Re: 44th Update To October 14, 2004 Correspondence

Dear Ms. Barker:

With midterms quickly approaching, seems the GOP is indeed in danger of receiving the boot, -- due to a variety of issues including Iraq, the "War On Terror," the Foley fiasco, warrantless domestic spying, abrogation of the Geneva Conventions, obliteration of the Fourth, Fifth, Sixth, and Eighth Amendments, and a whole host of other issues. Tough, isn’t it?

Before again addressing the ongoing, unresolved credit reporting agency fiasco ignored by your office, however, pending legislation "legalizing" warrantless NSA spying on American citizens is appalling. So are outrageously unconstitutional "national security letters" which enable FBI and other federal goons to access personal information without a warrant.

Threatened prosecution of those who receive one and disclose the fact is an atrocious abrogation of the First Amendment and a classical example of kangaroo "justice" in Nazi America. Hitler and Mussolini would have indeed been proud. … As they would have been of the "President" and his effort to redefine torture and "strengthen" "interrogation" of "detainees." In direct violation of the Geneva Conventions. Doesn’t the GOP understand the same standards will be applied to captured American forces? Outrageously unconstitutional passed legislation nothwithstanding?

The recent editorial written by Sen. Hutchison defending the USA "Patriot" Act is equally appalling and truly indicative of her chilling indifference to civil and constitutional rights and liberties. … Sadly, as well, demonstrative of her profound unfitness for office.

Despite the deliberate evisceration of the Bill of Rights, our country is no safer, just increasingly, alarmingly repressive. The embrace of fascism by the GOP, i.e. the pernicious blend of government, business, and religion, is a far greater threat than any enemy, domestic or foreign. Particularly, since the cowardly Right uses the perversion and bastardization of "religious" principles to defend and "justify" its embrace. … As did Adolph Hitler and Benito Mussolini back in the 30’s.

Pathetically and in a related matter, it appears the "President" of the United States and his henchmen have deliberately pressured Britain to pre-maturely arrest 24 British nationals in the current terrorist "plot" fiasco. Reportedly, this was done before British law enforcement had sufficient time to complete the investigations.

Consequently, some of these cases may have been needlessly compromised. Exactly, what has also happened in our formerly great country. Precisely, why charges have been repeatedly reduced in domestic "terrorism" cases, and only one offender has received serious time. Even so, Zacharias Moussaoui was unconstitutionally allowed to plead guilty to a crime he claims not to have committed. Right up to the time of his sentencing. Kangaroo justice, in Nazi America. The "judge," Leone Brinkema, should have been impeached.

… Care to bet the "President" will eventually nominate her to a higher court? Reverse Darwinism, survival of the unfittest? … As in the case of "Judge" Priscilla Owen and other fascists nominated by Mr. Bush? … Fascist "judges" who gleefully "legislate" their perverse ideology and "religious" views from the bench while falsely claiming to be impartial. Amusingly, however, a shamelessly disingenuous "President" rightfully labeling terrorists "Islamic fascists" is akin to the pot calling the kettle black. Fascism is fascism, -- whether "Islamic," or in the "President’s" case, "Christian." Tragically, two sides of the very same hopelessly intolerant coin.

Sadly, domestic statutes are so broadly and vaguely written innocent people are frequently caught in the perverse web deliberately and cleverly created by gutless, cowardly legislators. -- "Legislators" far more interested in pandering to the Nazi Right in our formerly great country than doing what’s right and constitutional. "Surveillance of a vulnerable terrorist target" can mean anyone could be falsely arrested and prosecuted for taking a scenic photograph. … Think tourists don’t think twice before snapping a picture of Buchanan Dam?

Worse, it is indeed lawful for federal thugs to lie with impunity to citizens. There is, however, a clever double standard at play. "Lie" to a federal officer, and prepare to be prosecuted. Tell the absolute truth to such an agent, however, and the corrupt and abusive bastard will likely, if convenient and politically expedient, distort and convolute what he’s told, leading to the prosecution of the "offender" anyway. Nazi, kangaroo "justice." A most clever Catch-22. … Why would anyone "cooperate" with a federal officer without benefit of counsel and a tape recorder?

Federal officials are seldom held accountable for dereliction of duty, malfeasance, or criminal activity. -- No one in the State Department was held accountable or criminally prosecuted for issuing 19 visas to the "Islamic fascists" responsible for 9/11. Had comprehensive background checks been done, the catastrophe could likely have been prevented. Yet, the "President" and his henchmen have protected and coddled this outrageous dereliction of duty. Inexplicably, for the sake of political expediency and party loyalty.

