive to every piece of correspondence sent.

Clearly, you still do not verify accuracy of fraudulently released information. Had you bothered to do so, you would have immediately ascertained the telephone number fraudulently provided by Alltel is false. This writer has no phone. … Then again, don't confuse the criminals at "credit" reporting agencies with the truth. Right? Yet, you continue to fraudulently list the non-existent number on the latest report dated March 22, 2005. Why?

Again, had you truly conducted an "investigation", you would have immediately ascertained this writer has no phone. The corporate liars at Alltel falsely supplied the number at the time they falsely and under false pretenses ran an unrequested, unwanted "credit" check never authorized by this writer. They had deceptively agreed to provide service on the basis of a cash deposit. If they claim otherwise, they are liars.

Under "Regular Inquiries" on the report you have falsely listed "CREDIT TRANSACTION" as "Permissible Purpose." This never occurred. There was no "credit transaction." Where did you receive this false information?

From the deceptive liars at Alltel, including Wayne Ploeckelmann, Sales & Service Representative, the Alltel employee responsible for deceptively running the unrequested, unauthorized "credit" check under false pretenses? At least according to his business card?

… Conveniently, the fox guarding the corporate chicken coop? Or was the Ploeckelmann business card provided by the Alltel employee involved in the fiasco that of his supervisor since the encounter occurred in Marble Falls, not Temple?

Precisely, how was your phony "investigation" conducted? As also allowed by law, kindly release the names, addresses, and telephone numbers of anyone contacted for "information." Also, disclose the identity of the Transunion employees involved in this kangaroo "investigation", no more than a phony charade, so they may be passed on to the U.S. Attorney, Texas Attorney General, U.S. Sen. Kay Bailey Hutchison, and the media.

Experian has rightfully chosen to delete the fraudulent Alltel request for a "credit check" on the "credit" report, -- fraudulently and deceptively obtained by Alltel under false pretenses. Why haven't the fraudulent criminals at Transunion followed suit?

The fact two "credit" reporting agencies can't agree, doing directly the opposite with the same two fraudulent listings, is proof-positive the "credit" reporting system is hopelessly fraudulent and grossly inaccurate.

Proof-positive, the "credit" reporting industry is incapable of posting accurate non-fraudulent information, serves only itself and the best interests of the business community. Certainly, not consumers.

… Amazing, the white-collar thugs at two major corrupt corporations can't get their fraudulent stories straight, isn't it? Would be laughable, if not so damned pathetic.

Your use of three different mailing addresses, egregious failure to personally identify the sender of each piece of canned "correspondence", is exceptionally cowardly and designed to hide the identity of the Transunion employees engaged in fraudulent criminal behavior.

Sadly, the tactical employment of anonymity used by all "credit" reporting agencies (CRAs) and the amusing shell game played by each to obfuscate the truth are highly indicative of the criminal nature and tactics used by Transunion and its "competitors." … Can't dazzle 'em with brilliance, baffle 'em with BS.

As stated in earlier letters, this entire criminal matter including the earlier false Datasearch on behalf of Baptist Air Life listing will have to be resolved by the offices of U.S. Sen. Kay Bailey Hutchison, the Texas Attorney General, and the U.S. Attorney. It will also be widely circulated in the media regardless of outcome. The public must protect itself from the fraudulent criminals at "credit" reporting agencies. Predators, who must be exposed for what they are.

Kindly continue to send unsigned, computer-generated, outrageously unresponsive "correspondence" to continuing, unanswered criminal accusations. … Certainly, confirms inherent, systemic corruption within Transunion. Also, usefully provides further evidence of ongoing criminal activity. Sadly, criminal and congressional investigations of Transunion and other "credit" reporting agencies are desperately warranted and badly needed.

Without question, citizens must be protected from the criminal thugs at Transunion and other CRAs. Sadly, the fraudulent listings, (in this case alone, at several different CRAs this writer is currently aware of), are staggering and impossible to correct without additional help from a U.S. Senator and the U.S. Attorney. -- Directly due to outrageous stonewalling, anonymity afforded criminal employees, and the amusing shell game played by the criminal thugs at "credit" reporting agencies.

While this writer has not, and will not ever seek credit, can only imagine what those who do must be enduring. … With "credit" reporting agencies that have absolutely no regard for truth and accurate reports.