Sadly, the United States has created this Islamic terrorist monster. Six decades of unbridled support of the State of Israel has exacerbated and nurtured this exponentially growing problem. The "green light" foolishly given Israel recently by the "President" and his henchmen to deliberately target innocent Lebanese civilians and pulverize infrastructure has backfired, solidifying support of Hezbollah.

-- Outrageous intentional targeting of civilians that was far, far more than just "collateral damage." Direct violation of U.S. weapons export law. Israel can do no wrong in the outrageously myopic view of the American government, -- despite the fact it (Israel) cleverly used and perfected the very same terrorist tactics it now deplores used against it while creating the State of Israel. Nothing quite like hypocrisy, is there? An outrageous double standard.

While this conflict indeed dates back to biblical times, Arabs have never been fully compensated for seizure of their land 58 years ago. Worse, the U.S. has not been an even-handed broker in the region. Apparently, never will be. We continue to seemingly permanently garrison American troops in Islamic countries, which is highly offensive to the Moslem community. Knowingly insist on doing so. We continue to callously and Aryan arrogantly support the outrageously corrupt and abusive House of Saud for political "reasons" and financial expediency.

We refuse to become energy independent due to the insatiably greedy energy industry and its unwillingness to aggressively pursue alternative energy sources for self-serving reasons. Financial contributions to the coffers of legislators, no more than bribes, are clearly and directly responsible for our failure to become energy independent fifty years ago. … How much money has the Senator received from this industry over the years?

Since the fascist currently occupying the Oval Office and his henchmen are unwilling to change U.S. policy, expect the global "War On Terror" to go on indefinitely and be ultimately lost. Sadly, as likely will the wars in Afghanistan and Iraq. Mr. Bush has needlessly squandered military resources that will likely require decades to remedy. The "President" has foolishly and inexplicably created a terrorist haven in Iraq that did not exist prior to our invasion under glaringly false pretenses.

After all, weapons inspectors repeatedly warned Mr. Bush there were no weapons of mass destruction. Indeed, there weren’t. He invaded anyway, stupidly creating still yet another generation of terrorists and mindlessly flaming intense hatred of the United States. For no legitimate reason. Over 2600 of our best and brightest have been killed. Another 20,000 have been maimed. For nothing other than the sad gluteus maximus of the fascist occupying the Oval Office.

Clearly, the senior senator from Texas has absolutely no appreciation of the swiftly changing political climate and exponentially increasing voter dissatisfaction,

-- particularly the GOP embrace of Fascist Right principles in our formerly great country. The Founders must indeed be spinning in their graves. With presidential poll numbers tanking, and congressional approval currently barely above 20% at the time of this writing and dropping, isn’t it time for Senator Hutchison to finally become responsive to constituent issues and concerns? … Or is the Senator too hopelessly arrogant to appreciate the increasingly fragile position of the GOP and certain coming voter retaliation in November?

Amusingly, this is the 44th time, and counting, this correspondence has been conveniently ignored by the Senator and/or her office. … Nothing quite like competent constituent service, is there? Then again, this is Nazi America, isn’t it?

-- Where day is night, night is day, and manure smells perversely sweet. … Where only corporate donors and the rich are serviced by outrageously corrupt and abusive politicians, right? While Democrats are clearly no better than their fascist Republican compadres, think approaching midterms will finally bring a little fresh air?

… Or will it take a figurative political bloodletting, -- courtesy of convicted felon Jack Abramoff and federal prosecutors hellbent on exposing congressional and presidential corruption? Failing that, an enlightened electorate will wisely throw all Democratic and Republican incumbents out on their ear in November. The only other alternative is unthinkable, -- a second American Revolution. Regardless, should Democrats retake the House, hopefully they will more than censure the "President." -- Impeachment could, and should, be a possibility, in light of warrantless domestic surveillance and the invasion of Iraq under false pretenses.

… How could any senator vote to confirm Gen. Michael Hayden as CIA chief? A man who has disgraced the uniform and abrogated his oath of office to protect and defend the Constitution? Particularly, the Fourth Amendment through implementation of warrantless domestic spying while head of NSA? … On a "happier" note:

Joining Transunion, Experian has apparently finally capitulated and removed both fraudulent listings, -- Alltel, and Datasearch on behalf of Baptist Air Life. The word "apparently" is used, however, since Experian previously removed both, only to subsequently re-post the fraudulent Datasearch listing. Regardless, CSC Credit Services and Equifax continue to stonewall all correspondence from this writer. … Ongoing egregious CRA stonewalling that continues to be ignored by Senator Hutchison and her office for well over a year. When will the Senator finally take action?

Did you bother to read the case file? All 43 letters? The information sent from the Federal Trade Commission (FTC) in your letter of September 14, 2005 is outrageously unresponsive to all unresolved issues to date, and amusingly identical to material sent months ago by James Alredge. Did you bother to read it? It’s worthless. Why waste taxpayer funds? … Can’t dazzle ‘em with brilliance, baffle ‘em with bureaucratic BS? Is the outrageous ineptness systemic? Intentional? Deliberately designed to obfuscate? Would indeed be laughable, if not so incredibly sad.

This is the second time two employees of the Senator’s office pulled the exact, same "dog and pony show." Apparently, the Senator approves of such outrageous tactics, obfuscation, and pathetically ineffective constituent "services." -- Cleverly and conveniently, prevents her from having to deal with some of the worst corporate and federal abuses of our time. … Wouldn’t want to offend outrageously corrupt and abusive corporations, however, would she? After all, they shamelessly line her war chest and those of her colleagues, don’t they?

Worse, both "dog and pony shows" exquisitely demonstrate how very little respect the Senator truly has for her constituents’ intelligence. -- Then again, only "big money" receives competent consideration and effective senatorial services, right?

Outrageously, the packet of material callously sent by your office includes copies of canned, computer-generated FTC letters to other constituents identified in that worthless correspondence. Clearly, the Senator couldn’t care less about the privacy of her constituents. … Indeed, proof-positive, Ms. Hutchison is callously unconcerned with abuse of information not only by credit reporting agencies, but even in her office.

The following issues have been conveniently ignored by the Senator for months:

First, Experian has fraudulently altered this writer’s File Explanatory Statement three times over the last year. -- A statement well-within FCRA and FTC guidelines that was deliberately and fraudulently altered to protect the identities of corrupt and abusive corporations.

Second, Experian has refused to permanently remove this writer from mailing lists, cynically demanding further non-germane personal information to do so.

Third, Baptist Air Life, Datasearch, and Alexander Billing and Consulting posted fraudulently-obtained personal information because: 1) this writer refused to answer questions unrelated to the medically-required $10,000 helicopter flight to the burn center, and 2) refused consent to a demanded future property search.

Fourth, CSC Credit Services and Equifax continue to stonewall all correspondence from this writer and have refused to post the File Explanatory Statement as allowed by FCRA and FTC regulations, -- and well within guidelines. CSC disingenuously demands further personal information that this writer has not, and will not, provide. … Neither to them, Experian, or any other credit reporting agency (CRA.)

These four issues, as well as others described in earlier correspondence, need to be fully investigated by FTC. Yet, the Senator has refused to pressure FTC to investigate individual cases. Particularly, this one. Why?

Why is Ms. Hutchison deliberately protecting and coddling outrageously corrupt and abusive corporations that have posted fraudulently-obtained data? Intentionally, shafted a burn survivor who refused to provide information not germane to injuries, and refused consent to a demanded future property search?

Worse, the Senator has filed no legislation redressing these outrageous credit reporting agency abuses. Clearly, she has no interest in these abuses. … Nor does she have any interest in civil and constitutional rights and liberties, -- as demonstrated by her support of outrageously unconstitutional legislation such as the USA "Patriot" Act, Homeland "Security" Act, "Real" ID Act, etc., and other equally unconstitutional Executive Orders all cleverly designed to eviscerate the Fourth, Fifth, Sixth, and Eighth Amendments. … Falsely, in the name of "national security."

The ultimate threat to "national security" comes not from al Qaeda or any foreign adversary. Rather, it comes from outrageously unresponsive, corrupt and abusive government at all levels.

The Senator and/or her office have repeatedly refused to answer the most critical question of all. If not the Federal Trade Commission, who is responsible for investigating and prosecuting individual complaints against outrageously corrupt and abusive CRAs? The U.S. Attorney? If not, precisely who? If no one, who protects ordinary citizens against fraud deliberately perpetrated by outrageously corrupt and abusive credit reporting agencies?

Again, why has the Senator refused to introduce legislation to correct this terrible injustice against millions victimized by these lawless corporations designed only to serve themselves and the business community, certainly not consumers?

Upon re-launch of this publication, correspondence from all parties will be published on the website. After all, the public must be made aware of how corrupt and abusive corporations have deliberately abused a burn survivor, and precisely how the Senator has done absolutely nothing to date to correct the injustice.

… Has taken absolutely no personal interest. Has exerted no pressure on FTC. Has introduced no legislation to correct these abuses. Sadly, the senior Senator from Texas, up for re-election, will be exposed to her constituents for exactly what she is. -- A pawn and servant of outrageously corrupt and abusive corporations.

After 44 letters, and counting, the Senator is not able to claim ignorance. Nor is she able to blame inept, unresponsive staff. After all, the buck indeed stops with the Senator. … Think Texans will ever wake up and hold outrageously corrupt and abusive politicians accountable? Perhaps, coming prosecutions of congressional and Bush "Administration" staffers and officials may indeed shed a little unwanted light, no?
